AFFIDAVIT

I, MARINA VILLAGONZALO, Filipino, of legal age, married

and a resident of Barangay Gatungan, Bunawan, Davao City, after
being duly sworn to in accordance with law, do hereby depose and
say that:

1. I am the same and identical person who caused the

execution of this affidavit;

2. I and my family have lived in Barangay Gatungan, Bunawan,

Davao City from _____ up to the present;

3. I together with my husband acted as caretakers of the three

parcels of land owned by the late Angeles Legaspi located at
Barangay Gatungan, Bunawan, Davao del Sur on 19__;

4. Before our engagement as caretakers, the previous

caretaker of the aforesaid land was _______ ;

5. As per instructions of the Legaspis, I together with my

husband are primarily tasked to preserve and protect their
rights over the aforementioned properties. Moreover, we
assisted in the harvesting and processing of the coconut
produce from the same;

6. From 19___ onwards, quarterly, the workers from Hagonoy

who were made to board a truck owned by the Legaspis,
would arrive in the area and would pick, harvest, process
and dry the coconuts into copra from the said subject land;
As per instructions of the Legaspi heirs, I together with my
husband rendered assistance in the harvesting and
processing of the coconut produce from the subject
aforementioned lands;

7. Since I acted as the caretaker over the said land, I neither

saw Maria Milagros Matuguina Mendoza nor her sons,
Cesar Matuguina Mendoza and Domingo Matuguina
Mendoza, Jr., appeared or make any claims in the afore-
stated lands. Likewise,I will not be able to recognize the
same persons if ever confronted;

8. As far as I know, such parcels of land were owned by the

Legaspi heirs and no other;
 9. On 2016, I know that several of the Legaspi heirs already
sold their shares in the subject parcels of land to Herky Abad
;

10. In fact, one of the heirs, Atty. Luciliza de los Santos,

planted banana plants in the area assigned to her on ___;

11. I am executing this affidavit to attest to the truth of the

foregoing facts and to submit the same to the authorities
concerned for whatever purpose this affidavit may serve.

AFFIDAVIT OF WITNESSES

We, GRACE CABIGAS and AIZA BINASBAS, both of legal

age, Filipino and residents of Davao City, Philippines, respectively,
after having been duly sworn to in accordance with law, do hereby
depose and say:

1. That I, JYLO JOHN A. OGAHAYON, at around 10:30 in the

morning of May 10, 2015, I accompanied Junemard C.
Quiban at the BDO Bank AT SM Lanang, Davao City, to
withdraw cash which was to be delivered to the Montos
sisters;

2. That I, JUNEMARD CAMIA QUIBAN, on May 10, 2015, at

around 12:00 noon, personally handed the amount of
THIRTEEN THOUSAND (Php=13,000.00) PESOS,
Philippine currency, to Jovelyn Montos at my apartment in
Sarphil, Agdao, Davao City;

3. That Jovelyn Montos received that said amount personally

and she handed me a document, Contract Governing Loan,
duly signed by her and her sister Erechelle Montos, which
document I also affixed my signature as witness;
 4. hat we are executing this Affidavit to attest to the truth of the
foregoing facts and to submit the same to the authorities
concerned for whatever legal purpose this may serve.

14, 1990 at home, Poblacion, Makilala, Cotabato, to the
spouses Augustina N. Paunil and Avelino S. Labajo, Sr.
presently residing at Santa Felomina, Makilala, North
Cotabato;
2. That my fathers Family Name appearing in my Certificate of
Live Birth was erroneously entered as LABAJO? instead of
LABAJO, which is true and correct one;
3. That such unnecessary entry is being attributable as a
typographical error;
4. That I could hereby attest to the fact that my fathers name
AVELINO S. LABAJO? SR. and AVELINO S. LABAJO,
SR. is refer to one and the same person;
