This is in responseto your initial November2,2009, FOIA requestby which you seekto
obtain, on behalf of your client, Citizensfor Responsibilityand Ethics in Washington(CREW),
informationregardingthe U.S. Marine Corps'handlingof domesticviolence issues.

By letter of March 13,2010,I notified you that I had initiated a searchof U.S. Marine
Corps(USMC) files for documentsconsidered responsiveto items(1), (10), (18), and (19) of
CREW's FOIA request. I alsonotified you that I had taskedthe Manpower and ReserveAffairs
(M&RA) Departmentof this Headquartersto ascertainwhetherthey could accuratelycalculate
numbersfrom the Marine Corps Total Force System(MCTFS) databaseto respondto item (4)
and to Family Advocacy Program(FAP) record files to respondto item (8).

Attachedat enclosure(1) is an Index of the documentsidentified,to date,as responsive


to CREW's FOIA request. This Index also addresses the FOIA releasabilityof eachidentified
responsivedocument. Becauseall of thesedocumentsdeterminedto be responsiveto item (l)
havebeenpostedto variousInternetwebsites,I haveprovided you the URLs from which the
responsivedocumentscanbe downloadedand printed.

As to item (4) of CREW'srequest,knowledgeableM&RA personnelin the Manpower


Information Division (MIT) ran queriesof the Marine Corps Total Force System(MCATS) database
to identifu the number of Marines,by calendaryear,dishonorablydischarged,given bad conduct
discharges,or, in the caseof officers,the total number of dismissals.The resultsof thosequeries
are identified as documentsUSMC (15) and USMC (16) and copiesare provided at enclosure(2).

As for item (8) of CREW's request,be advisedthat knowledgeableM&RA personnelin the


M&RA FAP Branchhave apprisedthat there is no centralizeddatabasethat collectsthe numberof
Marines ordered to attend angermanagementclassesandlor counseling,let alone one that collects
the nurnber of those orderedto attendpursuantto a deferred prosecutionagreementor diversion
program. Calculation of this number would require an extensive manual searchand review of
hundredsof paper file charts/ recordsmaintained in FAP and legal offices acrossthe USMC.

This type of search/reviewis not consideredreasonable.Accordingly, item (8) of CREW'srequestis


consideredto be "unperfected"and no further action is being takento provide CREW a responseto
this item.

Regardingitem (10) of CREW'srequest,be advisedthat knowledgeablepersonnelin the


M&RA FAP Branch have also apprisedthat the only documentationof a Marine'sattendanceat
mandatedangermanagementclasseswould be "sign-in" sheetsmaintainedat eachinstallation.
However, simply providing copiesof the sign-in sheetswould not provide an exactnumberof
Marineswho attendedsuchclassessincesomeattendeesare not mandatedto take the classas part
of a domesticviolencetreatmentprogrambut simply want to attendfor their own personalinterest.
Therefore,eachand every sign-in sheetwould have to be reviewedand only the numberof Marines
mandatedto take the classcounted. Further,we havebeenapprisedthat there are inconsistencies
acrossUSMC installationFAP offices with regardto attendancerecord keeping. Someinstallations
maintainsign-in sheets,somejust updatethe attendanceinformationon the individual Marine's
chart. Additionally, we were apprisedthat FAP offices do not maintainrecordsthat would reflect
any action taken againsta Marine for failure to attendordered angermanagementclassesand/or
counseling. Instead,suchrecordswould be maintainedat local commandlevelswhere local
installationFAP offices would ascertaina "no show" from an individual Marine'schart and notify
the Marine's commanding officer, letting the commandtake action, as appropriate. Any effort to
collect,review, and count the numeroussign-in sheetsand/orindividual chart recordsgenerated
since I Jan2001 would be an enormouseffort, exhaustinghundredsif not thousandsof manhours.
Becausesuch an effort is not consideredreasonable,item (10) of CREW's requestis consideredto
be "unperfected"and no further action is being takento provide CREW a responseto this item.

As for item (18), be advisedthat knowledgeablepersonnelwith the JudgeAdvocateDivision


of this Headquartershave apprisedthat neitherthe Departmentof the Navy (DON) nor the USMC
maintain any centralized databasesthat would allow for the ready identification of documentsthat
would reflect USMC decisionsnot to prosecutea Marine for a domesticviolencecrime becausesuch
a prosecutionwould have preventedthe Marine Corps from being able to deploy that Marine to Iraq,
or any other foreign country. A manualsearchof an incalculablenumberof paperfiles maintained
by eachand every Marine commanderwith suchdecisionmaking authority. Becausesuchan effort
is not consideredreasonable,item (18) of CREW's requestis consideredto be "unperfected"and no
further action is being taken to provide CREW a responseto this item.

Finally, regardingitem (19), be advisedthat we have learnedthat responsiveinformationis


maintainedin the USMC CentralRegistryfor DomesticAbuse Incidents. An MSExcel spreadsheet
report listing eachresponsivedomesticviolenceincidentwas generatedfrom that Registryand
is listed on the provided Index as
providedto this office for releaseto you. That spreadsheet
documentUSMC (16) and a mpy is providedon the CD-ROM attachedat enclosure(2). We have
also beenapprisedthat the Registrydatabasehasthe ability to producea two-pagereport,commonly
calleda maltreatmentreport, for eachincident. The recordscustodianfor the Registryis located
within the Personneland Family ReadinessDivision (MR) of the Manpower and ReserveAffairs

Departmentof this Headquartersand is currently downloading and preparing the 2-page


maltreatmentreportsfor provisionto this office. Be advised,however,that the maltreatment
reportscontainpersonalsensitiveinformationabout sponsors,offenders,and victims that will
haveto be redactedfrom thesereportsprior to their releaseto you. Becauseof the numberof
responsivedomesticviolence incidents(15,926),I will be releasingthem to you in batchreleases
of approximately1,000reportsat a time. I'm hoping to makethe first batchreleaseby or before
the middleof September 2010.

Further,be advisedthat, while M&RA (MR) maintainsthe USMC CentralRegistry


database,they do not maintainindividual casefile recordspertainingto individualsinvolved
in domesticviolence incidents. Instead,theserecordsare maintainedat the variousUSMC
installationlevel Family Advocacy Centers. Shouldyou wish to pursuea requestfor copiesof

installation.
