The creation of a Lodging Tax Special Revenue Fund will allow for greater transparency
within this new fund and the General Fund. The lodging tax revenue will still be recognized
as tax revenue, but it will no longer be combined with the tax revenue within the General
Fund, which is almost entirely property tax revenue.
This fund should not carry a fund balance as all funds received will be offset by expenditures
to both the CVB and the city's General Fund for the administration portion of the lodging tax
proceeds.
The 2018 budget did not account for this, so it is also appropriate that the lodging tax
revenues and the related expenditures of $370,000 be transferred from the General Fund to
the new Special Revenue Fund.

The AFG requires a monetary 10% match for fire departments serving populations between

RESOLUTION R2018-007
WHEREAS, the City of Shakopee supports the grant application made to FEMA
for Fire Assistance. The application is to obtain funding to purchase ten Self-Contained
Breathing Apparatus (SCBA), and
WHEREAS, the City of Shakopee recognizes the 10% match requirement for the
AFG and has secured the matching funds.
Adopted in adjourned regular session of the City Council of the City of Shakopee,

Quotes were solicited and opened on January 19, 2018. Four quotes were received and New
Look Contracting, Inc., from Rogers, Minnesota, is the low bidder in the amount of $99,820
(see attached quotation tabulation). New Look Contracting, Inc., has the capacity and
experience for the project and is deemed a responsible bidder. They are prepared to begin
work late winter with a completion of May 2018 .
Budget Impact:
The CIP identified a project budget of $100,000 for the Mill Pond Weir Project. The
awarded construction cost ($99,820) plus contingency, engineering, administration, and legal
costs (estimated $35,000) combine for a total project budget of $134,820, which is 34.8
percent over the CIP budget.
While the project is over budget from the original underestimation, the bids accurately reflect
the work needed to repair the failed weir.
Project funding is from the Storm Drainage Fund. There is adequate reserve in the Storm

The city has partnered with the CAPS digital design program since 2015. The students have
provided the city with top-notch graphic design, including Clean Up Day flyers, Huber Park
Performance series marketing and more. This spring semester, we’re hosting two interns, one
in communications and one in Parks and Recreation. Each works at the city two hours a day,
four days a week.
In November, the city partnered with the program on two specific projects: rebranding
Shakopee Government TV and the Enigma Teen Center. As part of the Shakopee
Government TV project, Leo Lickford and Bradley Vilaychack created a new logo, on-
screen graphics and meeting open video. Amy Nguyen and Isabel Roberts worked with the
Enigma Teen Center users to develop a new logo and brand.
The students will present their projects, as well as discuss their learnings from the experience.

When the police department received the application forms they found that he did not
disclose a DWI from 1985 on his application. The policy is that his application would be
denied for this omission.
Administrative staff believes that he disclosed this information on his original application
which allowed him to work in our community for the past nine and half years. However, his
original application was not located.

Discussion:
Beacon Construction, Inc. made application for an Appeal of the Board of Adjustment and
Appeals’ (BOAA) determination of a Conditional Use Permit request to allow exterior
storage at 290 Sarazin Street.
The BOAA reviewed the CUP request at their January 4th meeting, and approved
Resolution No. PC17-060, with conditions. (see attached CUP Resolution). This resolution
would allow exterior storage of vehicles and lifts in an area north of the recently constructed
building located on a 5.4-acre site at the northwest corner of 4th Avenue and Sarazin Street.
This storage area, as conditioned by the BOAA, would be enclosed by an 8’ chain link fence
with a fabric covering for screening purposes and coniferous trees, and surfaced with either
asphalt and/or concrete.
The Board, in making their decision, referred to the Criteria for granting conditional use
permits (Section 151.011) of the City Code. Those Criteria and Findings are as follows:

Criteria #1 The use will not be injurious to the use and enjoyment of other property in the
immediate vicinity for the purposes already permitted, nor substantially diminish and impair
property values within the immediate vicinity;
Finding #1 Staff has received no evidence that the exterior storage area will be injurious to
the use and enjoyment of other property in the immediate vicinity, nor would it substantially
diminish or impair property values in the area, provided the conditions of the resolution are
met.
Criteria #2 The establishment of the conditional use permit will not impede the normal and
orderly development and improvement of surrounding vacant property for uses allowed in the
area;
Finding #2 The conditional use permit, as proposed, will not impede future development and
improvement in the area, provided the conditions of the resolution are met.
Criteria #3 Adequate utilities, access roads, drainage and other necessary facilities have
been or will be provided;
Finding #3 Adequate utilities, access roads and drainage are provided or will be provided at
the site.
Criteria #4 The use is consistent with the purposes of the zone in which the applicant
intends to locate the proposed use; and
Finding #4 The use of the subject property is consistent with the purposes of the Light
Industry (I-1) Zone.
The Board questioned staff and the applicant/property owner on a number of topics,
including the following:
a. What feedback had staff received from neighboring property owners.
b. The nature of the types of vehicles and equipment to be stored on site, with the Board
expressing concerns about dust generation, site maintenance and leaking fluids from the
vehicles.
c. Frequency of movement of equipment and vehicles (daily and/or weekly).
d. What type of surface does the business have at their existing site.
Staff responded that residential property owners south of this site expressed concerns with

the visual appearance of the vehicles and lifts in the storage area. The applicant stated that
there would be a limited number of cube vans, pick ups with ladder racks, semi truck-type
cabs, and scissor lifts stored or located within this storage area. The applicant stated that
some of the lifts and vehicles would move on a daily basis, and some would be moved on a
monthly basis, and that their current site is paved with asphalt.
The Board spent a considerable amount of time discussing the applicants concerns, including
discussing phasing the paving requirement and phasing the build out of the storage area
before reaching their decision, which was a 6-1 vote to approve Resolution No. PC17-060, a
resolution approving the Conditional Use Permit with 10 conditions of approval.

WHEREAS, Loren Kjersten, Beacon Construction Inc.; on behalf of Larson Development 101 LLC,
applied for a Conditional Use Permit for Exterior Storage at 290 Sarazin Street on November 13, 2017; and
WHEREAS, The property located at 290 Sarazin Street is zoned Light Industry (I-1) which lists
Exterior Storage as a conditional use; and
WHEREAS, On January 4, 2018 the Board of Adjustment and Appeals held a public hearing and
approved the Conditional Use Permit for Exterior Storage, subject to 10 conditions as represented in
Resolution No. 17-060; and
WHEREAS, City Code Section 151.016, Subd. B allows for an appeal to the City Council of the
Board of Adjustment and Appeals decision within 10 days of the Board’s decision; and
WHEREAS, Mr. Kjersten, on behalf of Larson Development 101 LLC, filed an appeal within the
allotted time, specifically noting objections to certain conditions imposed by Resolution No. PC17-060; as
follows:
Condition #4 of the approved CUP: “An additional mix of 6’ tall (min.) Black Hills Spruce, Red Cedar
and Eastern White Pine coniferous trees spaced 20 feet apart shall be installed along the north, east and west
sides of the storage area for off site screening purposes”; and
Condition #8 of the approved CUP: “The exterior storage areas shall be surfaced entirely with asphalt
or concrete”; and
WHEREAS, the City Council heard the appeal at its meeting on February 7, 2018; and
WHEREAS, the City Council has reviewed the materials related to the Conditional Use Permit and
appeal.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Shakopee adopts
the following findings of facts and conclusion relative to this matter:
FINDINGS
1. The Board received no evidence that the exterior storage area will be injurious to the use and
enjoyment of other property in the immediate vicinity, nor would it substantially diminish or
impair property values in the area, provided the conditions of Resolution No. PC17-060 are met.

2. The conditional use permit, as proposed, will not impede future development and improvement
in the area, provided the conditions of Resolution No. PC17-060 are met.
3. The letter from the appellant’s legal counsel references that trees planted on the property to the
west would provide additional visual barrier between the outdoor storage area and the residential
property; where there is no guarantee that property owner will preserve those trees in perpetuity.
4. The letter from the appellant’s legal counsel references the existence of outdoor storage on
adjacent properties with no additional landscape screening; where that outdoor storage located
on those properties is legally nonconforming as it has existed since 1970 (property to the north)
and 1980 (property to the west).
5. The letter from the appellant’s legal counsel notes that outdoor storage is allowed on adjacent
properties in areas that are not paved with asphalt or concrete; where the property in question
(Shakopee Public Utilities) has outdoor storage areas predominately paved with concrete, with a
small class 5 storage area for materials setback approximately 50 feet from the adjacent property
(whereas the appellant proposes a storage area for vehicles approximately 10 feet from the
adjacent property).
CONCLUSIONS
1. The Board of Adjustment and Appeals have the authority to provide conditions in approving a
Conditional Use Permit to ensure compliance with the Criteria established within Section
151.011 of the City Code (“In granting a conditional use permit, the Board of Adjustment and
Appeals shall consider the effect of the proposed use upon the health, safety, and general welfare
of the occupants of surrounding lands and the city as a whole”).
2. The Board of Adjustment and Appeals decision regarding additional landscaping was to address
adjacent residential property owners concerns with stored vehicles and lifts being visible above
the proposed 8’ tall fence.
3. The Board of Adjustment and Appeals decision regarding paving of the parking lot was based on
concerns with dust generated from the vehicles, concerns with class 5 material being difficult to
maintain in the winter and early spring seasons, and environmental concerns regarding fluids
leaking from the vehicles and lifts located within the exterior storage area.
BE IT FURTHER RESOLVED, that the appeal of the Board of Adjustment and Appeals Approval
of Resolution No. PC17-060 is denied and that the Board’s decision is affirmed in all respects.
BE IT FURTHER RESOLVED, that the findings adopted by the Board of Adjustment and Appeals
are incorporated by reference into this Resolution.

Site
WHEREAS, Beacon Construction, Inc., applicant, and Larson Development 101 LLC,
property owner, have filed an application received November 16, 2017, for a Conditional Use Permit
to allow exterior storage under the provisions of Chapter 151, Land Use Regulation (Zoning), of the
Shakopee City Code, Section 151.014, Subd. (B) (7); and
WHEREAS, this parcel is presently zoned Light Industry (I-1) Zone; and
WHEREAS, the property upon which the request is being made is legally described as;
WHEREAS, notice was provided and on January 4, 2018, the Board of Adjustment and
Appeals conducted a public hearing regarding this application, at which it heard from the Community
Development Director and invited members of the public to comment.

Finding #5 The use is not in conflict with the Comprehensive Plan, which guides this
property for industrial uses.
BE IT FURTHER RESOLVED, that the application for Conditional Use Permit No. PC17-
060 is hereby GRANTED, subject to the following conditions:
1. Exterior storage shall be allowed consistent with submitted plans (dated 09/11/17), provided
the required fencing/screening is installed consistent with City Code standards [exterior storage
areas shall be screened from all public right-of-way and residentially-zoned land with a
predominantly opaque fence, wall, and/or berm not to exceed eight (8) feet in height,
constructed of new materials, and maintained in good condition], and/or as directed by the
conditions incorporated into this Resolution.
2. Storage equipment/materials shall not exceed the height of the screening fence
(registered/operable vehicles may extend above the fencing). Lifts shall be stored in a lowered
state.
3. The applicant shall submit a fence permit prior to construction of any fencing. This fence shall
not exceed eight (8) feet in height, shall include predominantly opaque privacy screening fabric
secured on the side facing adjacent properties, and shall not include barbed-wire.
4. Any landscaping removed from within the storage area shall be replaced with new trees of
comparable caliper inches (aggregate)around the perimeter of the storage area. An additional
mix of 6’ tall (min.) Black Hills Spruce, Red Cedar and Eastern White Pine coniferous trees
spaced 20 feet apart shall be installed along the north, east and west sides of the storage area
for off site screening purposes.
5. If a secured gate is added at any point between the Sarazin Street access and the east
elevation (Fire Department connection and fire hydrant), the applicant shall obtain an
additional Fire Department keybox and it shall be mounted at the secured gate.
6. Outside storage of combustible materials shall not be located within 10 feet of property lines
and the maximum height of storage, except for vehicles, shall not exceed eight (8) feet in
height. If the storage height is 6 feet or less, then the separation from the lot line can be
reduced to 3 feet.
7. The exterior storage area shall have a maximum area equal to the combined footprint of the
principal and accessory buildings.
8. The exterior storage areas shall be surfaced entirely with asphalt or concrete.
9. The exterior storage area shall not be located closer than 300 feet to any residential zone.
10. No businesses may store any vehicles which are unlicensed or inoperative for more than 7
days.

Memorandum
SUBJECT: Conditional Use Permit for Exterior Storage in the Light Industry Zone.
Site Information
Applicant: Beacon Construction, Inc.
Property Owner: Larson Development 101 LLC
Location: 290 Sarazin Street
Current Zoning: Light Industry (I-1) Zone
Introduction
Beacon Construction, Inc. made application for a Conditional Use Permit to allow exterior storage,
as part of a recently constructed building located at the northwest corner of 4th Avenue and Sarazin
Street. Attached are the applicant’s site, elevation, and landscaping plans for this project. Note the
highlighted area on the site plan, which identifies the proposed exterior storage area. This area will
be enclosed by an 8’ chain link fence, with a fabric covering for screening purposes. This storage
area will be used for vehicles and lifts; no materials.
The 28,000 sq. ft. building is larger than this proposed storage area, which would be located on the
north side of the building. The area of new exterior storage will be approx. 18,000 sq. ft. This
storage area is required to be screened from view from adjacent right-of-ways and residential
properties. The City Code standards also state that the maximum area for storage shall not exceed
the footprint of the building. It is proposed to be surfaced with class five (5) aggregate, and is not
located adjacent to residential zoned property.
Planning staff did receive comments from the Fire Dept., with comments incorporated into the draft
resolution.

City Code Section 151.014, Subd. (B) (7) provides guidelines for development of this property, of
which a number are listed as conditions of approval in the draft resolution. Should this CUP request
be approved, a building permit for the fence will need to be submitted for review and approval.

WHEREAS, the City of Shakopee, Minnesota (the “City”) and the Economic Development
Authority for the City of Shakopee, Minnesota (the “Authority”) intend to establish Tax Increment
Financing District No. 18 (the “TIF District”) within the Minnesota River Valley Housing and
Development Project No. 1 (the “Project”) pursuant to Minnesota Statutes, Sections 469.174
through 469.1794, as amended (the “TIF Act”), and will adopt a Tax Increment Financing Plan for
the purpose of financing certain improvements within the Project; and
WHEREAS, the Authority has determined to pay for certain administrative costs related to
the proposed TIF District (the “Qualified Costs”), which costs may be financed on a temporary
basis from City or Authority funds available for such purposes; and
WHEREAS, under Section 469.178, subdivision 7 of the TIF Act, the City is authorized to
advance or loan money from the City’s general fund or any other fund from which such advances
may be legally authorized in order to finance the Qualified Costs; and
WHEREAS, the City will loan funds from its Capital Improvement Fund, or any other fund
designated by the City, to the Authority to finance the Qualified Costs (the “Interfund Loan”) in
accordance with the terms of this resolution;
1. The City hereby authorizes the advance of up to $300,000 from the Capital
Improvement Fund, or from any other fund designated by the City, or so much thereof as may be
paid as Qualified Costs, contingent upon the approval of the Interfund Loan by the Board of
Commissioners of the Authority. The terms of the Interfund Loan shall be those set forth in the
resolution to be adopted by the Board of Commissioners of the Authority on the date hereof.
2. The Interfund Loan is repayable solely from and to the extent that Available Tax
Increment is available. “Available Tax Increment” means, on each Payment Date (as defined
herein), all of the tax increment generated in the preceding six (6) months with respect to the
property within the TIF District and remitted to the Authority by Scott County, Minnesota, all in
accordance with the TIF Act. Payments on the Interfund Loan are on parity with any outstanding or
future interfund loans secured in whole or in part with Available Tax Increment.

3. Provided that there is Available Tax Increment to repay the Interfund Loan to the
City, principal and interest (“Payments”) on the Interfund Loan shall be paid semiannually on
February 1 and August 1 (each a “Payment Date”), commencing on the first Payment Date after the
advance of the Interfund Loan. Payments shall continue until the earlier of (a) the date the principal
and accrued interest of the Interfund Loan is paid in full, or (b) the date of last receipt of tax
increment from the TIF District. Payments on the Interfund Loan will be made in the amount and
only to the extent of Available Tax Increment. Payments shall be applied first to accrued interest,
and then to unpaid principal.
4. The City may at any time determine to forgive the outstanding principal amount and
accrued interest on the Interfund Loan to the extent permissible under law.
5. The City may from time to time amend the terms of this resolution, including
amendments to the terms of and the Interfund Loan entered into under this resolution. However, the

actions are consistent with the terms for the Interfund Loan described in this resolution.
