Any cell phones or mobile phones, electronic telephone books, and the contents of their memory and digital messages received while in possession of this warrant, to be downloaded at a later time, ie., forensic processing of phone's memory. As set forth in this Affidavit, I, Deputy Hogan, your Affiant, am a Peace Officer in the State of Arizona, employed by the Pima County Sheriff's Department. [ have been a Police Officer for approximately 19 and a half years and have the following training and experience: [attended the Souther Arizona Law Enforcement Training Center Basic Academy, Pima County Sheriff's Advanced Basic, Pima County Sheriff's Detective training. Uh, Your Honor, I am investigating the crimes of homicide, attempted homicide, kidnapping and aggravated assault that I, which I believe to have been committed on today’s date, the 2"! day of February 2018, in Pima County, based upon the following reasons: Your Honor, uh, on today's date, February 2, 2018, at about 1603 hours, 4:03 p.m., the Pima County Sheriff's Department received a 911 call from a man who lives at an address, uh, in Corona de Tucson, the far southwest side of Tucson, uh, off of, ich is, uh, in the Corona de Tueson. He called 911 and said ita young male had just came over and knocked on his door, described the young male as about 18. Uh, the reportee says that the male came over and told him that his dad tried to kill him. Uh, he said that the young man, uh, had a la-, large amount of blood on him. and obvious injuries, including what appeared to be a severe head wound. The young man told him that he lives down the street and that his dad had attacked him and, uh, essentially, uh, hit him, uh, with some kind of object and tried to kill him, causing the male to flee and ask for help from this reportee, Your Honor. There they contacted| 3 birth ioe craft He’s the son, Your Honor. 4 @>« the son. He's 17 years old. When they walk up to him, he's at the reportee's 5 house. He’s clearly been injured, has, uh, what they described to be a severe blunt force 6 wound to his head. He also has sharp force trauma on his extremities, uh, has a lot of 7 blood on his clothing 8 Uh, he’s able to talk, however, and tell the following: Uh, he lives down the street, uh, 9 about from where he called 911 atgNorth Tomasita Drive. 10 That's the target, uh, location in this, uh, warrant, Your Honor. Uh, he was at school ul today and he got a, uh, a contact over the phone, believe to be a, uh, he says a phone call 12 from his dad, which was strange, to come home early. Uh, he did so. Drove home to his 3 house on Tomasita. When he artived, his dad met him outside, which, also, he said was 14 strange and was, essentially, talking to him outside, Uh, the son asked where, uh, mom 15 and daughter are. Mom lives there. Daughter lives there and she’s home schooled, so he 16 believe they should both be in the home. 7 Uh, dad, cu, said they were playing some kind of game inside and said that he needed his 18 son’s help to clean up. Uh, son said, to the Deputies as they walked in the front door, his 19 father reached down and grabbed something. He, uh, described it as possibly a hammer 20 oa tire iron or a piece of a jack stand. But, some type of object, uh, large metal object. 21 Uh, the dad began striking him on the head with this object, uh, as they walked into the 22 front door in the living room and attacked him. He said dad began to make quotes like, 2B just let me do what I need to do. Uh, I’m taking away your mom and sister and I need to 24 finish this, as he was attacking the 17 year old son. And the dad is, uh, is Her-, 25 Hemando, uh, Enriquez@> 26 He said he was fighting with father, fighting back. They went through the house and 7 eventually ended up in the kitchen. Uh, dad was striking him with the object. Uh, he 28 said that dad, ub, at one point, all, all of a sudden, in the kitchen, had a knife and began 29 stabbing and slashing the son as he was saying these, uh, phrases to him. The son said 30 they became very bloody and he was able to wriggle away and escape and run out the 31 door to where he went to the, uh, caller who called 911’s house, down the way. 32 Um, he did state that, uh, daughter, and, uh, his sister and his mother live there, It’s the 33 family home, the Enriquez, uh, residence, Your Honor. Uh, based on the clear attack, as 34 well as the, uh, two, uh, women that were still supposed to be in the house, Deputies went 35 to the Tomasita address. They began to knock on the door and announce. No one came 36 to the door. Uh, based on totality of the circumstances, they did force entry. They went 37 inside. They saw signs of a struggle, such as items on the ground like, lights, blood on 38 the ground, just inside the door. Uh, blood in other rooms, including the kitchen, all 39 consistent with the, the son’s story. Um, they saw a large amount of blood in the back 40 bedroom. They, bo-, both of the females bodies were essentially covered in blood. Uh, they had obvious sharp force trauma and what may be bblunt force trauma to the bodies. Uh, and, and it’s possible, they were moved into the, uu, tub, based on the, their, their observations of, I'll call the crime scene, Your Honor. ‘They were pronounced dead there on the scene. And at this point, appear to be the mother and daughter, uh, based on our descriptions, uh, from the son, who survived the incident. Dad was not in the house, Your Honor. Uh, they continued throughout the house, couldn't find him. They, uh, eventually went out the back door into a, we're in kind of a rural area, uh, it's maybe a quarter of an acre or so, towards some horse, uh, tra-, a horse trailer and some horse, uh, corrals. Uh, there’s a small wash and as they were walking that way, they saw a male laying on the ground, face down, with his hands undemeath him. It was immediate apparent that he was, uh, a adult male and he was covered in blood. Uk, they began to give him commands. He wouldn't, uh, essentially roll over or give them his hands. They, uh, used a taser, and eventually, were able to detain him. When they rolled him over, they found a, a kitchen knife. It’s about a six inches or longer type kitchen knife, uh, meat cutting knife, underneath him. Uh, he, this male in the wash has been positively identified as the father, uh, who’s listed as the target in this search warrant for physical characteristics, too. He said words to the effect of, the Deputies, uh, just go ahead and kill me., Uh, and essentially, just repeated that and kept mumbling, just go ahead and kill me. Just go ahead and kill me. Uh, the son’s at the hospital. He’s being treated, expected to survive and gave a more detailed statement to Detectives. He did state that recently, dad, uh, has been under the care of a doctor. He's had insomnia. And he’s been taking prescription medications, pos-, also, possibiy over the counter medication for sleep, as well as suffering from depression, recently. This relates to, uh, the physical characteristics, Your Honor, of a request for a blood draw on the father. Also, other evidence, Your Honor, relates to the phones, I'm asking to, uh, take any phones and download them. There’s a clear pattern here that he used the phone to lure the son in. Uh, essentially, get him home early from, uh, school and attack him. Uh, this leads to the fact that there will be evidence on the phones, as well as the possibility of, uh, text to, uh, other victims, uh, luring them home or photographs of the scene itself. Uh, farther, Your Honor, uh, regarding, um, uh, searching of the whole curtilage of property, Mr. Enriquez clearly fled the home. He was found out back on the rural property. He had time, in between the son fleeing and the police getting here, many minutes later, to hide any kind of evidence, such as other weapons used, whether they be sharp force or blunt force objects. Uh, we do not have a, uh, definitive murder weapon at this time, uh, other, but we do have the knife that was under him, covered in blood. Um, also, Your Honor, refer, regarding the medications, as I said, uh, the father has been taking over the counter and prescription meds, uh, uh, for sleep issues and depression, thus the request to seize any medication inside and the, the blood draw from the father. Um, also, Your Honor, I am going to ask, uh, for, uh, currently the time is 19, uh, 7:56 a., uh, p.m. I'm going to, uh, request to start the service of this search warrant here in the daytime, which is be-, prior to 10:00 p.m., the nighttime exception. But, I am going to request to continued into the nighttime, based on the severity of the crime, uh, the need to recover the evidence, the fact that the two bodies are still inside and the need to remove them from the home, which, uh, will clearly take time beyond, ub, finishing prior to 10:00 p.m., Your Honor, Um, let’s see here. Um, uh, based on the preceding facts, I, Deputy Hogan, request that a Telephonic Search Warrant to be issued.
