The convention operating in Britain,6 where a similar pattern of government to that of India
prevails, can be adapted suitably to meet the conditions prevailing here. The Supreme Court
has emphasized the importance of conventions to interpret constitutional provisions in the
following words.
1
Constitutional Reform Act 2005, Schedule 4(1).
2
Constitution of Thailand, 2007, Section197.
3
Status of Judges Act, 2004, Section 63.
4
Constitution of Albania, 1998, Article 147(5).
5
Constitution of Slovak Republic, 1992, Article 148(1).
6
MP Jain, Indian Constitutional Law 130 (Lexis Nexis, Nagpur 2015, 7th Edition).
It was said that we must interpret Art. 75(3) according to its own terms regardless of the
conventions that prevail in the United Kingdom. If the words of an article are clear,
notwithstanding any relevant convention, effect will no doubt be given to the words. But it
must be remembered that we are interpreting a Constitution and not :an Act of Parliament, a
Constitution which establishes a Parliamentary system of Government with, a Cabinet. In
trying to understand one may well keep in mind the conventions prevalent at the time the
Constitution was framed.7
