COMROMISE AGREEMENT

This Agreement executed this _____ day of February, 2017


at Bayombong, Nueva Vizcaya, by and between:

OFELIA SANGALANG-LUDAN, Filipino, of legal age


with address at NS Realty Bldg., 2nd Floor, 57 Zamora St.,
Batangas City (hereinafter referred to as the plaintiff).

-and-

MARIO LUDAN and MARINA MANUEL, Filipinos, of


legal age with address at 237 J.P. Rizal Street, Poblacion South,
Solano, Nueva Vizcaya, (hereinafter referred to as the
defendants).

WITNESSETH: That -

WHEREAS, the plaintiff OFELIA SANGALANG-


LUDAN have instituted the above-styled complaint against the
defendants MARIO LUDAN and MARINA MANUEL before
the Honorable Court.
WHEREAS, the parties desire to buy peace and wish to
avoid a protracted litigation in this case.

NOW THEREFORE, in consideration of the foregoing and


the further covenants hereinafter set forth, the parties agree as
follows:

1. As full settlement of his obligation to plaintiff, defendant


Mario Ludan shall execute a Deed of Conveyance
covering a portion of one-half (1/2) of his one-third (1.3)
share of a parcel of land which he owned in common with
plaintiff Ofelia Sangalang-Ludan along with their sibling
Geronima Ludan, which real property is described as Lot
49-E of the Subdivision Plan, located at District IV (now
Poblacion South), Solano, Nueva Vizcaya with an area of
FIVE HUNDRED EIGHTEEN (518) square meters and
covered by TRANSFER CERTIFICATE OF TITLE NO.
T-64953 of the land records of Nueva Vizcaya;

2. The execution of the aforesaid conveyance shall be made


by defendant Mario Ludan immediately upon the
execution of this agreement and subject to the condition
that plaintiff shall not sell, mortgage or otherwise convey
the aforesaid of his 1/3 share unless and until the
subject real property has been duly partitioned by the co-
owners, including said defendant and plaintiff;

3. This Compromise Agreement shall not affect nor


prejudice any case or cases between the parties not
specifically referred to herein.

4. The signatories to this Agreement hereby represent and


warrant that they are duly authorized to execute this
Agreement.

5. The parties or their assigns hereby waive, renounce and


forever quitclaim all their respective claims and
counterclaims subject of the instant action as well as those
that may arise therefrom, in connection therewith or in
relation thereto.
6. The foregoing covenants are not contrary to law, morals,
or public policy and the parties bind themselves to comply
strictly with their undertakings.

MANIFESTATION

COMES NOW the plaintiff, through counsel, and


before this Honorable Court, most respectfully states:

1. During the last hearing, the plaintiff was directed


to comment on the Commissioners Report
relative to the above-entitled case;

2. Pending submission of comment, a new


development has unfolded wherein plaintiff Ofelia
Ludan-Sanggalang and defendant Mario Ludan,
who are full blooded siblings, agreed that as
settlement of his obligations, defendant shall
convey the one-half portion of his one-third share
over that certain parcel of land which they owned
in common with their sister Geronima Ludan,
which real property is described as Lot 49-E of
the Subdivision Plan, located at District IV (now
Poblacion South), Solano, Nueva Vizcaya with an
area of FIVE HUNDRED EIGHTEEN (518) square
meters and covered by TRANSFER CERTIFICATE
OF TITLE NO. T-64953 of the land records of
Nueva Vizcaya;
3. The corresponding Memorandum of Agreement
(MOA) has been drafted by plaintiffs counsel and
the defendants are just awaiting said plaintiff
who resides in Batangas City to come to home to
Nueva Vizcaya and to sign the agreement next;

4. With this, the Honorable Court is hereby


informed that instead of submitting his comment
he will just submit the aforesaid agreement for its
approval next week or until the end of this
month.

WHEREFORE, premises considered, it is


respectfully prayed before this Honorable Court that this
Manifestation be NOTED for all legal intent and
purposes.
