"

AN ACT TO CONTROL TOXIC SUBSTANCES AND HAZARDOUS AND NUCLEAR WASTES,


PROVIDING PENALTIES FOR VIOLATIONS THEREOF, AND FOR OTHER PURPOSES

Toxic Substances and Hazardous, and Nuclear Wastes Control Act of 1990 : (1) regulate, restrict or prohibit
the importation, manufacture, processing, sale, distribution, use and disposal of chemical substances and
mixtures that present unreasonable risk and/or injury to health or the environment; (2) prohibit the entry,
even in transit, of hazardous and nuclear wastes and their disposal into the Philippine territorial limits for
whatever purpose; and (3) provide advancement and facilitate research and studies on toxic chemicals.

Toxic Substances and Hazardous, and Nuclear Wastes Control Act of 1990 shall cover the importation,
manufacture, processing, handling, storage, transportation, sale, distribution, use and disposal (from cradle to
grave) of all unregulated chemical substances and mixtures in the Philippines, including the entry even in
transit, as well as the keeping or storage and disposal of hazardous and nuclear wastes into the country for
whatever purposes.

Scope
This Act shall cover the importation, manufacture, processing, handling, storage, transportation, sale,
distribution, use and disposal of all unregulated chemical substances and mixtures in the Philippines

Policy
It is the policy of the State to regulate, restrict or prohibit the importation, manufacture, processing, sale,
distribution, use and disposal of chemical substances and mixtures that present unreasonable risk and/or
injury to health or the environment

Objective
This act aims to:
A. Keep an inventory of chemicals that may be considered relevant to the protection of health and the
environment;
B. To monitor and regulate the use and disposal of chemica substances and mixtures that present
unreasonable risk or injury to health or to the environment in accordance with national policies and
international commitments;
C. To inform and educate the populace regarding the hazards and risks attendant to the manufacture,
handling, storage, transportation, processing, distribution, use and disposal of toxic chemicals and
other substances and mixture;
D. To prevent the entry, even in transit, as well as he keeping or storage and disposal of hazardous and
nuclear wates into the country for whatever purpose

Department of Environment and Natural Resources : The role of the DENR- it is tasked to
keep an inventory of chemicals, test potential hazardous substances, evaluate, monitor, subpoena
witnesses and disseminate information.

 The implementing agency and assisted by the Inter-Agency Advisory Council

Provides for the regulation of all chemical substances that may pose threat to public health and the
environment

The Inter-agency technical advocacy council


- There is hereby created an inter-agency technical advisory council. It shall assist the DENR to create
pertinent rules and regulations related to this act.
- There is an Inter-agency Technical Advisory Council attached to the Department of Environment
and Natural Resources which shall be composed of one (1) chairman and ten (10) members :
Secretary of DENR as Chairman,
- and Secretary of DOH (Dept of Health),
- Director of PNRI (Phil. Nuclear Research Institute),

- Secretary of DTI (Dept. of trade and industry),
- Secretary of DOST (Dept of Science and Technology),
- Secretary of DND (Dept. of National Defense),
- Secretary of DFA (Dept. of Foreign Affairs),
- Secretary of DOLE (Dept. of Labor and Employment),
- Secretary of Finance,
- Secretary of Agriculture,
- & Representative from the non-governmental Organization on healthy and safety.

Prohibition (The following shall be considered unlawful under Section 13)

A.) Knowingly use a chemical substance or mixture which is imported, manufactured, processed or
distributed in violation of the Act

B.) Failure or refusal to submit reports, notices or other information, access to records, as required by this
Act

C.)Failure or refusal to comply with the pre-manufacture and pre-importation requirements

D.) Cause, aid or facilitate, directly or indirectly, in the storage, importation, or bringing into Philippines
territory any amount of hazardous and nuclear wastes in any part of the Philippines

Penalties:
- The penalty of imprisonment of six months and one day to six years and one day and a fne ranging
from Six hundred pesos to four thousand pesos (P 600.00 – P 4,000.00) shall be imposed upon any
person who shall violate section 13 (a-c) of this act shall not be covered by the probation law.
• Violation of Section 13 (A-C) is committed by partnership, corporation, association:
The partner, president, director or manager that did the violation shall be directly liable and responsible for
the employees and shall be criminally liable as co-principal.

• Violation of Section 13 (A-C) is done by government official or employee


Aside from penalties, automatically dismissed from office and permanently disqualified from holding any
elective or appointive position

• Violation of Section 13 (D)


Penalty of imprisonment of 12 years to one day to 20 years
If foreigner, he or she shall be deported after serving his or her sentence

• Violation of Section 13 (D) is done by corporations or other associations


• Penalty shall be imposed upon the managing partner, president or chief executive in addition to the
exemplary damage of at least ₱500,000.00
• If foreign firm, directors and officers shall be barred from entry to the Philippines and cancellation of
its license
• Confiscated and forfeited chemical substances shall turn over to DENR for safekeeping or proper
disposal
• Person or firm responsible or connected with bringing or importation into the country of hazardous
or nuclear wastes shall be obligated to transport or send it back

Effects of Toxic waste


Toxic waste contains chemicals, heavy metals, radioisotopes, dangerous pathogens, or other toxins.
Toxic wastes spreads quite easily and can contaminate lakes and rivers. The term is often used
interchangeably with “hazardous waste”, or discarded material that can pose a long-term risk to health or
environment.

• Short-term exposures to high levels of toxic waste can result in impaired liver function and skin
lesions, difficulty in breathing etc.

• Long-term exposures can impair the reproductive system (difficult pregnancies, birth defects etc.),
the immune system (skin cancer, lung cancer etc.), the endocrine system and the nervous system
