ORDER

For action is the Motion filed by the accused, through counsel, praying
for reconsideration of the Order dated October 18, 2011 denying his Motion for
Reinvestigation.

In the interest of justice, the Motion for Reconsideration is hereby

GRANTED. Corollary thereto, the Order dated October 18, 2011 is hereby
reconsidered. In support of this Order is the ruling of the Supreme Court in the
leading case of Crespo vs. Mogul, 151 SCRA 462, as follows:

The rule therefore in this jurisdiction is that once a complaint or

information is filed in Court any disposition of the case as its dismissal
or the conviction or acquittal of the accused rests in the sound discretion
of the Court.

WHEREFORE, let this case be remanded to the Provincial Prosecution

Office of Bohol for reinvestigation. Meanwhile, all proceedings relative to this
instant case before this Court are suspended pending the outcome of the
reinvestigation.

SO ORDERED.
