TITLE 1 - CRIMES AGAINST THE PERSON

240 PC. Assault

Any person who, except in self-defense, places another person in reasonable fear of harm,
or any person who attempts to cause harm to another.

240 PC is a misdemeanor, punishable by up to 6 months of imprisonment in county jail.

245(a)(1) PC. Assault with a Deadly Weapon


Any person who attempts to cause or threaten immediate harm to another whilst using a
weapon, tool, or other dangerous items to communicate that threat.

Any person who commits an assault upon another person with a deadly weapon or
instrument, not including a firearm.

245(a)(1) PC is a misdemeanor, punishable by up to 1 year of imprisonment in county jail.

242 PC. Battery


Any person who unlawfully causes harm to another, except in self-defense, with the intention
to do so.

242 PC is a misdemeanor, punishable by up to 6 months of imprisonment in county jail.


243(d) PC. Aggravated Battery
Any person who intentionally and unlawfully uses great or continued force of violence
against another person.

243(d) PC is a felony, punishable by up to 1 year of imprisonment in county jail or by up to 4


years of imprisonment in a state penitentiary.

210.5 PC. False Imprisonment


Any person who:

(1) without consent, detains or arrests another person for an extended period of time.

(2) without consent, restricts one's freedom of movement from another person for an
extended period of time.

(3) performs an unlawful citizen's arrest.

210.5 PC is a felony, punishable by up to 1 year of imprisonment in county jail or by up to 4


years of imprisonment in a state penitentiary.

207 PC. Kidnapping


Any person who detains or arrests another without their consent:

(1) with premeditated aforethought or;

(2) for a very long period of time or;

(3) for the purpose of holding that individual ransom of any kind.

207 PC is a felony, punishable by up to 8 years of imprisonment in a state penitentiary.


664 PC. Attempted Murder
Any person who:

(1) unlawfully attempts to kill another person or cause life-threatening harm to another
person with premeditated actions.

(2) through criminal accident, negligence, or in the "heat of passion", causes severe or life-
threatening bodily harm to another person.

664 PC is a felony, punishable by up to 10 years of imprisonment in a state penitentiary.

187 PC. Murder


Any person who unlawfully kills another human being. Murder is categorized by degrees of
first, second and capital murder.

(a) Any person who commits murder associated with the following shall be classed as first-
degree murder:

(1) Using a destructive device or explosive, a weapon of mass destruction, poison, or metal
piercing ammunition

(2) Torturing someone

(3) Murdering someone willfully, deliberately, and with premeditation

or if an individual is killed in any of the following crimes:

(5) Arson

(6) Robbery

(7) Burglary

(8) Carjacking

(9) Train Wrecking

(10) Kidnapping

(11) Mayhem

(12) Torture

(13) Rape
(14) Unlawful Acts of Sodomy

(15) Forcible Acts of Penetration

(16) Lewd Acts with a Minor

(b) Any person who commits murder willfully but without malice or premeditation shall be
classed as second-degree murder.

(c) Any person who commits murder under the following shall be classed as capital murder:

(1) The murder of another for financial gain;

(2) The murder of a state-employed person such as a police officer, firefighter or public
official;

(3) The murder of another because of their race, color, religion, etc.;

(4) The murder of another by drive-by;

(5) the murder of more than one victim.

187(a) PC, "first-degree murder", is a felony punishable by 25 years to life.

187(b) PC, "second-degree murder", is a felony punishable by 15 years to life.

187(c) PC, "capital murder", is a felony punishable by death or imprisonment in a state


penitentiary for life without the possibility of parole or by imprisonment in the state
penitentiary for a term of 25 years to life, or death.

192 PC. Manslaughter


Any person who unlawfully kills another human being without malice aforethought.
Manslaughter is categorized by voluntary, involuntary and vehicular.

(a) Voluntary—upon a sudden quarrel or heat of passion.

(b) Involuntary—in the commission of an unlawful act, not amounting to a felony; or in the
commission of a lawful act which might produce death, in an unlawful manner, or without due
caution and circumspection. This subdivision shall not apply to acts committed in the driving
of a vehicle.

(c) Vehicular—through negligent operation of a land, sea or air vehicle.

192(a) PC, "voluntary manslaughter", is a felony punished by imprisonment in a state


penitentiary for a term of up to 9 years.

192(b) PC, "involuntary manslaughter", is a felony punished by imprisonment in a state


penitentiary for a term of up to 4 years.

192(c) PC, "vehicular manslaughter", may be a misdemeanor or felony based on severity


and negligence, punished by imprisonment for up to a year in county jail as a misdemeanor
or by imprisonment for up to six years in a state penitentiary as a felony.

243.4 PC. Sexual Battery


Any person who:

(1) commits an assault for the purpose of sexual arousal, gratification, or abuse.

(2) threatens non consensual sexual contact.

243.4 PC is a felony, punishable by up to 4 year of imprisonment in state penitentiary.

261 PC. Rape


Any person who engages with another in non-consensual sexual intercourse or acts
accomplished by means of threats, force, or fraud, or with another person who is
unconscious or incapable of consenting.

261 PC is a felony, punishable by up to 15 years of imprisonment in a state penitentiary. A


second offense is punishable by imprisonment in the state penitentiary for a life term, or
death.
647.6 PC. Child Molestation
Any person engaging in lewd acts with a minor, even if they are non-sexual in manner, for
the act of potential sexual gratification.

647.6 PC is a felony, punishable by 25 years to life, or death.

270 PC. Child Abuse & Neglect


Any person who:

(1) willfully causes or permits any child to suffer or allows thereon unjustifiable physical pain
or mental suffering.

(2) having the care or custody of any child causes the person or health of that child to be
injured beyond reason or placed in a situation whereby their health may be endangered.

(a) Severe abuse and negligence—Any person who, having care of custody of any child,
acts or refuses to act resulting in injuries causing permanent and severe disability or death.

270 PC is a felony, punishable by up to 6 years of imprisonment in a state penitentiary.

270(a) PC is a felony, punishable by up to 15 years to life of imprisonment in a state


penitentiary.

206 PC. Torture


Any person who, with the intent to cause cruel or extreme pain and suffering for the purpose
of revenge, extortion, persuasion, or for any sadistic purpose, inflicts great bodily injury upon
the person of another.

206 PC is a felony, punishable by 18 years to life of imprisonment in a state penitentiary.

273.6 PC. Violating a Restraining Order


Any person who violates the conditions of a restraining order by making contact with any of
the parties involved in the order by in phone, mail, notes, email, electronic communication,
using a third party to replay a message, delivery services, fax, or by going within 360 feet of
the person or person's home, work or school.

273.6 PC is a misdemeanor, punishable by up to 1 year of imprisonment in county jail.

TITLE 2 - CRIMES AGAINST PROPERTY AND CRIMINAL


PROFITEERING

451 PC. Arson

Any person who causes damage recklessly by fire or explosion to property such as land,
vehicles or buildings, whether or not that person owns said property.

(a) Intentional—Any person who commits any act of arson with malice aforethought.

(b) Negligent—Any person who, without malice aforethought, commits an act of arson.

451(a) PC, "intentional arson", is a felony, punishable by up to 10 years of imprisonment in a


state penitentiary.

451(b) PC, "negligent arson", is a felony, punishable by up to 5 years of imprisonment in a


state penitentiary.

601 PC. Trespassing


Any person who enters onto private property, without disabling or circumventing security
measures, without consent.

601 PC may be a misdemeanor, punishable by up to 6 months of imprisonment in county


jail, or a felony, punishable by up to 2 years of imprisonment in a state penitentiary.

459 PC. Breaking and Entering


Any person who enters another's property without their expressed permission to do so with
the intent to commit a crime.

(a) Burglary—Any person who commits the act of breaking and entering with the intent to
steal goods.

459 PC and 459(a) PC are both felonies, punishable by up to six years in a state
penitentiary.

466 PC. Possession of Burglary Tools


Any person who has in their possession the appropriate combination of tools for the
purposes of committing a crime, such as burglary, breaking and entering or other related
crimes. Tools may include, but is not limited to:

(1) toolkits;

(2) theft devices;

(3) pass-through layers;

(4) screwdrivers;

(5) crowbars;

(6) lockpicks.

466 PC is an infraction, punishable by a fine not exceeding $5,000.

594 VC. Vandalism


Any person who causes damage to, or otherwise defaces property, without the consent of
the property owner.

594 VC may be an infraction, punishable by a fine not exceeding $3,000, or a misdemeanor,


punishable by up to 6 months of imprisonment in county jail.
470 PC. Forgery
Any person who falsifies a document by means of representing themselves as another
person, or who falsifies a document by means of counterfeiting or unlawful duplication.
Additionally, any person who manufactures or engages in the sale of false identification
cards, false drivers licenses, or other false means of identification.

470 PC may be a misdemeanor punishable by up to 1 year of imprisonment in county jail, or


a felony, punishable by up to 4 years in a state penitentiary.

118 PC. Fraud


Any person who intentionally engages in false representation of fact with the intention to
deceive another for personal or financial gain.

118 PC may be a misdemeanor punishable by up to 1 year of imprisonment in county jail, or


a felony, punishable by up to 3 years in a state penitentiary.

186.10 PC. Money Laundering


Any person who uses money or other items, obtained through lawful or legitimate means, to
conceal or prevent the detection of the origins of money or other items obtained through
criminal means.

186.10 PC is a felony punishable by up to 4 years in a state penitentiary.

484 PC. Theft


Any person who steals or takes the possessions or property of another.

(a) Petty Theft—the theft of items not exceeding the cumulative value of $2,000.

(b) Theft—the theft of items above the cumulative value of $2,000 but not exceeding
$10,000.

(c) Grand Theft—the theft of items above the cumulative value of $10,000.

(d) Grand Theft Auto—the theft of a land, sea or air vehicle.


(e) Grand Theft of a Firearm—the theft of a firearm.

484(a) PC, "Petty Theft", is a misdemeanor punishable by up to 1 year of imprisonment in


county jail.

484(b) PC, "Theft", may be a misdemeanor punishable by up to 1 year of imprisonment in


county jail, or a felony punishable by up to 2 years of imprisonment in a state penitentiary.

484(c) PC, "Grand Theft", is a felony punishable by up to 3 years of imprisonment in a state


penitentiary.

484(d) PC, "Grand Theft Auto", is a felony punishable by up to 4 years of imprisonment in a


state penitentiary.

484(e) PC, "Grand Theft of a Firearm", is a felony punishable by up to 4 years of


imprisonment in a state penitentiary.

496 PC. Receiving Stolen Property


Any person who knowingly purchases, or otherwise receives property. that was stolen or
unlawfully obtained.

496 PC may be a misdemeanor punishable by up to 1 year of imprisonment in county jail for


goods not exceeding the cumulative value of $2,000, or a felony punishable by up to 3 years
of imprisonment in a state penitentiary for goods exceeding the cumulative value of $2,000.

211 PC. Robbery


Any person who takes property from the possession of another against their will by means of
force, fear, intimidation or threat of danger.

211 PC is a felony punishable by up to 6 years in a state penitentiary.

211 PC. Armed Robbery


Any person who takes property from the possession of another against their will by means of
force, fear, intimidation or threat of danger facilitated by a weapon or instrument used as a
weapon.
211 PC is a felony punishable by up to 8 years in a state penitentiary.

518 PC. Extortion


Any person who, by means of threats or actual intimidation, coerces a person to hand over
property or services or take action for personal gain.

518 PC is a felony punishable by up to 4 years in a state penitentiary.

470 PC. Forgery and Counterfeiting


Any person who falsifies a document by means of representing themselves as another
person, or who falsifies a document by means of counterfeiting or unlawful duplication.
Additionally, any person who manufactures or engages in the sale of false identification
cards, false drivers licenses, or other false means of identification.

470 PC may be a misdemeanor punishable by up to 1 year of imprisonment in county jail, or


a felony punishable by up to 3 years in a state penitentiary.

503 PC. Embezzlement


Any person who fraudulently appropriates property that has been entrusted to them, such as
funding for a business.

503 PC may be a misdemeanor punishable by up to 1 year of imprisonment in county jail, or


a felony punishable by up to 3 years in a state penitentiary.

215 PC. Carjacking


Any person taking a motor vehicle in the possession of another, from his or her person or
immediate presence, or from the person or immediate presence of a passenger of the motor
vehicle, against his or her will and with the intent to either permanently or temporarily deprive
the person in possession of the motor vehicle of his or her possession, accomplished by
means of force or fear.

215 PC is a felony punishable by up to 4 years in a state penitentiary.


319 PC. Lotteries
Any person who hosts or sells tickets to a lottery, raffle or gift enterprise.

A lottery is any scheme for the disposal or distribution of property by chance, among persons
who have paid or promised to pay any valuable consideration for the chance of obtaining
such property or a portion of it, or for any share or any interest in such property, upon any
agreement, understanding, or expectation that it is to be distributed or disposed of by lot or
chance, whether called a lottery, raffle, or gift enterprise, or by whatever name the same may
be known.

319 PC is a misdemeanor punishable by up to 1 year of imprisonment in a county jail and/or


a infraction for $5,000 to the host of the lottery.

330 PC. Illegal Gaming


Every person who deals, plays, or carries on, opens, or causes to be opened, or who
conducts, either as owner or employee, whether for hire or not, any game of faro, monte,
roulette, lansquenet, rouge et noire, rondo, tan, fan-tan, seven-and-a-half, twenty-one,
hokey-pokey, or any banking or percentage game played with cards, dice, or any device, for
money, checks, credit, or other representative of value, and every person who plays or bets
at or against any of those prohibited games.

330 PC is a misdemeanor punishable by up to 1 year of imprisonment in a county jail and a


infraction for $5,000 to the host of the illegal game.

TITLE 3 - CRIMES AGAINST PUBLIC JUSTICE

67 PC. Bribery

(a) Any person who gives or attempts to give money, items or service to a state or
municipally employed person in exchange for preferential treatment.

(b) Any state or municipally employed person who willingly and knowingly accepts money,
items or services in exchange for preferential treatment.
67(a) PC and 67(b) PC are felonies punishable by up to 4 years of imprisonment in a state
penitentiary.

1320.5 PC. Failure to Pay a Fine


Any person who fails to pay an infraction, a fine, or court ordered fee within a clearly stated
period of time. Any person shall not be charged per fine for a single arrest.

1320.5 PC is a misdemeanor punishable by up to 6-months of imprisonment in county jail.

148(a)(1) PC. Resisting Arrest


Any person who avoids apprehension from a police officer by mostly physical non-vehicular
means.

148(a)(1) PC is a misdemeanor punishable by up to 1 year of imprisonment in county jail.

836.6 PC. Escape From Custody


Any person who, whilst in the custody of a police officer, escapes from said police officer's
custody.

836.6 PC is a felony, punishable by up to 5 years of imprisonment in a state penitentiary.

148 PC. Obstruction


Any person who willfully and intentionally impedes the duties of a government employee.

148 PC is a misdemeanor punishable by up to 1 year of imprisonment in county jail.

653(y) PC. Misuse of a Governmental Hotline


Any person who uses an emergency hotline for anything other than an emergency.
653(y) PC is an infraction punishable by a fine not exceeding $3,000.

236.1 PC. Human Trafficking


Any person who intentionally:

(1) smuggles non-citizens into the state without proper visas and authorization or;

(2) restricts one's liberty through fear, intimidation or threat of danger for forced labor or sex
trafficking, or other forced activities.

236.1 PC is a felony, punishable by up to 15 years of imprisonment in a state penitentiary.

31 PC. Aiding and Abetting


All persons concerned in the commission of a crime, whether it be felony or misdemeanor,
and whether they directly commit the act constituting the offense, or aid and abet in its
commission.

31 PC Aiding and Abetting may be a misdemeanor punishable by up to the same time of


imprisonment in county jail for the crime committed by the person they assisted, or a felony
punishable by up the same time of imprisonment in a state penitentiary for the crime
committed by the person they assisted.

32 PC. Accessory After the Fact


Any persons who harbors, conceals, or aids a person, who they know to have commited
a felony, in order to protect him or her from arrest, trial, conviction, and/or sentencing is
guilty of 32 PC. Accessory After the Fact.

32 PC is a felony punishable by up to 2 years of imprisonment in a state penitentiary.

141 PC. Tampering with Evidence


Any person who alters, destroys, suppresses, removes, or conceals any record, document,
or article with the purpose of impairing its discovery, legibility, or availability in any official
proceeding or investigation.

141 PC is a felony punishable by up to 3 years of imprisonment in a state penitentiary.

529 PC. Impersonation


(a) Any person who falsely represents their identity for personal, professional, or financial
gain shall have committed impersonation or

(b) Any person who impersonates an employee of a state or municipal government.

529(a) PC is a felony punishable by up to 3 years of imprisonment in a state penitentiary.

529(b) PC is a felony punishable by up to 5 years of imprisonment in a state penitentiary.

166 PC. Contempt of Court


Any person who willfully disobeys the verbal or written order of a court authority or
disrespects the decorum or the court or otherwise infringes upon due process.

This charge shall only be issued by a judge or appropriate staff member of the court.

166 PC is a felony punishable by up to 2 years of imprisonment in a state penitentiary.

92 PC. Corruption
Any person who commits an act of corruption:

(a) of Public Office—whilst occupying an elected or appointed seat or office in government.

(b) of Public Duty—whilst occupying a duly-sworn position.

92(a) PC and 92(b) PC are felonies punishable by up to 7 years of imprisonment in a state


penitentiary.
TITLE 4 - CRIMES AGAINST PUBLIC PEACE AND
DECENCY

314 PC. Indecent Exposure


Any person who intentionally:

(a) exposes their naked body or genitalia on public property or in the public area of a private
building.

(b) exposes their naked body or genitalia on private property without the permission of the
property owner.

(c) engages in sexual activities in public in view of a minor.

314(a) PC and 314(b) PC are misdemeanors punishable by up to 1 year of imprisonment in


county jail.

314(c) PC is a felony punishable by up to 5 years of imprisonment in a state penitentiary.

415. Disturbing the Peace


Disturbing the Peace is a breach of one of three aspects of the law: unlawful fighting,
unreasonable noise, and offensive words such as 'fighting words' meant to immediately
provoke an attack.

415 PC may be an infraction punishable by a fine not exceeding $3,000, or a misdemeanor


punishable by up to 6-months of imprisonment in county jail.

374.4. Littering
Any person who ignores publicly posted notices of waste containers by dumping waste or
other items in a non-designated area, container, or in a public place.

374.4 PC is an infraction punishable by a fine not exceeding $3,000.


407 PC. Unlawful Assembly
Any person who engages in a protest or other assembly without a permit, and who refuses to
disperse upon request by a Peace Officer.

407 PC may be an infraction punishable by a fine not exceeding $3,000, or a misdemeanor


punishable by up to 6-months of imprisonment in county jail.

404 PC. Rioting


Any person using force or violence, disturbing the public peace, or any threat to use force or
violence, by two or more persons acting together, and without the authority of law, is a riot.

(a) Any person willfully or knowingly participating in a riot.

(b) Any person willfully or knowingly inciting a riot or attempting to incite a riot.

404(a) PC, "participating in a riot", may be an infraction punishable by a fine not exceeding
$5,000, or a misdemeanor punishable by up to 1 year of imprisonment in county jail.

404(b) PC, "inciting a riot", may be a misdemeanor punishable by up to 1 year of


imprisonment in county jail, or a felonypunishable by up to 4 years of imprisonment in a state
penitentiary.

647(b) PC. Prostitution


Any person who engages in sexual favors or activities or solicits these actions, intended for
sexual gratification of the recipient, in exchange for compensation in the form of goods or
services including, but not limited to, money, housing, food, or other commodities.

647(b) PC is a misdemeanor punishable by up to 2 years of imprisonment in a state


penitentiary.

266(h) PC. Pimping / Pandering


Any person who solicits, advertises, aids or provides transport or supervises persons
involved in prostitution and retains some or all of the money, objects, or other property

public infrastructure.

(1) uses systematic threats or actions against the public good to cause fear and intimidation

11379.6 HS. Manufacture of a Controlled Substance or Alcohol
(a) Controlled Substance—Any person who unlawfully engages in, or attempts, the
manufacturing of a controlled substance or derivative substance.

(b)Alcohol—Any person who unlawfully engages in, or attempts, the manufacturing of


alcohol or derivative substance.

11379.6(a) HS is a felony punishable by up to 8 years of imprisonment in a state

25658 BP. Sale of Alcohol to a Minor


A person who willfully and knowingly sells alcohol to a minor under the age of 21.

20002 VC. Hit and Run


Any person who hits another person or occupied motor vehicle and leaves the scene of the
accident.

20002(a) VC with Injury—Any person committing a Hit and Run which causes injuries to

20002(a) is a felony punishable by up to 3 years of imprisonment in a state penitentiary.

22450(a) VC. Failure to Yield to a Stop Sign


Any person who, while operating a motor vehicle, fails to observe instructions from a stop
sign or other traffic control device.

$750 for the first offense;

$1,250 for the second offense;

(1) demonstrates careless or general disregard to safety whilst operating a vehicle or;
(2) meanders between lanes of traffic erratically with disregard to safety or;

(3) demonstrates poor control of their vehicle or;

(4) drives on an underpopulated sidewalk, pedestrian passageway, or plaza.

23103 VC is an infraction punishable by a fine not exceeding:

$750 for the first offense;

$1,250 for the second offense;

Any person who drives a vehicle upon a highway or roadway or occupied sidwalk in willful or
wanton disregard for the safety of persons or property is guilty of reckless driving.

22350 VC. Speeding


Any person who, while operating a motor vehicle, exceeds posted or reasonable speed limits
on public roadways.

Speed limits shall be defined, where not otherwise posted, as follows:

(1) In residential areas and Greater Metropolitan, the speed limit shall be 30 miles per hour.

(2) In commercial and business districts, the speed limit shall be 45 miles per hour, except in
Greater Metropolitan areas.

(3) In rural districts and sparsely populated areas, and on highways and freeways, the speed
limit shall be 60 miles per hour.

22500 VC. Parking Violation


Any person who parks improperly, unlawfully or impedes public traffic or pedestrian

(8) On any bridge or tunnel.

(9) On any highway or freeway.

(10) On railroad tracks or within range of being struck by a railroad car or train.

(11) In immediate ambulatory parking or bay area of a hospital or clinic.

(12) In front of or obstructing a private driveway or an entrance or exit to a private road or


path.

(13) In a clearly marked disabled parking zone without proper permits, or without reasonable
cause.

22500(a) VC Impeding Public Services or Facilities—Any person who, by committing a


Parking Violation, impedes public services or facilities.
22500 VC is an infraction punishable by a fine not exceeding:

$750 and/or impoundment for 24 hours for the first offense;

$1,250 and/or impoundment for 24 hours for the second offense;

$2,000 and/or impoundment for 24 hours for the third, and subsequent, offenses.

22500(a) VC is a non-stackable infraction punishable by a fine not exceeding $2,500 and/or


impoundment for 24 hours.

26708 VC. Window Material Violation


Any person that installs, affixes or applies any transparent material upon the windshield,
driver side or passenger side window of any motor vehicle if the material alters the color or
reduces the light transmittance so that it prevents or obscures the vision of occupants
beyond a reasonable amount ((level 1 and level 2 are considered beyond a reasonable
amount)).

Any federal, state or municipal agency or department that requires glazed, protective or
darkened materials for the purposes of security, public safety or law enforcement shall be
exempt only for side windows and rear windows.

26708 VC is an infraction punishable by a fine not exceeding:

$750 for the first offence.

$1,000 and impoundment for 24 hours for the second, and subsequent, offence.

12500 VC. Driving Without a Valid License


Any person who operates a vehicle:

(1) without proper licensing or;

(2) with an expired license or;

(3) with a suspended license.

12951(a) VC. Failure to Show a Drivers License


Any Person who is driving on a public road or highway without the valid driver's license

23221 VC. Open Alcohol Container


Any person who possesses a visible and open container of alcohol or alcohol-infused
beverage in a vehicle, moving or not.

23221 VC is an infraction punishable by a fine not exceeding $2,000 on the first offense.

23152 VC. Driving Under the Influence


Any person who operates a motor vehicle while under the influence of alcohol with a blood
alcohol content higher than 0.08%.

23152(a) VC Driving Under the Influence of Drugs—Any person who operates a motor
vehicle while under the influence of any drug that might affect motor function, perception or
coordination.

23152 VC is an misdemeanor punishable by up to 6 months of imprisonment in county jail


and 7 day license suspension. A subsequent charge of 23152 VC within 90 days results in a
misdemeanor punishable by up to 6 months of imprisonment in county jail and 15 day
license suspension.

27151(a) VC. Use of Nitrous Oxide


Any person who operates a motor vehicle whilst in possession of nitrous oxide equipment
whereas their possession and use was not authorized by a governing body prior to the motor
vehicle's use on a controlled course, speedway, or race track.

27151(a) VC is a misdemeanor punishable by up to 6 months of imprisonment in county jail


and a fine not exceeding $2,000.

38025 VC. Operation of All-Terrain Vehicles (ATV's) on Streets / Highways


In accordance with subdivision (c) of Section 4000, a motor vehicle issued a plate or device
pursuant to Section 38160 may be operated or driven upon a highway but only as follows:

(a) On a two-lane highway, only to cross the highway at an angle of approximately 90


degrees to the direction of the roadway and at a place where a quick and safe crossing may
be made, or only when the roadway is not maintained by snow removal equipment and is
closed to motor vehicles that are subject to registration pursuant to Division 3 (commencing
with Section 4000), or only to cross a highway in the manner specified in subdivision (b).

30600 PC. Possession of an Assault Weapon


Any person who possesses a firearm that is classified as an assault weapon.

30600 PC is a felony punishable by up to 11 years of imprisonment in a state penitentiary.

29800 PC. Felon in Possession of a Firearm


Any person previously convicted of a felony relating to the misuse of firearms, violence or
crimes against the person in possession of a firearm.

29800 PC is a felony punishable by up to 10 to 15 years of imprisonment in a state


penitentiary.

18710 PC. Highly Dangerous Devices


Any person who possesses any manufactured or improvised device or equipment which is
made of explosive, highly flammable, gaseous, poisonous or toxic materials, that has the
potential to cause severe injury or harm to others, without appropriate permits.

18710 PC is a felony punishable by up to 10 years of imprisonment in a state penitentiary.

417 PC. Brandishing a Weapon


Any person who draws, exhibits, or uses a deadly weapon in a manner that is not self-
defense.

417 PC is a misdemeanor punishable by up to 6 months of imprisonment in a county jail.

417(f) PC. Brandishing a Firearm


Any person who draws, exhibits, or uses a firearm or deadly weapon in a manner that is not

Any person who discharges a firearm from a motor vehicle in an unlawful manner or
