CONSTITUTION AND RULES
1. The name of the group/society shall be mamakiu welfare group {the group was founded by people from
machakos, makueni and kitui counties who live in uthiru, Nairobi and its environs.
2. OBJECTIVES
A. To promote understanding and good relationship among members.

B. Non political and non violence.

C. Shall be none profit making group.

D. Shall seek and save funds aimed at improving the living standard of the group members.

E. To help our members in case of there death and that of:

i}. member of their nuclear family


ii}. Members children and above 18yr schooling and less than 24yrs and single.
Iii} member parents as per registration details.
Iv} the amount for each burial case shall be 100,000Ksh divided amongst the group members.
V} any new members shall be handled by the group four months after registration.
Vi) any transport to and from any burial shall be divided amongst the group members and shall
depend on the distance.

{ INCASE OF ANY DEATH OF A PARENT OF MORE THAN TWO RELATED MEMBERS, THE GROUP SHALL
UNDER TAKE IT AS A SINGLE CASE AMOUNTING TO 100,000KHS} and the amount shall be divided amongst the
braved members after the mandatory expenses are done{ they include,, casket, transport of the hearse, tents,
chairs, programs, food and mortuary fees.

4. MISION: To create unity that meets members needs guided by values of commitments, fairness &
integrity.
5. REGISTRATION OF NEW MEMBERS
Any new member shall be of 18yrs of age and above and shall:
A) First read and understand the group constitution
B) Pay non refundable fee of ksh 1000sh per year times the no. of yrs the group has existed
C)Be well known by at least a member of the group
D) Shall produce his or her ID. Card /passport. E) Should fill the member details form provided by the
group.
6. RESIGNATION
Any member intending to resign, terminate membership voluntary shall be:
A) Not be entitled to any refund/any claim whatsoever.
B) Shall be clean from debts of the society.
7. EXPULSION
A member may be expelled from the group on the following conditions:
a. Unruly behavior which are not of positive interest to the group.
b. Defaulting for four consecutive months
c. Any member who falls in arrears of his monthly contribution for 4 consecutive meetings shall
automatically cease to be a member.
d. If the member is Declared by 60%+ of the group members as nuisance.
e) If a member is voted out shall be required to double the amount owed to the group and do fresh
re=admission. F) if any member wishes to leave or is expelled by the group and has benefitted thru
the group, the group shall look at his/her savings and deduct the savings from the benefits and pay
the difference. g) any member who falls to pay burial contributions within 3 months shall
automatically cease to be a member
8. OFFICE BEARERS
The office shall consist of:
1) The chairman
2) The vice chairman pg 1.
3) The secretary
4) The assistant secretary
5) The organizing secretary
6) The treasure
7) Two member representatives
8) Assistant organizing secretary

All of whom shall be fully paid up members of the group and shall be elected by a secret ballot at the
annual general meeting to be held annually and all members present shall vote

a) All office bearers shall hold office from the date of election until the succeeding annual general
meeting but shall be eligible for re election for two terms consecutive
b) Any member who ceases to be a member of the group shall automatically cease to be an office bearer
thereof.
c) Officials shall be of high integrity knowledge, honest and popular person of the group.
9. DUTIES OF OFFICE BEARERS
A) THE CHAIRMAN
a. Shall unless prevented by illness or other sufficient cases, preside over all meetings
b. Shall be signatory to all documents on behalf of the group.

THE VICE CHAIRMAN

a. Shall perform the duties of the chairman in his absence and any other duties assigned by the chairman
on his behalf

B ) THE SECREATARY

a. Shall deal with the corresponded of the group under the general supervision of the committee or any
other duties assigned to him /her by the chairman.
b. Shall keep record of all minutes of every meeting
c. Incase of agent matters where the committee cannot be conducted he/she shall consult the chairman
or if he /she is not available, the vice chair. The decision reached shall be subject to ratification at the
next committee meeting.
C) THE ASSISTANT SECREATARY
a. Shall in the absence of the secretary perform all the duties of the secretary and any other duty
assigned by the chairman.

D) THE TREASURE

a. Shall receive and disburse under the directions of the committee all the money belonging to the
group ,
b. Shall issue receipts for all monies received by him or her.
c. Shall preserve all vouchers of monies paid by him.
d. Shall be responsible to the committee and members for the proper record of the monies received
and disbursed and shall be required to avail the records for inspections upon request.

E) MEMBER

a. Shall oversight the committee on behalf of the members.

F) THE ORGANIZING SECRETARY


a. Shall co-ordinate the group activities and any other duties assigned by the chair.

G) THE ASSISTANCE ORGANIZING SECRETARY

a. Shall perform the duties of the org. secretary and any other duty assigned to him/her by the
chairman.

10 THE COMMITTEE

a. Shall consist of all the office bearers of the group elected at the annual general meeting held yearly,

b. Special meetings shall be held when necessary

11 .DUTIES OF THE COMMITTEE

a. The committee shall be responsible for the management of the group and shall give directives to
the office bearer as the manner in which the law they shall perform their duties.
b. All money disbursed on behalf of the group shall be authorized by the committee shall not be less than
two thirds of (2\3) of the paid up members.
c. the quorum of the committee shall not be less than 50%+ of the committee members .

12.GENERAL MEETING.(AGM).

A) Absenteeism without member a proper defined apology can lead to displinary action against

B ) During the AGM the report of the previous years meeting shall be discussed while future target shall
be set.

E) Election for new officials shall be done.

D ) the chairman in conjunction with officials can call an emergency meeting OF AGM any day.

A) All group members meetings shall be held every month at the group venue.

B) The meeting will be held at time which will be decided by the committee.

C) Attendance to the meeting is compulsory with exception to apology related to:

Death of a member of nuclear family


Hospitalization
Death of ones parents
Police court summons.
All apologies must include payment of monthly savings and fines.
14. ABSENTISM:
A ) Absenteeism without a proper defined apology can lead to displinary action against a member.
15. CONTRIBUTIONS.
a) Each member shall contribute a minimum of ksh.200 monthly as a group savings plus sitting.
b) Any member coming late for a meeting shall be fined ksh.30
c) Any member absent shall be fined ksh.200 without apology and 100sh with apology
d) All apologies shall be channeled to the member representative.
e) All money must be deposited at the group account and receipt handed to the treasure of the group
during the meeting day and time.
16. GROUPS BANK.
a) The group shall open an account with a bank as decided by members.

b) The account shall be operated by officials and one appointed member as per the mandate prescribed in
the group minutes.

C) The chairman, the secretary, the treasurer and a member shall be signatories

d ) All signatories to sign at any given time. pg 3.

e) Money withdrawn from the group shall be signed) f) All money shall be deposited to the groups bank
account and the receipts shall be produced in the next monthly meeting m the group account shall be minuted
and signed by officials.

17. WELFARE.

a) A welfare committee shall be formed.

b) Member welfare shall be discussed by all the members as they rise and the decision reached shall be final.

18. AMMENTMENTS

Any section of this document shall be amended, added are changed with agreement of 60% plus of the entire
existing active and sound members of the group in dully constituted meeting.

19. DISOLVING THE GROUP.

The group be dissolved with the majority agreement after the agreements are made.

A ) A motion of dissolving the group shall be formal through a fully constituted meeting under the groups
committee.

b) Members shall clear all the arrears within one month after the motion.

c) Groups audited account shall be provided during the second month.

d) The members shall share any savings/investments on prolatta bases less bank or any charges if any.

e) Members with unclear arrears shall receive their share less the arrears.

NB: The group shall be dissolved three months after the motion and all the above requirements met, the
committee shall counter the audited account.

20. DECLARATION.

This document has been discussed, formulated and agreed by all group members of MAMAKIU welfare group,
it will be the authoritative guideline in the running of the group affairs.
