DECISION

The Zoning Board of Appeals met on December 18, 2017 at 6:30 P.M. at the
former Town Library, present were members: Donald Zebrowksi, Chair,
Members: Kathleen Bronner, Jeremy Carrier, Ronald Harrop, Brian Kennedy
and Alan Champagne. Also present, Town Attorney Edward Ryan, Esq.

Chairman Donald Zebrowski called the meeting to order at 6:30 P.M. and
announced that the purpose of the meeting was for the ZBA to discuss,
deliberate and vote on its decision regarding the Appeal of the Granby Bow
and Gun Club to an order issued by the Town of Granby Selectboard acting as
the Zoning Enforcement Officer dated September 6, 2017. The Zoning Board
of Appeals had held a public hearing on November 20, 2017 where both the
Club and the Town were represented by counsel, introduced testimony,
submitted exhibits and made oral arguments. Following the close of the
hearing the ZBA received written briefs from both sides in support of their
respective positions.

At the Zoning Board of Appeals' public meeting held on December 18,2017 the
ZBA took public votes on a series of questions following and opportunity to
discuss each question.

For an accurate copy of the Board's vote on each of the questions posed see
Exhibit "A" Granby Zoning Board of Appeals minutes for ZBA meeting
December 18, 2017. Said minutes and recorded votes are incorporated herein
and made a part of the ZBA's decision.,

At the conclusion of these individual votes, all of which were unanimous, the
Board entertained a single motion made by Kathleen Bronner as follows:

I move that we adopt the various votes made by the members


to the questions posed bythe Chairperson and that the same
shall constitute the decision ofthe ZBA regarding the appeal
of the Granby Bow and Gun Club.

The Board voted unanimously to adopt the motion and have it constitutetheir
decision on the appeal ofthe Granby Bow and Gun Clubs appeal ofthe
Selectboards order dated September 6,2017

Minutes for ZBA Meeting - December 18,2017

ZBAChair Don Zembrowski opened meeting at 6:30 pm

Those ZBA members present introduced themselves.


ZBA members present: Donald Zembrowski, Chair, Members: Kathleen Bronner, Jeremy
Carrier, Ronald Harrop, Brian Kennedy and Alan Champagne. Also present, Town Attorney
Edward Ryan, Esq.

The following individual issues were presented and voted on individually by the Board:

Based upon the evidence presented by the parties at the Appeal Hearing held on November 20,
2017:

A. 1) Do we as the ZBAfind that the special permit issued on January 25, 2010 to the Granby
Bow and Gun Club expired prior to the construction of the shooter shed and therefore, was
no longer in force and effect when it was build?
Any Discussion? Being none. ZBAmembers voted unanimously in favor to uphold the decision
that the special permit expired.

2) Do we as the ZBAfind that the subject property owned by the Gun Club was used as a Bow
and Gun Club prior to the adoption of the Town of Granby Zoning By-laws and as such certain
Bow and Gun target shooting was permitted as persisting non-conforming use?
Any Discussion? Being none. ZBA members voted unanimously yes.

3) Do we as the ZBA find the 1,000 plus yardage target shooting should not be used and that
the cease and desist order of the Selectboard acting as the Zoning Enforcing Officer should
remain in effect?
AnyDiscussion? Ron Harrop asked ifthe Club addressed proper process in obtaining
appropriate permits can this be a pathwayfor addressing this issue. ZBA members agreed that
ifthe Club revisited proper process, this issue can be addressed.
As of this point in time, the ZBA members voted unanimously infavor to uphold the decision to
uphold the cease and desist order of the Selectboard acting as the Zoning Enforcing Officer.

Based upon the evidence presented by the parties at the Appeal Hearling held on November 20,
2017:

1) That the club removed earth material from the premise in excessof15cubic yards without
obtaining the necessary permits pursuant to Section 5.8 of the Town of GranbyZoning By
laws:
After brief discussion that this evidence can't be verified, the ZBA voted unanimously No.
