    COUNT III OF PLAINTIFFS COMPLAINT

    For the reasons set forth in their supporting brief, Defendants Presbyterian Health Plan,

    Inc., Presbyterian Network, Inc., and Presbyterian Insurance Co., Inc. move pursuant to Rule 1-

    012(B)(6) to dismiss the State of New Mexicos claim for unjust enrichment (Count III) for

    failure to state a claim upon which relief can be granted.
