PREAMBLE

We, the student under the College of Technology (CT), taking up Bachelor of
Science Technology courses of University of Science and Technology of Southern
Philippines imploring the aid of the Almighty God, in order to establish the Student Council
of Technology (SCT), which shall embody our ideals and aspirations, promote the
common good, instill the spirit of the fellowship among our colleagues, to uplift and
support the programs and activities of the Council and College, do hereby ordain and
promulgate this constitution and by-laws.

ARTICLE I: NAME, SCOPE, AND DOMICILE

SECTION 1:
This organization shall be called Student Council of Technology and shall have an
acronym of SCT. In this connection, the SCT shall be referred to as a council.

SECTION 2:
The Student Council of Technology shall cover all students under the College of
Technology of University of Science and Technology of Southern Philippines.

SECTION 3:
The main office of the Student Council of Industrial and Information Technology
shall be located at bldg. 3 of the College of Technology, University of Science and
Technology of Southern Philippines, Lapasan, Cagayan de Oro City.

ARTICLE II: DECLARATION OF PRINCIPLES AND POLICIES

SECTION 1:
The Council is an independent student organization governing all students under
the College of Technology of University of Science and Technology of Southern
Philippines.

SECTION 2:
The Council shall adhere to the policy of peace, equality, justice, freedom,
cooperation, and amity of all sectors of the society.

SECTION 3:
The Council shall adhere to the policy of non-active violence in pursuing its
guidelines and policies.

SECTION 4:
The Council shall promote genuine concern for its members in an effort to attain
their holistic development.

SECTION 5:
The Council shall safeguard the members rights and welfare, including profound
nationalistic consciousness necessary for constructive citizenship.

SECTION 6:
The Council shall establish a strong department representation in the formulation
and application of policies affecting the members in the academic and extra-curricular
affairs.

ARTICLE III: OBJECTIVES

SECTION 1:
To organize a unified body of all the student under the College of Technology (CT)
of University of Science and Technology of Southern Philippines.

SECTION 2:
To provide the members with well-defined input and obligations and to promote
and safeguard their welfare and interest according to their privileges.

SECTION 3:
To provide procedures for the establishment of a harmonious relationship between
the Council and the School Administrators.

SECTION 4:
To maintain peace and order, and to work with the School Administrators in the
development of the physical, mental, spiritual, social, political and moral aspects of the
members.

SECTION 5:
To trait and promote leadership potentials of the members, cognizant to the vital
role that they play in the school-training in particular and nation building in general.

ARTICLE IV: RIGHTS AND PRIVILEGES OF MEMBERS

SECTION 1:
Every member shall have the right to be informed on matters concerning students
right and welfare.

SECTION 2:
Every member shall have the right to voice out opinions, suggestions, and other
constructive criticism on all matters discussed during the General Assembly.

SECTION 3:
Campus freedom of speech or of the press, or the right of the members assemble
peaceful petition to the school authority for redress of grievances should be responsible
for the consequences of any act.

SECTION 4:
Every member shall have the right to be elected or appointed for any objective
position, to vote, and to participate in the deliberation of the Council.

SECTION 5:
Every member shall have the right to use or utilize the school facilities and
equipment for their academic learning.

SECTION 6:
Every member shall have the right to participate in activities, which will promote
their physical, mental, spiritual, social, political, and moral development.

ARTICLE V: DUTIES AND OBLIGATIONS OF THE MEMBERS

SECTION 1:
It shall be the duty of every member of the Council to abide all provisions stated in
this constitution as stated herein:

a. To observe the existing laws of the council.

b. To attend all General Assemblies and Dialogues called by the council


c. To pay the corresponding fees for SCT fee of Php 130.00,as well as the new
membership fee for the following unit organizations; SECT Php 100.00 ,
SAMS Php 85.00, SUEMTS Php 135.00, SUETS Php 75.00.
d. To support and participate in all activities concerning the enlistment of the
College of Technology Department.
e. To cast their votes provided that he/she is qualified in every election being
conducted.

SECTION VI: SUFFRAGE


SECTION 1:
Suffrage shall be exercised by all members of the SCT, provided that he/she must
be a bona fide student under College of Technology.

SECTION 2:
The committee on elections shall provide a system for securing the sanctity of all
the ballots.

ARTICLE VII: ORGANIZATIONAL STRUCTURE

SECTION 1:
The governing body of the SCT shall be the Executive Body composed of elected
officials.

SECTION 2:
The Executive Body shall be composed of the Council President, Vice President
Internal, Vice President External, General Secretary, Associate Secretary, Treasurer,
Auditor, Public Information Office and the Departments.

SECTION 3:
The Legislative Body or the SCT Cabinet shall be composed of all Unit
Organization President in the College of Technology.

SECTION 4:
In case the Board of Committees is an elected official of the Council, the Vice
President shall automatically be called to be the member of the Board of Committees.

ARTICLE VIII: THE LEGISLATIVE

It shall be the responsibility of the SCT Legislative to formulate laws, resolution


manifesto, and referendums to promote the students welfare supportive of the objectives
of the council.

SECTION 1:
The Legislative shall be composed of Unit Organization Presidents.

SECTION 2:
The Legislative may chair a special committee as created by the President.

ARTICLE IX: THE SCT OFFICERS

SECTION 1:
The SCT Officers shall be composed of the Council President, Vice President
Internal, Vice President External, General Secretary, Associate Secretary, Treasurer or
Financial Manager, Auditor, Public Information Officer and the Departments. They shall
be called the Executive Body.

SECTION 2:
Any bona fide student under College of Technology may run for the SCT Office
provided he/she must:

a. Have enrolled and completed at least one school year of academic work for the
position of President and Vice-Presidents.
b. Carry a regular load as prescribed by the College.
c. Have not been found guilty in any disciplinary cases and actions.

ARTICLE X: POWER AND FUNCTIONS OF THE SCT OFFICERS

SECTION 1:
The President as the chief executive of the Council has the following powers and
functions:

a. Sign all communications, papers and resolutions of the Council provided that
the resolutions are concurred by a majority of the officers present during the
meeting of the Council.

b. Create Ad Hoc or special committees(s) and appoint its staff or members, as


well as the delegates or representative to any external affairs affecting the
Council as may be recommended by the Council.
c. He must represent the Council in his capacity as the chairperson in occasions
or events where organizations need representation.
d. Responsible in informing his constituents of the undertaking, plans, programs
of the council.
e. Preside over all regular, special, emergency meeting and general assembly of
the SCT.
f. Perform such other duties as may deem necessary or incidental to discharge
the functions of his office.

SECTION 2:
The Vice President Internal shall:

a. Preside over all meetings of the Council if in case the President gives him the
power to do so, provided that in case he desires to take part in discussions or
debate, he may name any member of the Council to take the chair.
b. Take over the functions of the President whenever his office is vacant by
reason of death, resignations, removal, suspension, illness, physical or mental
incapacity and his failure to qualify for office.
c. Perform such duties concerning the internal affairs of the Council including the
office and management.
d. Perform and accomplish assignments as delegated by the President
e. As the head for the Departments, the Vice President for internal will supervise
oversee the roles and responsibilities of the every Departments.

SECTION 3:
The Vice President External shall:

a. Preside over all meetings of the Council if in case the President gives him the
power to do so, provided that in case he desires to take part in discussions or
debate, he may name any member of the Council to take the chair.

b. Take over the functions of the Internal Vice President whenever his office is
vacant by reason of death, resignation, removal, suspension, illness, physical
or mental incapacity and his failure to qualify for office.
c. Perform such duties concerning the external affairs of the Council including
social affairs and events that may rise
d. Introduce and implement external activities inside the organization.
e. Perform and accomplish assignment as delegated by the President.
f. As the head for the Legislatives, the Vice President for External will supervise
oversee the roles and responsibilities of every Unit Organizations.

SECTION 4:
It is the duty of the General Secretary to:

a. Keep all papers, records, documents, files and correspondence of the Council.
b. Take the minutes of all meetings of the Council.
c. Keep records of all standing and special Committees.
d. Responsible for keeping files of the Office Inventory.
e. Perform such other functions as delegated by the President in relevance to the
General Secretarys Job.

SECTION 5:
The Associate Secretary shall:

a. Assist the secretary in performing his/her duties especially in communication


and letters.
b. Take over responsibilities and duties of the Secretary in the absence and
incapacity of the latter.
c. Perform and accomplish assignments as delegated by the President/Secretary.

SECTION 6:
The Treasurer / Financial Manager shall:

a. Collect and receive semester memberships during enrolments and fees.


b. Act as custodian of the Councils funds and shall deposit the funds to a bank
stated in the resolution concerning the depository of it.
c. Secure that all payments and disbursements made by him or herself be
covered by receipts and properly audited.
d. Prepare and submit a financial report required at the end of each semester to
the Accounting Manager.

e. Perform and accomplish assignments as delegated by the president in


relevance to the Treasurers Job.

SECTION 7:
The Auditor shall:

a. Keep an inventory and take charge of all Council properties and prepare/submit
properly inventory report at the end of each semester.
b. Act as a watchdog/overseer of the money matters of the Council.
c. Verify and audit bills, payment disbursements.
d. Perform and accomplish assignments as delegated by the President in
relevance to the Auditors Job.

SECTION 8:
The Public Information Officer shall:

a. Make all announcements to the SCT officers/members either regular,


emergency, special meetings or general assembly.
b. Notify the members of the meetings.
c. Inform the Legislative Body about the plans of the Executive Body.
d. Perform and accomplish assignments as delegated by the President in
relevance to the Public Information Officers Job.

ARTICLE XI: CONSTITUTIONAL COMMITTEE

The standing Departments of the SCT shall be chaired by the Vice President
Internal with members appointed by the individually, of the College Technology
Department.

SECTION 1:
The Head Department on Ways and Means (DEPWAM) shall be responsible of:
a. Initiating and planning income generating activities and projects in behalf of the
SCT.
b. Endorsing all funds raised by the Committee to the Council Treasurer.
c. Finding ways and means in a direct or indirect manner for the success of
activities of the SCT.

SECTION 2:
The DEPWAM Co-Head shall be responsible of:

a. Proposed plans for income generating activities and projects.


b. Take over the responsibility in Office Income generating projects e.g Printing
services, Locker and other projects.
c. To introduce a more effective way of bringing a monetary credits to the council.
d. Perform and accomplish assignments as delegated by the President/DEPWAM
in relevance to the Project Managers Job.

SECTION 3:
The DEPWAM Secretary shall be responsible of:

a. Keep all papers, records, documents, files and correspondence of the


DEPWAM.
b. Take the minutes of all meetings of the Department.
c. Perform such other functions as delegated by the DEPWAM Head in relevance
to the General Secretarys Job.

SECTION 4:
The DEPWAM Treasurer shall be responsible of:

a. Act as custodian of the DEPWAM funds and shall forward the remaining funds
to the Executive Treasurer as stated in the letter for depository of it.
b. Prepare and submit a financial report required at the end of each semester to
the Executive Treasurer.
c. Perform and accomplish assignments as delegated by the DEPWAM Head in
relevance to the Treasurers Job.

SECTION 5:
The Head Department on Sports (DEPSPO) shall be responsible of:

a. Initiating and creating programs and activities that promote sports development
among student under College of Technology.
b. Coordinating with the existing sports and association within the technology
Department.
c. Counter parting financially in supporting the deserving varsity/sports players
within the College of Technology Department.

SECTION 6:
The DEPSPO Co-Head shall be responsible of:

a. To assist and coordinate with the existing sports and association within the
Technology Department under the supervision of the DEPSPO Head.
b. Counter parting financially in supporting the deserving varsity/sports players
within the Industrial and Information Technology Department.

SECTION 7:
The DEPSPO Secretary shall be responsible of:

a. Keep all papers, records, documents, files and correspondence of the


DEPSPO.
b. Take the minutes of all meetings of the Department.
c. Perform such other functions as delegated by the DEPSPO Head in relevance
to the General Secretarys Job.

SECTION 8:
The DEPSPO Treasurer shall be responsible of:

d. Act as custodian of the DEPSPO funds and shall forward the remaining funds
to the Executive Treasurer as stated in the letter for depository of it.
e. Prepare and submit a financial report required at the end of each semester to
the Executive Treasurer.
f. Perform and accomplish assignments as delegated by the DEPSPO Head in
relevance to the Treasurers Job.

SECTION 9:
The Head Department on Extra-Curricular Activities (DEPECA) shall be
responsible of:

a. Initiate activities for the enhancement of social, cultural, and extra-curricular


aspect of the students under College Technology.

SECTION 10:
The DEPECA Co-Head shall be responsible of:

a. Serves as assistance for the Head DEPECA in Initiate activities for the
enhancement of social, cultural, and extra-curricular aspect of the students
under College Technology.

SECTION 11:
The DEPECA Secretary shall be responsible of:

a. Keep all papers, records, documents, files and correspondence of the


DEPECA.
b. Take the minutes of all meetings of the Department.
c. Perform such other functions as delegated by the DEPECA Head in relevance
to the General Secretarys Job.

SECTION 12:
The DEPECA Treasurer shall be responsible of:

g. Act as custodian of the DEPECA funds and shall forward the remaining funds
to the Executive Treasurer as stated in the letter for depository of it.
h. Prepare and submit a financial report required at the end of each semester to
the Executive Treasurer.
i. Perform and accomplish assignments as delegated by the DEPECA Head in
relevance to the Treasurers Job.

SECTION 13:
The Head Department on Academics (DEPA) shall be responsible of:

a. Initiating and creating programs and activities that promote educational


development among student under College Technology.
b. Coordinating with the existing extra-curricular and education activities within
the College of Technology.

SECTION 14:
The DEPA Co-Head shall be responsible of:

a. Serves as assistance to the Head DEPA in initiating and creating programs and
activities that promote sports development among student under College
Technology.
b. Perform and accomplish assignments as delegated by the DEPA Head in
relevance to the DEPAs Job.

SECTION 15:
The DEPA Secretary shall be responsible of:

a. Keep all papers, records, documents, files and correspondence of the DEPA.
b. Take the minutes of all meetings of the Department.
c. Perform such other functions as delegated by the DEPA Head in relevance to
the Secretarys Job.

SECTION 16:
The DEPA Treasurer shall be responsible of:

j. Act as custodian of the DEPA funds and shall forward the remaining funds to
the Executive Treasurer as stated in the letter for depository of it.
k. Prepare and submit a financial report required at the end of each semester to
the Executive Treasurer.
l. Perform and accomplish assignments as delegated by the DEPA Head in
relevance to the Treasurers Job.

SECTION 17:
The Head Department of Digital Arts (DEPDA) shall be responsible of:

a. Initiating and creating lay-outs and digital arts that promotes and advertise the
activities of the Council.
b. Coordinates with the Executive and the Legislative for the promotional lay-outs.

SECTION 18:
The DEPDA Co-Head shall be responsible of:

a. Serves as assistance to the Head DEPDA in initiating and creating creating lay-
outs and digital arts that promotes and advertise the activities of the Council.

b. Perform and accomplish assignments as delegated by the DEPDA Head in


relevance to the DEPDAs Job.

SECTION 19:
The DEPDA Secretary shall be responsible of:

a. Keep all papers, records, documents, files and correspondence of the DEPDA.
b. Take the minutes of all meetings of the Department.
c. Perform such other functions as delegated by the DEPDA Head in relevance
to the Secretarys Job.

SECTION 20:
The Head for League of Technology Volunteer (LTV) shall be responsible of:

a. Initiating and creating programs and activities that promotes in empowering


the students and engage them in Leadership Activity.
b. Counter parting financially in supporting the deserving students who wants to
engage in leadership activities within the College of Technology Department.

SECTION 21:
The LTV Co-Head shall be responsible of:

a. Serves as assistance to the Head LTV in initiating and creating that promotes
in empowering the students and engage them in Leadership Activity.
b. Perform and accomplish assignments as delegated by the LTV Head in
relevance to the LTVs Job.

SECTION 22:
The LTV Secretary shall be responsible of:

a. Keep all papers, records, documents, files and correspondence of the LTV.
b. Take the minutes of all meetings of the Department.
c. Perform such other functions as delegated by the LTV Head in relevance to the
Secretarys Job.

SECTION 23:
The LTV Treasurer shall be responsible of:

m. Act as custodian of the LTV funds and shall forward the remaining funds to the
Executive Treasurer as stated in the letter for depository of it.
n. Prepare and submit a financial report required at the end of each semester to
the Executive Treasurer.
o. Perform and accomplish assignments as delegated by the LTV Head in
relevance to the Treasurers Job.

ECTION 24:
Special Committee may, from time to time be created by the President whose
powers and responsibilities, terms and membership be designed by the Executive Board
as the need arises.

ARTICLE XII: MEETINGS AND QUOROMS

SECTION 1:
Meeting shall either be regular, special or emergency/adjourned.

SECTION 2:
The regular meeting of the SCT Executive and Cabinet members shall be held
every last Saturday of the month.

SECTION 3:
All meeting shall be called by the President, or by the designated in-charge, or may
be called by petition of at least four (4) SCT Officers.

SECTION 4:
A General Assembly shall be called anytime by the President as deemed
necessary.

SECTION 5:
The meetings of the standing committee (Constitutional Committee) may be called
by the Chairman or by the designated in-charge.

A. The Committee Chairman shall hold a monthly regular meeting in which the
members shall determine the date.

B. The Committee Chairman shall report all transactions they have in every
meeting of the Council.

SECTION 6:
The presence of the half the number of the Executive Body Officers plus one (50%
+ 1) shall constitute a quorum for the Council to legally transact business.

SECTION 7:
Matters concerning the approval or resolution and adoption of the committee
reports need a simple vote of majority for consideration.

SECTION 8:
Matters concerning the approval, amendment to the constitution and impeachment
of elected/appointed officials need two third (2/3) vote for all Officers present in the
meeting for consideration.

SECTION 9:
An officer shall be face the sanction if he/she is absent during the regular meeting
except for valid reason.

A. First offense: The officer shall will have an additional 1 hour extension during
the U-Hour.
B. Second offense: The officer shall will have an additional 1 hour extension
during the U-Hour and must provide cleaning materials.
C. Third offense: The officer shall be given a memorandum for impeachment.
D. Fourth offense: The officer shall be expelled from the Council.

ARTICLE XIII: IMPEACHMENT

SECTION 1:
The grounds for impeachment of the elected/appointed officials of the Council are
as follows:
A. Any willful violation of this Constitution.
B. Gross neglect of duty.
C. Failure to attend three (3) consecutive regular meetings.
D. Any disorderly behavior during the Council sessions/meetings.
E. Illegal use of SCT funds.

SECTION 2:
The respondents shall be given time to elucidate the reasons behind the violation.

SECTION 3:
If the dropped member wishes to return, he/she should explain and justify his/her
side. With the concurrence of the two third (2/3) vote of affirmative vote of all the officers,
he/she can be reinstated in the Council.

SECTION 4:
The Executive Board shall spearhead the investigation in case there is a petition
for impeachment of any Officers.

SECTION 5:
After the verification of the Executive Board about the complaint, it shall then
endorse the complaint in form of resolution of the SCT Officers. The complaint must be
settled within two (2) consecutive regular meetings of the Council.

SECTION 6:
Two third (2/3) of the members present during the meeting can tackle and discuss
petition for impeachment of the Officers(s).

SECTION 7:
Any SCIIT Officers may be removed from office by the concurrence of the two third
(2/3) votes of all Council Officers.

ARTICLE XIV: GENERAL PROVISION

SECTION 1:
This Constitution shall govern the Student Council of Technology of University of
Science and Technology of Southern Philippines.

SECTION 2:
This Council is subject to all First, Second, Third and Fourth year under College
Technology students.

SECTION 3:
The Council shall strengthen the holistic development among student taking
courses under College Technology.

SECTION 4:
Permanent vacancy exist when any position in the SCT Executive Board has been
vacated for reasons of death, resignation, impeachment, permanent disability and other
reasons that hinder the Officer to perform his/her duty in the SCT.

A. In case it is the Presidents position that has been vacated, Vice Presidents will
take over elected or appointed.

SECTION 5:
Temporary vacancy exists when a seat in the SCT is vacated by reasons that
hinder the Officer in performing his/her duties before the end of the term.

A. In case the vacancy is set for long period, the President shall appoint
somebody, deemed capable for the rank to fill in temporarily.

SECTION 6:
The SCT membership fee shall be per semester.

SECTION 7:
The SCT membership fee shall be increases upon the affirmative vote of two third
(2/3) of all SCT Officers and with the Moderator, if deemed necessary.

SECTION 8:
All laws formulated by the Council which is not in conformity with the Philippine
Constitution shall be considered null and void.

ARTICLE XV: AMENDMENTS AND REVISION

SECTION 1:
The Constitution of the SCT may be revised or amended.

SECTION 2:
The revision and amendment of the Constitution must need two third (2/3) votes
for all the members of the Executive Board.

SECTION 3:
Upon the approval of the proposal for amendment/revision by the Council, a
Constitutional Convention must be formed.

SECTION 4:
This Constitution may be revised or amended by an affirmative two third (2/3) of
all the members present in the Constitutional Convention.

SECTION 5:
The Constitutional Convention comprises of the ff.
A. All SCT officers
B. All Unit Organization Presidents
C. The Moderator of the Council

ARTICLE XVI: TRANSITORY PROVISIONS

SECTION 1:
The present Officers of the Council shall have an Organizational Review to
comprise the present structure of the Constitution.

SECTION 2:
The new designation of the Officers shall function in the conformity with the present
constitution.

SECTION 3:
Induction of the newly elected officers shall be held after the turnover ceremony.

SECTION 4:
There must be a formal turnover of the finances, properties and functions of the
outgoing set of officers to the incoming set on their first regular meeting.
