Accused.

DECISION
The accused Ferigno Vedatia y Bernardino is charged with the violation of
Section 5, Article II, of Republic Act 9165'. The information reads, in part, as
follows:

That on or about the 10t h day Of February 2015, in Ouezon

City, Philippines, the above-named accused, without lawful authority,
did then and there willfully and unlawfully sell, trade, administer,
dispense, deliver, give away to another, distribute, dispatch in transit
or transport, or act as broker in said transaction, a dangerous drug,
to wit: zero point twenty three (0.23) gram of white crystalline
substance containing Methamphetamine Hydrochloride, a dangerous
drug.
CONTRARY TO LAW.

The Antecedent Facts

Upon arraignment on March 5, 2015, the accused Ferigno Vedafia y

Bernardino who was duly assisted by his counsel entered a plea of not guilty to the
crime charged in the Information. On even datO, the Pre-Trial of the case was held
and the testimonies of the Forensic Chemist, PSI Bernardo Rivera Roque, and the
police investigator, P03 Harold Polistico, were dispensed with after the
prosecution and defense stipulated on their proposed testimony.
