RESEARCH PROPOSAL
a) Title of the Internship: The title of the assignment Importance of copyright in india this
topic talks about the importance of copyright in india.
b) Hypothesis: The term copyright is not defined under the Indian Copyright Act, 1957
(hereinafter referred to as Copyright Act). The general connotation of the term copyright
refers to the right to copy which is available only to the author or the creator, as the case may
be. Thus, any other person who copies the original work would be amount to infringement
under the Copyright Act. Copyright ensures certain minimum safeguards of the rights of
authors over their creations. Creativity being the keystone of progress, no civilized society can
afford to ignore the basic requirement of encouraging the same. Economic and social
development of a society is dependent on creativity. The protection provided by copyright to
the efforts of writers, artists, designers, dramatists, musicians, architects and producers of
sound recordings, cinematograph films and computer software, creates an atmosphere
conducive to creativity, which induces them to create more and motivates others to create.
c) Research Problem: Copyright may be acquired for almost all the visible things like script,
photo, book, essay, films, videos, architecture etc and also intangible things such as music. The
most important criteria to determine whether the said article is copyrightable or not, is based
on its originality. Also copyright can be only for things that are worth copying and not
otherwise. For example, a baby scribing in a pad cannot be copyrighted.
d) Research Methodology: the research methodology used in this assignment is empirical.. The
study is based on available literature extracted from different databases. This is a qualitative
study intended to understand the issues related to the importance of copyright in india

IMPORTANCE OF COPYRIGHT IN INDIA
Introduction- The scope of intellectual property is expanding very fast and attempts are being
made by persons who create new creative ideas to seek protection under the umbrella of intellectual
property rights. Copyright is a kind of intellectual property the importance of which has increased
enormously in recent times due to the rapid technological development in the field of printing,
music, communication, and entertainment and computer industries. 1
MEANING OF COPYRIGHT
The word copyright is derived from the expression copier of words first used in the context,

and sanctioned by positive law. An intangible incorporeal right granted to the author or originator of

Copyright as defined in the Oxford English Dictionary is an exclusive right given by law for a
certain term of years to an author, composer etc., (or his assignee) to print, publish and sell copies of

OBJECTIVE
The object of copyright law is to encourage, authors, composers, artists and designers to create
original works by rewarding them with the exclusive right for a specified period to reproduce the
works for publishing and selling them to public. It is thus the exclusive right for a limited period to
exploit the work for monetary gain. The economic exploitation is done by licensing such exclusive
right to entrepreneurs like publishers, film producers etc., for a monetary consideration.
