COMPLAINT-AFFIDAVIT
2. That Mr. Ochinang, Mr. Estacion and Mr. Alcaide are my tenants

on the 3 floor of Edge 55 Apartment.
4. That Mr. Ochinang, Mr. Estacion, Mr. Alcaide and I had an oral
agreement that they will pay monthly rental fee amounting to five thousand
pesos (₱ 5,000.00).
5. That on September 18, 2017 until December 18, 2017 the tenants
failed to pay their rental fee for three consecutive months amounting to fifteen
thousand pesos (₱ 15,000.00).
7. That on January 21, 2018, the tenants did not vacate the unit and
did not pay their unsettled rental fees.

10. That Section 9 of Republic Act No. 9653 known as the “Rental
Control Act of 2009” states that:

Arrears in payment of rent for a total of three (3) months: Provided,
That in the case of refusal by the lessor to accept payment of the rent agreed
upon, the lessee may either deposit, by way of consignation, the amount in
court, or with the city or municipal treasurer, as the case may be, or barangay
chairman, or in a bank in the name of and with notice to the lessor, within one
(1) month after the refusal of the lessor to accept payment.
