ORDER OF COMMITMENT

Pending before the Court is the Government’s Motion for an Order of

Commitment. The Bureau of Prisons provided to the Court a Psychological Evaluation

report by Dr. Lisa Bellah of Defendant Erlyndon J. Lo. The Court, being advised of all

the pertinent facts, and based on Dr. Bellah’s report, finds by a preponderance of the

evidence that Defendant Lo is presently suffering from a mental disease or defect

rendering him mentally incompetent to the extent that he is unable to understand the

nature and consequences of the proceedings against him and to assist in his own defense.

It is hereby ORDERED, that according to Title 18, United States Code, Section

4241(d), Defendant Lo is committed to the custody of the Attorney General for

hospitalization and for treatment in a suitable facility for such a reasonable period of time,

not to exceed one-hundred and twenty (120) days, as is necessary to determine whether

there is a substantial probability that in the foreseeable future he will attain the capacity to

permit the trial to proceed. The commitment shall continue for any additional reasonable

time until Defendant Lo’s condition is so improved that his trial may proceed or until

pending charges against him are disposed of according to law, whichever is earlier.

It is further ORDERED that the director of the facility in which Defendant Lo is

hospitalized according to this Order shall prepare and file a report no later than one

hundred twenty days after commitment containing his recommendations concerning the

need for Defendant Lo’s continued hospitalization. The director shall submit the report to

this Court for distribution to the parties.

It is further ORDERED that the Attorney General shall designate the facility in

which Defendant Lo will be placed and that facility shall be the best available to

rehabilitate and treat his mental condition.

The director of the facility shall also take all reasonable steps to attempt to

determine if Defendant Lo was sane at the time of the events which are the subject of the

indictment against him.
