‘The affiant is a citizen and resident ofthe State of Flovida, and thet he has a probable cause to believe that
evidence related to Driving Under tho influence Manslaughter and or Vehicle Manslaughter, or Driving
under the influence causing Serious Bodily Injury in violation af Section 316,193(302) and section
316.193 (303) , Florida Statutes is located at Lawnwood Regional Medical Center, 1700 8 23rd St, Fort
Pierce, FL 34950, and is desoribed as follows
DIRECTIONS TO LOCATION
Starting at the intersection of South 25 Streot and Virginia Ave, Fort Pierce, FL, travel south on South
25# Stet. Mako a right on Frist Blvd, Travel Fast approximately 1200 feet to anive atthe location to
bbe searched,
EVIDENCE TO BE SEIZED
Anny and all vials of blood taken from Julio Ruiz, DOB: 11/19/1988 at Lawnwood Regional Medical
Center on 12/25/2017. Additional evidence is sought is the name of the person who drew the blood a3
‘well as the dato and time the blood was withdrawn.
‘Lavmnwood Regional Medical Canter” possesses evidence velovant to proving the commilsaion of
Driving Under the Influence Manslaughter and or Vehicle Manslaughter, or Driving under the influence
‘causing Serious Bodily Injury in violation of Seotion 316.193(3c2) and section 316.195 (303) , Florida
‘Statutes. Said evidence is described as any and all vials of blood taken from Julio Ruiz, DOB:
11/19/1988 at Lavmwood Regional Medicel Center on 12/25/2017,
PROBABLE CAUSE
‘Yout Affiant has been a law enforcement officer for 4 yeats and has completed no less than
approximately 30 impairment investigations including but not limited to the use of the Standardized
Ficld Sobriety Exercises. Your Affiant has also been a traffic homicide investigator for 3 years, Your
Affiant has had in excess of 280 hours of crash investigation training. Your Affiant has edministored the
Standardized Field Sobriety Exercises no Jess than 60 times. Your Afiant has established significant
reliability in the administration and intorprotation of the Standardized Field Sobriety Exercises
including the Horizontal Gaze Nystegrous (H.G.N.) Test, Your Afiant has investigated no leas then 200
teaffic related crashes, which inclades 15 traffic homicide investigations and or serious bodily injury
crashes,
1, On Monday 12/25/17, aftiant was called out to the intersection of Cortez Blvd and Suntise Blvd
{in reference to a vehicle crash resulting in the death af a rear passenger, Onee on scene, 1
observed skid marks in the westbound lane of Cortez Bivd. The vehicle should have beea
‘traveling ia the eastbound on Cortex Blvd,, based on the direct of travel, The skid marks
fae‘continued aeross Sunrise Bivd. The skid marks begin on Corton Blvd, approximately 60 feet
‘west of the intersection, There is a stop sign located on Cortez. Blvd, approaching Sunrise Blvd,
‘The sid marks start before the stop sign and proceed through the intersection approximately
300 feet, The skid marks proceed fo and stop ata bieck Toyota Corolla, Your affiant observed
the black Toyota Corolla to have struck a Ford F-250 head on based on the track of the skid
‘matks, The Ford F-250 bed extensive front nd damage. The Ford F-250 was parked atthe time
of the collision, The F-250 was pushed backward and sideways approximately 20 feet upon
impect. From the aid marks, itis clear « proper stop was not completed atthe stop sign. The
skid marks continued on the driveway and into yard of 2811 Sunise Blvd before stopping atthe
rear tites ofa black 4 door sedan,
2, Your affiant looked inside the black Toyota Corolla from the outside, Both passenger side doors
‘had been removed by the fire department prior to this ofticer’s arrival on scene, Inside, your
affiant observed blood on the airbags deployed on both the front driver and passengor sides of
the vehicle. Your afiant also observed the inside to be destroyed fkom the Lmpact with blood
‘and brain matter scattered foroughout the vehicle.
3. Your affiant was told by Officer Edward Black thet a pair of men’s jeans was found next to the
driver's side of the vehicle, which appeared to have been cutoff the driver. He found what he
knew through training and experience to be camnbis ahake in the pocket of the pants. Also, a
corona beer bottle cap was located in the pants,
4, Your aftiant was told by Of, Tumblin that Julio Ruin was transported by St. Lucie Fire Resoue
to Lawnvvood Regional Medical Center from the location ofthe erash on December 25, 2017,
5. On Decembec 25, 2017, your affiant went to Lawawood Regional Medical Center and observed
Julio Ruiz inthe hospital, Ho hd evidence of medical intervention, The medical stuff indicated
that blood was drawn from Julio Ruiz as part of medical treatment,
6. On 12/27/17, your affiant spoke to Firefighter, Tony Conte, who stated the driver (ater
identified as Julio Ruiz) was out of the vehiole when he arrived on scene, there was a juvenile
onal (identities Alt Ruiz in the back diver’ side seat orying, here was a juvenile mal
(ontfied as Issac Santillan) lying on top of the passenger seat headrest and there was en adult
female (identified as Yenira Beanga) wedged between the dashboard and floor on the front
passenger side when he arrived on scene, He stated he was the fist on scene, He farther stated
the entize vehicle smelled like eloohol and none of the passengers were seat belted atthe time of
‘he crash,
7. Officer Candice Keman-Fullen conducted traffic crash investigation. Your affiant reviewed
the CAD and Officer Kernan-Pullen’s report, which both stated Issae Sanillan wes pronounced
dead atthe soene by St. Lucie Fire Rescue at approximately 4:50am on 12/25/17,
8, Based on the reconstruction ofthe skid marks by your affiant, the vehicle is estimated to have
boon traveling at the tine ofthe skid boginning at a minimum of 77 miles per hour in a 30 mile
pot hour zone, At the time of impact with tho Ford F-250, the black Toyota Corolla was
‘traveling at approximately 39 miles per hout,
9, On 12/26/17, your affiant interviewed Julio Ruiz at Lawnwood Regional Medical Center, Your
affiat observed him to have bruises and abrasions to his face end arms, These injuries were
consistent wit injures fom airbag deploymeat. Your affiant asked Julio Ruiz for identifying
{nfotraation before conducting an interview. He stated his name was Julio Ruiz, DOB
11/19/1988, Julio Ruiz stated he was at a barbeque and had a couple of drinks, He also stated be
started getting a headache and took a couple of unknown pills forthe hoadacke, He does not
remember anything after taking the pills, Julio Ruiz acknowledged he was the fther of Alani
Ruiz,
10. On 12/27/17, your affiant spoke to Alani Ruiz, 6 years of age, at St, Mary's Hospital in Palm
Beach, Your affiant observed het to have swollen left eye, cut on her nose, and a broken left erm
eel‘and right og, Alani Ruz wes asked if she remembered what happened. She stated deddy was
going really fat, saying he was going faster and faster: She stated then she hit her hend, her leg,
‘and her eye. She said her brother hit the windshicld, Then, the plane came. Your afiant was
{nfonned by dispatch that the juvenite female ftom the crash was flown by helicopter tothe
hospital.
11, n 12/28/17 your affant conducted a vehicle search ofthe above vehicle, Located under the
ctiver seat was a corona beer bottle cap, looated onthe driver seat was a small clear ar that
contained cannabis, and loceted in the center eonsole wes a pipe used to smoke the cannabis
that had been broken during the ora,
‘The defendant wes operating the vehicle that caused or contributed to the motor vehicle crash and
appears to be under the influence of an aleoholic beverage and/or chemical and/or controlled substance,
‘There is probable cause to believe thet within the defendant's blood is being kept certain evidence
which is relevant to the commission of a felony.
Your Affiant further requests authority for Police Officers of the Fort Pierce Police Department, to seize
‘the blood being held at Lavmwood Regionel Medical Center, and send to FDLE to be tested forthe
preseace of tity! aloohol and/or the presence ofa chemical and/or controlled substanes, Said property
‘was used to commit an offense as sot forth inthis affidavit for search warrant. These incidents occurred
