AFFIDAVIT

I, JERRY FONTANILLA, of legal age, married, Filipino citizen and a

resident of Brgy. Ineangan, Dupax Del Norte, Nueva Vizcaya, after having been
duly sworn to in accordance with law hereby depose and state that:

1. I personally know Lurleen Damian-Malit, daughter of Spouses

Bienvenido Damian (deceased) and Merle Galeon-Damian, as we are
residents of the same barangay;

2. I know that Spouses Bienvenido Damian and Merle Galeon-Damian

owns a parcel of farm land located at Brgy. Ineangan, Dupax del Norte,
Nueva Vizcaya;

3. Sometime in 2000, Lurleen Damian-Malit approached me and offered

me to be the caretaker of their house at Brgy. Ineangan, Dupax Del
Norte, which I accepted;

4. Since then, I became the caretaker of their house and at the same time
I monitored the farm works on their farm. I know that Generoso (Ben)
de Vera was the one who regularly works on their farm on commission
basis. He was the one who sows fertilizer, maintains the good condition
of the rice plants and provide for the proper water supply;

5. Whenever Ben de Vera, together with his children, works on the farm,
I and my wife provides for their lunch and snacks;

6. A few weeks after the harvest on the farm of the Damians on April
2017, Mr. Ronaldo E. Tagami tractored the farm land to prepare it for
the next cropping;

7. Sometime in June 2017, on my way to the farm of the Damians a

neighbor, who tills the land adjacent to the farm, informed me that
other persons started to level the soil on the tractored land and planted
rice seedlings by direct seeding (sabog-tanim in local parlance) so I
immediately called Lurleen to inform her of the incident since she was
then in Manila;

8. On June 13, 2017, I accompanied Lurleen to their farm to confirm if

indeed it was already directly seeded and took pictures of it. When we
saw that indeed it was directly seeded, we went to the police station to
have the incident recorded on the police blotter;
 9. From 2000 until June 2017, I personally know that the Damians are the
ones tilling the farm land located at Brgy. Ineangan, Dupax del Norte
with an area of 18,000 square meters;

10.I am executing this affidavit to attest to the truthfulness of the

foregoing statements and for whatever legal purposes it may serve.
