II. OFFER.
The testimony of the witness Jury Junsan is being offered to prove:

1. The existence of the debt between the plaintiff and defendant;

2. The fact that a partial payment has been received by the plaintiff;

3. The plaintiff has been in possession of the defendant’s car as security


of the loan.

4. That the plaintiff is unable to return the car due to loss.

III. JUDICIAL AFFIDAVIT PROPER.

I, JURY JUNSAN, 31 years old, single, Filipino, and residing at Zone 3, Bo.
Obrero, Iloilo City, Philippines, under oath, depose:

1. Q – Please state your name, age, residence, and occupation of the


witness.

A– I am Jury Junsan , 31 years old, single, Filipino, and residing at


Zone 3, Bo. Obrero, Iloilo City, Philippines. I work as a supervisor at IBC
company.

2. Q- Why are you here now?

A – To give a sworn statement by way of a judicial affidavit, the


same to constitute as my direct testimony, in the above-captioned
civil case.

3. Q- For the record, please state the name and address of the
Lawyer who is now conducting or supervising your examination and the
place where the examination is being held now?

A – The legal counsel for the defendant, Atty. Abundio Bacatan


is conducting or supervising my examination now at his law office located at

Don Bosco Boys’ Home, Dumangas, Iloilo.

4. Q – In what language do you want your examination to be conducted?

A– This judicial affidavit is prepared in English.

5. Q – Do you undertake to answer the questions to be asked of you,


fully conscious that you will do so under oath, and that you may face
criminal liability for false testimony or perjury?
A - Yes.

6. Q – Let us now proceed to the Complaint. Do you know the


plaintiff LOVELY DE LA TORRE?

A – Yes

7. Q – How did you come to know her?

A – She is my girlfriend.

8. Q – Why are you testifying in this case?

A – I am testifying as a defendant of a complaint filed by her against


me for collection of sum of money.

9. Q – When did you borrow money from her?

A – I borrowed money last October 17, 2016 at her home in Pavia,


Iloilo.

10. Q – How much money did you borrow?

A – I borrowed five hundred thousand Pesos (P500,00.00)

11.Q – Did she lend you the amount?

A – Yes. It was an emergency. Our house was partly damaged by fire


in our neighborhood and I needed the money to repair it.

12. Q – When was the debt due?

A – I promised to pay her on October 1, 2017. My sister from abroad


was already preparing the sum for the payment.

13. Q – Have you then paid her?

A – I made partial payment of the debt of the amount two hundred


thousand Pesos (P200,000.00), and she gave me a receipt. (“Annex” 2)

14. Q - Anything else?

A – I also left my car, a Toyota Wigo as security for my debt.

15. Q – Anything else?


A – Last September 30, 2017, the car was stolen while it was still in
her possession. So I told her that I will not pay her until my car is
recovered. I have a police blotter on the incident (“Annex” 1)

16. Q - Anything else?

A – My car has not yet been recovered. The of a car like the one I lost
is around three twenty thousand Pesos (P320,000.00).

Nothing Follows.

Dumangas, Iloilo, Philippines , under oath, deposes and states:
1. He is the Legal Counsel for the plaintiffs in the above-entitled case;

2. He faithfully recorded or caused to be recorded the questions


he asked and the corresponding answers that the above-named
witness gave;

3. Neither he nor any other person then present or assisting him


coached the witness regarding the latter's answers; and

4. He conducted the examination of the witness at his Bacatan Law
