The Complainant submits this complaint to the Court and states that there is probable cause to believe

Charge Description: Between October 23, 2015 and May 24, 2016, in the County of Rice, Minnesota,
Jeremiah Jon Smith did obtain possession of property or services from people with an aggregate value of
morethan$5,000,bymeansofswindle.

STATEMENTOFPROBABLECAUSE

TheComplainantstatesthatthefollowingfactsestablishprobablecause:

Complainantand/orSigningOfficerdesignatedbelow,declaresunderpenaltyofperjury,thathe/shehas
reviewedpolicereportsrelatingtotheabove-namedDefendantandtheallegationscontainedherein,
and/orhasspokenwithpeaceofficershavingknowledgeoftheincident,andbaseduponthatinformation,
believesthefollowingtobetrueandcorrect.

OnoraboutMay24,2016,theFaribaultPoliceDepartmentreceivedareportofpossibletheftbyfraud.A
complainantreportedthatJeremiahJonSmith,DOB:3/14/1980(hereinafterthedefendant),claimedto
havestage4terminalcancer.Thedefendantstatedheonlyhad18-24monthstoliveafterbeing
diagnosedwithcanceraroundOctober23,2015.Amonthlater,thedefendantreportedheonlyhadsix
monthstolive.Thedefendantsaidhewenttotwoorthreedoctorappointmentsbutrefusedtoallowhis
wifetoattendthoseappointmentswithhim.ThedefendantresidesinRiceCounty.

AGoFundMefundraiserwascreatedbasedonthedefendantsrepresentationthathewassuffering
fromcancer.Numerouspeople,believingthedefendanttobedyingfromcancer,donatedover$6,800.
ThatmoneythatwasdonatedwasgiventothedefendantandreceivedinRiceCounty.

Thedefendantquithisjobaboutamonthafterheclaimedtoreceivehisdiagnosis.Thedefendant
changedhisstoryabouthowhewastoldabouthiscancer.Thedefendantonceclaimedhereceiveda
phonecall.Anothertime,thedefendantclaimedanursetoldhim.ThedefendantsaidhewenttoOlmsted
MedicalCenter(OMC)andonatrialmedication.AphonecallwasplacedtoOMCbythecomplainantand
theyweretoldOMCdoesnotparticipateintrialmedications.Thedefendantclaimedhewasbeingtreated
byDr.Bartels.Dr.BartelsisaFamilyPracticeDoctoratOMC.

OnFebruary6,2016,adarttournament,beerbust,andsilentauctionfundraisertookplaceforthe
defendantatBiffsinSpringLakePark,MN.Theeventraisednearly$6,600.OnFebruary20,2016,a
secondbenefittookplaceforthedefendantinNorthfield.Thiswasadvertisedasaliveandsilentauction,
foodanddoorprizes.Thiseventraisedabout$9,000.Accordingtothecomplainant,thedefendantspent
allofthemoneyfromthefundraisers.Onlyabout$4,000wasusedforoutstandingbills.Thecomplainant
saidtherestofthemoneywenttowardsClashofClansvideogame,drinking,darttournaments,and
marijuana.Thebenefitswereheldforthedefendantbasedonthedefendantsrepresentationthathewas
dyingofcancer.

ThedefendantswifeattemptedtoobtainmedicalrecordsbutwasdeniedbytheClinic.Shereported
neverseeingamedicalbillorrecordregardingthedefendantscancertreatment.Thedefendantswife
lookedaroundthehouseforanyevidenceofthedefendantscancer,butwasunabletofindanything
showingthedefendanthadcancer.ThedefendantswifeattemptedtoobtainassistancefromRiceCounty

SocialServices,butthedefendantrefusedtosignpaperwork.ThatpaperworkwouldhaveallowedSocial
Servicestoobtainthedefendantsmedicalrecords.

OnJune10,2016,FaribaultPoliceDepartmentdetectivesspokewiththedefendant.Theypresentedthe
allegationtohimandallowedhimanopportunitytoprovidehismedicalrecords.Thedefendantagreedto
providehisrecordstothedetectives.ThedefendantsaidhewouldhavethembyJune13,2016.The
defendantneverprovidedtherecordsheagreedtoprovide.

OnJune21,2016,detectivesfrombothFaribaultPoliceDepartmentandNorthfieldPoliceDepartment
spokewiththedefendant.Theconversationwasatthedefendantshome.Thedefendanttoldthe
detectiveshewasgoingtothedoctoronJune23,2016andthelastfewweekshadbeenroughforhim
duetotwodeathsinhisfamily.Thedefendantsaidhewasnottryingtododgeanyone.Thedefendant
figuredsincehealreadyhadacheckupinRochester,thathecouldgethisrecordsatthattime.

OnJune27,2016,thedefendantleftamessagewithFaribaultPoliceDepartmentstatinghehadhis
medicalrecordssettobefaxedonJune29,2016andtocallhimiftheyhadquestions.

OnJune30,2016,thedefendantswifespokewithaFaribaultdetective.Shesaidthedefendantwas
sittingattheTruckersInntruckstopandbelievedeverycartherewaslookingforhim.Thedefendant
calledtheSheriffsofficeaskingwhytheywerelookingforhim.Thedefendantswifesaidhewasvery
paranoid.Thedefendantwouldnotleavethetruckstop.

OnJuly1,2016,FaribaultPoliceDepartmentdetectivesmetwiththedefendantathishome.The
defendanttolddetectiveshehadtalkedwithhisfamilyandwasnotimpressedthatsomeonewasnosyand
thoughttheyneededtoknoweverything.Hewasntgoingtoshowanythingtohisaccuserandwoulddeal
withtheconsequences.Thedefendantrepeatedhewassickandhadcancer.Thedefendantwentsofar
astodescribethecancerstartedinhiscolonandprogressedtohiskidneysandbladder.TheDefendant
saidhisdoctorwasDr.BartelsfromOMC.

OnNovember21,2016,detectivesweregrantedasearchwarrantforthedefendantsmedicalrecordsat
OlmstedMedicalHospitalandClinics.Thedefendantsownmedicalrecordsaredevoidofanycancer
diagnosis.

OnFebruary21,2017,detectivesobtainedasearchwarrantfromOlmstedCountyDistrictCourttospeak
withDr.Bartelsaboutthedefendant.ThedefendanttolddetectivesthatDr.Bartelswasthedoctorwho
diagnosedthedefendantwithcancer.ThedoctorsaidhelastsawthedefendantonMay23,2016.The
doctorsaidherememberedthedefendant.ThedoctorsaidhetreatedthedefendantinMayforAttention

DeficitDisorder.ThedoctorsaidhesawthedefendantinSeptember2015forinsomniaandADD.In
March2016,thedefendantwasseenbyanOMCsurgeonforsmalllipomasinsidetheabdominalwalls.
Thelipomaswerenotcancerousandwouldnotbeconsideredcancer.Thedoctorwasclearhenever
diagnosedthedefendantwithcancer.Thedefendantneverreferredthedefendanttoanotherdoctorfor
cancerorcancerlikesymptoms.Accordingtothedoctorspersonalandprofessionalknowledge,the
defendantdoesnothavecancer.ThelipomasSmithhadremovedwouldnotcausehimtobeterminallyill.

Thedefendantswifeindicatedtheyreceived$17,000frombenefitsandover$6,000online.TheMoney
onlinewentintotheirbankaccountandapproximately$4,000wasusedonbills.Themoneyfrombenefits
weregiventothedefendantincash.Asidefromsomebeingspentonbills,thedefendantswifedoesnot
knowwhatallthedefendantspentthemoneyon.Sheknowsthatthedefendantboughtnewtabletsfor
himselfandhisson.Sheknowsthatsomemoneywasbeingspentonmarijuana.

Allofthemoneydonatedtothedefendantwasbasedonthedefendantsrepresentationthathewasdying
ofcancer.

PLEASETAKENOTICE:PursuanttoMinn.Stat.609.49.,intentionalfailuretoappearfordulyscheduled
courtappearancesmayresultinadditionalcriminalcharges,andinadditiontoanyarrestwarrantthatmay
otherwisebeissuedbytheCourt.

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendants arrest
or other lawful steps be taken to obtain Defendants appearance in court, or Defendants detention, if already in custody,
