AFFIDAVIT OF UNDERTAKING

I, KEVIN BENNETT C. ESTERO, of legal age, single, Filipino and a resident of Mission Viejo,
Brgy. Mandalagan, Bacolod City, Philippines, after being sworn in accordance with law, do hereby
depose and state that:

1. I am a driver of a vehicle more specifically known as Isuzu Crosswind Sportivo with plate
no. FFS 673;

2. I am the holder of a NPDL No. FOI-10-005442 issued by LTO Bacolod City and valid until
October 2018;

3. On February 15, 2018 at around 5 o’clock in the morning, while travelling from east of Buri
Road, Brgy. Mandalagan, Bacolod City, I saw a cart ahead of me towed by a carabao. I
swerved to the left and ran over the concrete gutter / sidewalk and landed in a vacant lot
full of water while trying to avoid hitting the said cart. Attached herewith is a copy of the
Incident Report Form with IRF Entry No. PS3-4997;

4. The said incident was beyond my control after exercising extraordinary care and diligence
to safety;

5. The same extraordinary care and diligence was exercised when I took control of the
situation by immediate applying brakes and preventing more fatal vehicular accident;

6. I execute this affidavit of undertaking to attest to the veracity of the foregoing facts stated
herein and for whatever legal purposes it may serve.
