CIRCUIT COURT STATE OF WISCONSIN CRIMINAL DIVISION MILWAUKEE COUNTY CRIMINAL COMPLAINT, ‘STATE OF WISCONSIN DA Case No.:2016ML019211, Plaintiff, vs. Complaining Witness: Fowler, Patrick D Court Case No.: 9314 West Sheridan Avenue - IS cM 318 | Milwaukee, WI 53225 DOB: 03/27/1984 Defendant, THE ABOVE NAMED COMPLAINING WITNESS BEING DULY SWORN, ON INFORMATION AND BELIEF STATES THAT: Count 1: MISDEMEANOR BATTERY, DOMESTIC ABUSE ASSESSMENTS: ‘The above-named defendant on or about Sunday, August 23, 2015, at 9314 West Sheridan Apt. 2, in the City of Milwaukee, Milwaukee County, Wisconsin, did cause bodily harm to C.T., by an act done with intent to cause bodily harm to that person, without that person's consent, contrary to see, 940.19(1), 939.51(3)(a), 973.055(1) Wis, Stats. ‘Upon conviction for this offense, a Class A Misdemeanor, the defendant may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both. ‘And further, invoking the provisions of sec. 973.055(1) Wis. Stats., because this charge is an act ‘of domestic abuse, the court shall impose the domestic abuse assessment of $100 for this offense because this charge is an enumerated crime under sec. 973.055(1)(a)1, Wis. Stats., and the conduct constituting the violation involved an act by the defendant against his or her spouse, against an adult with whom the defendant resides or formerly resided, or against an adult with whom the defendant has created a child ‘Count 2: DISORDERLY CONDUCT, DOMESTIC ABUSE ASSESSMENTS ‘The above-named defendant on or about Sunday, August 23, 2015, at 9314 West Sheridan Apt. 2, in the City of Milwaukee, Milwaukee County, Wisconsin, while in a private place, did engage in abusive, profane, unreasonably loud, violent or otherwise disorderly conduct, under circumstances in which such conduct tended to cause a disturbance, contrary to sec. 947.01(1), 939.51(3)(b), 973.056(1) Wis. Stats. Upon conviction for this offense, a Class B Misdemeanor, the defendant may be fined not more than One Thousand Dollars ($1,000), or imprisoned not more than ninety (90) days, or both. And further, invoking the provisions of sec. 973.055(1) Wis. Stats., because this charge is an act of domestic abuse, the court shall impose the domestic abuse assessment of $100 for this, offense because this charge is an enumerated crime under sec. 973.055(1)(a)1, Wis. Stats., and the conduct constituting the violation involved an act by the defendant against his or her spouse, against an adult with whom the defendant resides or formerly resided, or against an adult with whom the defendant has created a child. Patrick D Fowler, DOB: 03/27/1984 Page 2 of 2 Probable Causé Complainant is a law enforcement officer employed by the City of Milwaukee Police Department and bases this complaint upon offical reports prepared by fellow Milwaukee Police Oficers, Which are of the kind that complainant knows to be prepared in the regular course of that department's business and which complainant has used in the past and found to be accurate and reliable, Officer Ryan Kramschuster reports that on August 23, 2015 at approximately 1:14, he was dispatched to the above-stated location. C.T. (02/13/1987) states that the above-named defendant, C.T.’s former live-in boyfriend, was jealous and confrontational with her. C.T. reports that the defendant threw her to the ground in a bedroom, put his weight on her back, and held a knife to her throat with one hand while pulling her head back, using her hair, with the other hand. This caused C.T. pain. The defendant stated, “you're not gonna leave me, if you try to leave me, we're both gonna leave together.” C.T. did not consent to this conduct. C.T. further states that the defendant threw her to the floor again and pushed her into a wall C.T. states she was able to escape from the apartment to seek help from neighbors and police. “End of Complaint™*** Subscribed and sworn to before me and approved for fling this day of August, 2015. Thomas, by an act done with intent to cause bodily harm to that person, without that person's consent, contrary to sec. 940.19(1), 939.51(3)(a), 968.078(1)(a), 939.62(1)(a) Wis, Stats. Upon conviction for this offense, a Class A Misdemeanor, the defendant may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both. ‘And further, invoking the provisions of sec. 968.075(1)(a) Wis. Stats., because this charge is an act of domestic abuse, costs upon conviction would include the domestic abuse assessment imposed under sec. 973.055(1) Wis. Stats. And further, invoking the provisions of sec. 939.62(1)(a) Wis. Stats., because the defendant is a repeater, having been convicted of at least one felony during the five year period immediately preceding the commission of this offense, which remains of record and unreversed , the maximum term of imprisonment for this offense may be increased to not more than 2 years. Count 2: DISORDERLY CONDUCT, DOMESTIC ABUSE, REPEATER The above-named defendant on or about Saturday, May 18, 2013, at 3042 N "A" 10th St, in the City of Milwaukee, Milwaukee County, Wisconsin, while in a private place, did engage in violent, abusive, or otherwise disorderly conduct, under circumstances in which such conduct tended to cause a disturbance, contrary to sec. 947.01(1), 939.51(3)(b), 968.075(1)(a), 939.62(1)(a) Wis, Stats. Upon conviction for this offense, a Class B Misdemeanor, the defendant may be fined not more than One Thousand Dollars ($1,000), or imprisoned not more than ninety (90) days, or both. And further, invoking the provisions of sec. 968,075(1)(a) Wis. Stats., because this charge is an act of domestic abuse, costs upon conviction would include the domestic abuse assessment imposed under sec. 973,055(1) Wis. Stats., because the defendant is a repeater, having been convicted of at least one felony during the five year period immediately preceding the commission of this offense, which remains of record and unreversed , the maximum term of imprisonment for this offense may be increased to not more than 2 years. ‘Complainant is a City of Milwaukee Police Officer and bases this complaint upon review of the reports of Officer Gilberto Collado, which Complainant believes to be truthful and reliable because Complainant has relied upon similar reports in the past and found them truthful and reliable and because Complainant is aware that such reports are prepared in the ordinary course of the official work of the City of Milwaukee Police Department. Officer Collado bases his report upon the statements of Christina Thomas. On May 18, 2013, ‘Thomas was at home at 3042 North 10" Street with her live-in boyfriend, the defendant. When ‘Thomas woke up, she noticed the defendant on the computer. She asked the defendant why he was on the computer so early as it was before 6:00 AM. The defendant became upset and began to’yell and grab at Thomas. This resulted in marks to Thomas's neck and arms. The defendant mother then entered the room and calmed the situation down. All three parties began walking downstairs. The defendant and Thomas continued arguing. The defendant yelled “call the police and watch what will happen.” He then punched Thomas in the face several times. He then fled. As a result of the defendant's actions, Thomas suffered a knot to her forehead, swelling and redness to her eye, marks on her neck and arms, and pain. She did not consent to the defendant's actions. This complaint is further based upon Complainant's examination of the official records maintained by the Milwaukee County Clerk of Circuit Court, which reflect that on October 15, 2009, the defendant was convicted in the Circuit Court of Milwaukee County, in Felony Case No.: 2009CF3193 of the felony offense of Sex Registry Violation, in violation of Wisconsin Statutes Section 301.45(6)(a)1, and that said conviction remains of record and unreversed. Stats. Upon conviction for this offense, a Class H Felony, the defendant may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than six (6) years, or both. Complainant states s/he's a City of Milwaukee Police Officer and this complaint is based on the following information and belief. Jacque F. reported that he is 16 years old with a date of birth of 6/9/93. He stated that on the above date he and his sister, Samantha, stopped by the home of another sister, Mercedes, who lives at 2013 West Burnham Street, City and County of Milwaukee, with her boyfriend, the defendant. Jacque stated that a heated discussion resulted in Jacque deciding to leave and as he and Samantha started to leave, the defendant threw his girfriend, Mercedes, to the floor and the defendant was about to jump on Jacque so Jacque and Samantha waiked out to the alley and headed home. As Jacque got to the nearby alley, the defendant suddenly came running up behind Jacque, yelling at Jacque and the defendant swung his fist and missed hitting Jacque and then the defendant kneed Jacque hard in the face; the defendant then repeatedly punched and kicked Jacque, knocking Jacque down to the ground; as Jacque was on one knee, the defendant choked Jacque with his forearm which impeded Jacque's breathing. Jacque stated that he forced the defendant's arm off his neck and finally broke free. He reported that he suffered pain and soreness and a fractured nasal cavity bone as a result of the defendant's attack on him. “End of Complaint’ Subscribed and swom to before me and approved for filing this day of June 2009.
