Dear Mr. Maxwell,
Pursuant to Section 31.006 of the Texas Election Code, I respectfully request your assistance in
reviewing allegations of criminal activity in the Dallas County Republican Party primary
election.
‘The attached complaint from Mr. Stephen Stanley alleges that Mr. Justin Koch offered to pay
‘Mr. Stanley’s campaign debts if Mr. Stanley dropped out of the County Commissioner race.
The conduct described in the complaint constitutes reasonable cause to suspect a violation of
Texas Penal Code 36.02. Section 36.02 prohibits offering any benefit to a public servant as
consideration for that servant’s decision or exercise of discretion. The Penal Code in section
1.07(41) defines public servant to include candidates for public office.
‘A violation of section 36.02 of the Texas Penal Code is a second degree felony.
‘After review of the submitted documentation, we believe the information provided warrants
submission for criminal investigation to the Texas Attorney General, as the specific allegations
described involve a potential felony offense. Accordingly, under Section 31.006 of the Code, we
are forwarding this complaint to the Attorney General for investigation.
We note that under Texas Election Code 31.006, election complaints submitted to our office are
not public information until such time as our office has decided not to refer the matter to your
office or your office has completed their investigation. Accordingly, this matter remains
confidential pending the completion of your office’s investigation or decision not to investigate
the matter further.
