POVO INDGENA XUCURU X BRASIL: UM BREVE PANORAMA

Resumo: O artigo pretende abordar o caso relativo ao povo indgena Xucuru versus o Estado
brasileiro, registrado pela Comisso Interamericana de Direitos Humanos sob o n 12.728,
remetido Corte Interamericana de Direitos Humanos em 16 de maro de 2016 e ainda
carente de resoluo. Busca retratar as violaes e as omisses do Estado quanto aos direitos
constitucionalmente previstos e garantias previstas pela Conveno Interamericana de
Direitos Humanos, sobretudo, a demora no processo administrativo de demarcao,
delimitao e titulao das terras do povo indgena Xucuru e a conseqente ausncia de
proteo e garantias judiciais que deveriam ser prestadas pelo Estado ao povo indgena, alm
da violao do direito propriedade coletiva.

Abstract: The article intends to address the case concerning the Xucuru indigenous people
versus the Brazilian State, registered by the Inter-American Commission on Human Rights
under No. 12.728, which was referred to the Inter-American Court of Human Rights on
March 16, 2016 and still lacking resolution. It seeks to portray the violations and omissions of
the State regarding the constitutionally foreseen rights and guarantees provided by the Inter-
American Convention on Human Rights, especially the delay in the administrative process of
demarcation, delimitation and titling of the lands of the Xucuru indigenous people and the
consequent lack of protection and Judicial guarantees that should be provided by the State to
the indigenous people, as well as violation of the right to collective property.
