The London Local Authorities and Transport
for London Act 2003, (Section 14)

Up until the above Act came into operation, it was the responsibility of the
Police to take action against motorists who “parked in front of dropped
footways” (sloping kerbs).

Responsibility for taking enforcement action against motorists for parking

in front of dropped footways (sloping kerbs) was transferred from the
Police to the Local Authorities and Transport for London. The Police retain
some powers and still take enforcement action for obstruction of the
public highway.

What does this mean for me?
It means, that Parking Attendants will be
able to issue Penalty Charge Notices
(parking tickets) to motorists for parking in
front of dropped footways (sloping kerbs),
however, parking tickets can only be
issued under the following circumstances:
1:
The Council can issue parking tickets to
any motorist parked in front of a shared
or pedestrian dropped footway.
A shared dropped footway is a footway
used by two or more residents or
business users to enter / exit their
driveway. A pedestrian dropped
footway is used by pedestrians to cross
the road, e.g. by a pedestrian refuge.
2:
The Council can only take enforcement
action against a motorist for parking in
front of a single use dropped footway if
the resident affected has authorised the
Council to do so. Bexley Council will
require residents to register their details
and this will enable the Council to issue
parking tickets to any vehicle parked in
front of such a dropped footway (this
includes resident’s own vehicles).
Single use dropped footways are used
by one resident or one business user to
enter or exit their driveway.
How do I give permission for the
Council to issue parking tickets
to motorists parked in front of
my single use dropped footway?
The Council will be creating a register of
resident’s details for all residents who
authorise the Council to issue parking
tickets to motorists parking in front of
single use dropped footways. To
register please complete the attached
registration form, you must read the
Terms and Conditions below before
completing the registration form.
Terms and Conditions:
1. I request and authorise the Council to
enforce the legislation prohibiting
parking on the road adjacent to my
single use dropped footway (which
only I can use to enter or exit my
driveway and is not shared by other
residents of other properties).
2. I understand and accept that any
vehicle (including those which are
registered at my address) which is
seen parking in front of the single use
dropped footway (which only I can use
to enter or exit my driveway and is not
shared by other residents of other
properties), is liable for a parking ticket
for contravention (27) “parked adjacent
to a dropped footway”.
3. I understand and accept that the
Council’s parking enforcement
contractor will have access to the data
that I provide on the attached
registration document or details that I
subsequently supply in a written
format, which they may use for
verification purposes.
4. I understand and accept that the data
I provide will be distributed to Parking
Attendants (working on behalf of
Bexley Council), to ensure that the
Council enforces the regulations in
accordance with its statutory
obligations and in a fair and even
manner, and to allow the Parking
Attendant to verify my details
as authentic.
5. I understand and accept that in the
event of a parking ticket being issued
to me, my family or visitors to my
premises, for parking in front of the
single use dropped footway outside
of my house, should we consider it
reasonable to challenge the issue of
the parking ticket we will follow the
statutory process as shown on the
reverse of the parking ticket.
6. I understand and accept that the
Council do not guarantee that any
parking tickets issued under term 4
above will be cancelled as
each case is judged on its own
individual merits.
7. I understand and accept that the
enforcement of the regulations that
govern vehicles parking in front of
dropped footways, does not
supercede or undermine any existing
parking restrictions, (single or double
yellow lines), or parking regulations
(resident or short stay parking bays
etc), during the restricted hours of
such restrictions or regulations.
8. I understand and accept that I may be
asked to provide documentation to
support my claims of residency
should there be any discrepancies
that require the Council to make
enquiries, and that the Council may
check my details against those held
on the electoral register or other
Council records.
9. I understand that I can withdraw the

request and authorisation at any time
by writing to the Council. Such
withdrawal will take effect (7 days
from) the date of receipt.
