1 Mr. Naseer Ahmad and Mr. Shaukat Ali, Superintendent (BS-16), PPSC has
stated vide (PUC-1&2/C) that they have been neglected/discriminated regarding promotion
of Assistant Director (BS-17) in recent Departmental Promotional Committee meeting held
on 18-04-2014, despite of fact that they have clean service record. They also stated that
their colleagues namely Syed Muzaffar Hussain and Mr. Ijaz Naseem were promoted to the
said post, which were junior to petitioners according to Seniority List. Service record &
seniority has been totally ignored by Authority in subject matter which is astonishing.
2 They also referred promotions of Mr. Abdul Majeed and Zia Haider Zaidi,
which was promoted as Deputy Director (BS-17) in DPC held on 09-02-2013, that was
according to seniority on the basis of seniority cum fitness rules.

2. The following Private Secretaries of the PPSC have also filed a Writ
Petition No. 6238/2011 for grant of BS-17 and grant of BS-18 to them after seven
years service as granted to their seniors. The writ petition was decided in favour
of the petitioner. They also filed a Criminal Original No. 1707-W/2012 in Writ
Petition No. 6238/2011 & CM No. 2655/20122. In compliance of court’s order, the
Secretary (I&C), S&GAD vide order No. CAB-I/4-2/2009(P) dated 08-01-2013 has
provisionally upgraded the posts of following Private Secretaries from BS-16 to
BS-17 held by the following incumbents with effect from the date they joined the
posts of Private Secretaries in the Punjab Public Service Commission:-

In response to this office letter dated 09-03-2013, the above mentioned
former officers of Punjab Public Service Commission have stated followings submissions
with the request to take a lenient view in their cases:-
(a) It is submitted for kind information that Rules 8(2)(3) & (5) of Punjab Civil
Servant Rules, 1974 is applicable in promotion cases only. Since the case of
the petitioner is of up-gradation, therefore, these rules are not at all
applicable/relevant in their case.
(b) It is also submitted that in the first instance, posts of 11 Private Secretaries
of the Commission were upgraded in compliance with the orders of the
Supreme Court of Pakistan.
(c) Similarly posts of 2 Private Secretaries have also been upgraded with the
orders of the Lahore High Court, Lahore vide W. P. No. 8451/2009.
(d) Recently, the Lahore High Court, Lahore is kind enough to allow
upgradation of some of the posts of the Private Secretaries of Commission,
exactly inline with the above referred precedents.
(e) Your kind honour would reveal that the case of the petitioner is also of
upgradation and not of promotion, which is an identical in nature to the
cases of the above mentioned Private Secretaries of the Commission, whose
posts have since been upgraded.
(f) As all the Private Secretaries are of the same department having equal status,
therefore, the petitioner deserves the same privileges and liabilities.\

4-2/93-II dated 29-12-1997 (Annexure-A) had authorized Chairman, Punjab Public Service
Commission to modify/change the nomenclature of a post. This permission was within the
framework of the Punjab Delegation of Financial Powers Rules, 1990 and Re-appropriation
Rules, 1963.
2. Now that the Punjab Delegation of Financial Powers Rules, 2006 have
become operative, apparently Chairman, Punjab Public Service Commission does not enjoy
this jurisdiction as mentioned in Para-01 ante.
5. You are, therefore, requested to take up our request with the Finance
Department to re-designate the post of Senior Psychologist (BS-19) as Chief Psychologist

made a representation at Page-292/Cor. (PUC) and requested that the letter moved to the
Regulation Wing, S&GAD to abolish the Private Secretaries promotion quota against the
posts of Deputy Directors may be withdrawn and the vacant posts of Deputy Directors
reserved for Private Secretaries (holding BS-17) may be filled to an early date.
The Service Rules for the post of Deputy Director/Deputy Secretary (BS-
If no suitable person from amongst both the above categories is available for
promotion then by transfer.
PPSC under the Chairmanship of Mr. Shahzad Hassan Pervez, former Chairman was held
on 21-03-2009 (Minutes at Page-294/Cor.). The DPC observed that the existing Service
Rules regarding quota of Private Secretaries (20%) for promotion has become redundant
after up gradation of eleven posts of Private Sectaries to BS-17 and grant of BS-18 to them
after seven years service by the Finance Department in compliance of orders of Supreme
Court of Pakistan. The DPC directed that relevant Services Rules may be got reframed as
Private Secretaries BS-18 cannot be promoted to the lower post of Deputy Director
(BS-17).
It is further submitted that the post of Private Secretary has been upgraded
from BS-16 to BS-17 vide circular letter dated 12-02-2013 at Page- 296/Cor.
In the light of above mentioned orders, it has been observed that the existing
service rules in the matter have become redundant as the senior most Private Secretaries of
BS-17 and BS-18 cannot be promoted to the same/lower post of Deputy Director (BS-17).

The worthy Chairman, PPSC vide Para-192 (Page-31) has referred the case
for analysis to Mr. Arshad Bin Ahmad and Mr. Muhammad Ilyas, Members, PPSC for the
(20% Quota). After examining all the aspects of the issue; it was decided vide Para-202(ii)
(Page-32) that two posts of Deputy Directors against promotion quota of Private
Secretaries in the functional unit may be referred to the Regulation wing of S&GAD for
reframing the service rules as the senior most Private Secretaries being already in BS-18
(PUC), the Commission has not yet sent any letter to Regulation wing for amended in
service rules to abolish the quota of Private Secretaries against promotion of the posts of
Deputy Director’s.

Subject:- AGE RELAXATION AND QUOTA FOR CERTAIN
COMMUNITIES/REGIONS
It is submitted that the Government of the Punjab has granted following type
of age relaxation:-
(a) In the case of a disabled person the maximum upper age limit prescribed in
the Service/Recruitment Rules, for appointment to a post, shall be raised by
10 years (Page-267).
(e) In the case of the candidates from schedule castes and under developed
areas, for a period of 20 years from the commencement day of the
Constitution of the Islamic Republic of Pakistan the upper age limit shall be
relaxed by three years (this provision had been become redundant since
1993) (Page-266).
The Government of the Punjab vide circular letter bearing No. SOR-
IV(S&GAD)10-6/2013, dated 19-06-2012 at Page-263 has provided the following quotas
for appointment through different notifications:-
(f) 15% quota for women as prescribed vide Notification No. SOR-IV
(S&GAD)15-1/2012, dated 21-05-2012.
(h) 20% quota of posts in the cadre of Junior Clerk, Patwari, Driver, Baildar,

(1) It is submitted that the Government of the Punjab has pleased to grant Special
Allowance @ 20% of Basic pay to the employees of Civil Secretariat Punjab

this allowance. The same allowance was granted in the past with name of
Secretariat Allowance which was also given to the employees of Punjab Public
Service Commission until it was break off in 1994. The Finance Department

Thousand only) vide order No. CAB-I/4-3/2010 dated 19 th May, 2010 in
anticipation of provision of funds through Supplementary Grand during the

Subject: FRAMING OF SERVICE RULES FOR THE NEWLY CREATED I.T.
POSTS IN PPSC
It is submitted that I alongwith Maj (R) Rana Waqar, Security Officer and
Mr. Imdad Ali, Protocol Officer visited Information Technology Park to explore the
possibility of shifting of offices of PPSC, Head Office to the above mentioned Park.
Engineer Syed Akmal Hussain Gilani, Project Director of I.T. Park, after detailed
discussion, offered to handover12th floor of the I.T. Park to PPSC. The 12th floor of the I.
T Park is still under construction. Only initial structure of the said floor has been completed.
The total covered area of the floor is approx 11000 square feet. The Project Director
further told the undersigned that the PPSC would have to make further construction at its
own. Wall ceiling, flouring, partition and finishing have to be done by the PPSC itself.
Approximately, an amount of 200 to 250 million rupees will be required for the said
purpose.

In the enclosed letter dated 04-09-08 at Page-338, the meeting with DFID
Technical Assistance Management Agency (TAMA) inspection team on 05-08-2008
presided over by Mr. Humayon Farshori, Member PPSC has been referred and has been
requested to arrange another meeting to discuss the contents of Project Concepts Note.
Deputy Program Director has requested that the concurrence of the PPSC
may reach the Program Management Unit (PRMP) initiate the hiring process thereafter.

The Finance Department was approached to inquire about the latest position
regarding Writ Petition No. 10293/2006 filed by the Drivers and Dispatch Riders of PPSC
for grant of overtime allowance to all the Drivers and Dispatch Riders. The writ petition has
been accepted by the Lahore High Court, Lahore. Representative of Finance Department
has told that the Department is considering to approach the Supreme Court of Pakistan
against the decision.
As per comments of Director Legal vide Para-41/N, relief in the said writ
has been sought from the Finance Department. If approved, the representation of Drivers
may be forwarded to the Finance Department for further necessary action on its part. Draft

Subject: CIVIL PETITION NO.995-L OF 2008 FILED BY PROVINCE OF
PUNJAB VS SAMEUL BHATTI, ETC.
The subject case is fixed on 30-12-2008 for hearing in the Supreme Court of
Pakistan vide notice at page-91/C. Director Legal may be requested to attend the court
accordingly.
The Dy. Secretary (Services) vide letter dated 12-04-2008 at P.U.C (Page-
45) has requested to provide a consolidated list of existing contractual employees working
in Administrative Departments, Attached Department, Autonomous Bodies and District
Governments, containing their names, designation, basic pay scales, period of contract and
appointing authority, in the following categories.
The borrower, Mr. Shabbir Ahmad, Naib Qasid was granted 730 days leave
of the following kind:-
Accordingly his salary was drawn manually and outstanding amount was
deposited into the N.B.P Bank account after receipt of this letter.
However, contents of this letter are totally contradictory to the letter written
by the Central Region Lahore dated 29-06-2007 at page 82. As per ‘A’ of that letter:-
“in view of the above, you are requested to please assure concern D.D.O. that he is
not responsible in case of default by the borrower”.
In the light of the said letter of Central Region, Lahore, the Manager N.B.P

Public Service Commission and has created the requested posts vide advice dated
15-05-2007. It is evident from the advice that Finance Department has created these posts
to make up the deficiency of supervisory staff and to meet the increased workload in the
Punjab Public Service Commission.
Despite the clear advice of the Finance Department, Audit Copy has not
been got issued by the S & GA Department by interlinking this issue with the upgradation of
the posts of Directors and Deputy Directors. Moreover, the Section Officer (Cab-I), Govt.
of the Punjab has raised objection against the post of Assistant Director, keeping in view the
fact that the post of Deputy Directors/Deputy Secretary are also in BS-17 and being filled in

It is humbly prayed to your honour to personally look into the matter and
this Audit Copy may be got issued with the change of nomenclature of the post of Assistant
Director into Deputy Director. This act of kindness will not only give a great incentive of
promotion of almost 50 low grades employees but also simplify the Promotion/
Appointment against these posts as Service Rules for the post of Deputy Director has
already been framed. We, Superintendents of the Commission, hereby undertake that if the
post of Deputy Director is upgraded to BS-18 at any stage, will not create any problem and
will accept the nomenclature of the post what so ever it will be. This undertaking can be
reflected in the orders at the time of promotion of a Superintendent to the post of Deputy
Director.

Subject: VISIT OF STUDENTS
He has also requested to Secretary /Focal Person, PPSC to arrange for next
meeting during the 1st week of March, 2008 at Lahore. The Agenda items from all
Commissions will be invited for finalization/circulation in due course by the Federal Public
Service Commission.

week of March, 2008 to hold Inter Public Service Commissions Meeting.
Subject: CONDUCTING OF FORTHCOMING GENERAL ELECTIONS-2008
AD. L.G & C.D vide P.U.C. at page-1/C has requested to provide list of
staff of PPSC to forwarded the Provincial Election Commission, Punjab for appointment as
polling personnel and for proper training in this respect well before the time of forthcoming
General Elections-2008.
It is submitted that due to busy schedule of interviews and tests, the staff of
the Commission will not be in a position to perform the election duty. Moreover, no
precedent is available in the past for performing of Election duty by the PPSC staff.
Deputy Director (Legal), PPSC has informed that the subject case is fixed on
28-11-2007 for hearing in the court (Lahore High Court, Lahore). Deputy Director Legal
may be requested to attend the court accordingly.
Govt. of the Punjab vide P.U.C. at page 2/C has amended the Punjab
Government Rules of Business, 1974 as per detail given below:-
The District Officer, vide P.U.C at page-36/C has requested to approach the
S&GAD or District Coordination Officer in case of District Government.
The present building was hired on 01-07-2004 for PPSC Regional Office,
Rawalpindi with a monthly rent of Rs.50,000/- initially for a period of three years w.e.f. 01-
07-2004 to 30-06-2007 vide tenancy agreement at page-2/C. The rent was subject to
increase at the rate of 25% after three years which comes to Rs.62500/- after expiry of three
years period. The landlady did not agreed to extend the tenancy agreement at the pervious
terms and conditions and insisted to increase annual rent @ 8.3% per annum in the revised
agreement.
At present, the PPSC Library has been provided with an internal telephone
connection through exchange which often remains either busy or faulty and creates
problems to cope with the task given by Members, PPSC on urgent basis. On the other
hand, if the required number is busy it becomes difficult to get the line free each time.
System Analyst may be requested to deputed Mr. Faisal Munir, Data Entry
Operator who has already helped the Establishment Branch in the matter, for guidance and
training of the related staff of Establishment Branch.
Subject: TENANCY AGREEMENT IN RESPECT OF PPSC, REGIONAL
OFFICE, RAWALPINDI.
49. A reference was made to the Finance Department to seek advice whether
PPSC could enter into tenancy agreement with the landlady of office building of Regional
office, Rawalpindi who had been insisting to increase annual rent @ 8.3 % per annum
instead of increase of 25 % after three years vide letter dated 26-09-2007 at Page-15/C.
50. Section Officer (Cab-I) vide letter dated 01-11-2007 (PUC) at page119/C
has forwarded the advice of Finance Department in this regard. As per advice, Finance
Department has no objection if the PPSC enter into agreement with the owner of the
building hired for PPSC, Regional office, Rawalpindi by substituting clause (2) of tenancy
agreement that rent would be increased @ 8.3 % per annum instead of 25% increase after
three years.
51. If approved, we may forward the advice to the Incharge, Regional Office,
Rawalpindi for further necessary action at his end.

It is, therefore, proposed that the case for creation of Secret Branch ‘C’ may
be kept pending for the time being.
Subject: EXTENSION IN RECRUITMENT PROCESS UNDER PAHSE-III
It is submitted that PPSC has been allowed to fill up 26 posts vide page-
312/C under Phase-III. As a result of it, PPSC advertised the following post on 20-08-2007
with closing date on 29-08-2007:-

4. Driver 01

Out of the above posts the Commission has been able to fill up one post of
Driver and one post of Data Entry Operator. Interview for the post of Naib Qasid has been
completed. Test has also been conducted for the Posts of Stenographers and Junior Clerks
and interviews are to be completed in the month of November, 2007.
A request was made to the Section Officer (Cab-I) for issuance of Audit
copy in respect of creation of six posts of Assistant Directors and one post of Assistant
Director (Research) in the PPSC.
The present building was hired on 01-07-2004 for PPSC, Regional Office
Rawalpindi with a monthly rent of Rs.50,000/- per month initially for a period of three years
w.e.f. 01-07-2004 to 30-06-2007. As per terms and conditions of tenancy agreement, the
rent was subject to increase at the rate of 25% after three years. This tenancy agreement has
been expired on 30-06-2007. The land lady has not agreed to extend the tenancy agreement
on the previous terms and conditions and insisting to increase annual rent earlier @ 8.3%
and now @ 10% in the next agreement instead of increase of 25% after three years.
The office has approached the Finance Department for advice whether PPSC
can revise the tenancy agreement on the term of the land lady. Reply of the Finance

A question has arisen that where a deceased civil servant had more than one
wife and the family does not agree on the point as to which of the two wives of their
children are to be considered for appointment under the said rule.

In this regard, it is submitted that Finance Department has regretted the case
of System Analyst. The case for installation of official residential telephone at the residence
of Deputy Secretary was sent to Finance Department for the first time.
Educational Consultant FPSC, vide P.U.C., has informed that the Chairman,
Punjab Public Service Commission has consented to host the next meeting of Inter Public
Service Commission in February/March, 2008 at Lahore.

366. The Section Officer (Cabinet – I), S&GAD vide letter dated 15 th June, 2007
at Page-203/Cor. (PUC) has stated that a series of cases are received from the Punjab Public
Service Commission seeking necessary sanction for the defence of the case at public
expense. Simultaneously, the Solicitor to Government of the Punjab is also requested for
similar necessary action. This department accords necessary sanctions. Generally, all
Government Departments request the Solicitor to Government of the Punjab to issue
necessary sanction for the defence of the case at public expense. The Solicitor’s Department
issues advices to the Advocate General, Punjab, Lahore in respect of the petitions filed in
the Lahore High Court, Lahore and the District Attorney in respect of the cases in the
Lower Courts. This Department intends to know under what law/rule/regulation the
sanction for defence of the case at public expense is required to be accorded by this
Department. It has been requested that the requisite clarification alongwith supporting
documents/references may kindly be furnished to this department at the earliest
367. It is general practice of the Commission to seek necessary sanction for the
defence of the case at public expense from Administrative Department. Director Legal-cum-
Law Officer, PPSC may be requested to clarify under what law/rule/regulations the sanction
for defence of the case at public expense is required to be accorded by the Commission.

28. In response to this office letter dated 7th May, 2007 at Pages-72 &
76/Cor., the Deputy Secretary (Cabinet), S&GAD vide letters dated 5 th July, 2007 at
Page-86/Cor., has requested to furnish the following information which is a prerequisite to

i. Post-wise justification for up-gradation/creation of the proposed posts.
ii. The mode of appointment containing the eligibility criteria including the
minimum qualification with regard to the new post of Assistant Director

iv. There is no mention about the post of Deputy Secretary (BS-17) which
needs clarification with special reference to its relevance to the cadre.
vi. Affect of the judgment of the Honourable Court in the pending Writ Petition
No. 20100/04 filed in the Lahore High Court, Lahore by the Private
Secretaries of the Punjab Public Service Commission over the changes in the
organizational set up of the Commission by upgrading/creating the proposed
posts as well as Superintendents/Private Secretaries as the next date of
hearing stands fixed for 21st September, 2007.
iv. The post of Deputy Secretary (BS-17) is reflected in the Punjab Public
Service Commission Service Rules, 2003 as Deputy Director/Deputy
Secretary (BS-17) and has no separate Service Rules. Any of the Deputy
Director could be posted as Deputy Secretary.

24. In response to this office letter dated 12th May, 2007 at Page-2/Cor., the Deputy
Secretary (Development), Information Technology Department vide letter dated 30th May, 2007 at
Page-16/Cor. (PUC) has stated that the computerization project for PPSC is near completion as
all the major components like deployment of Hardware, establishment of Local Area Networking,
Development of Software Application etc. have been completed successfully. The final version of
the software will be deployed on 1st of June 2007. As the project will be live very soon, the entire
infrastructure created under the project requires to be maintained in a professional way. This
requires a dedicated and professionally trained staff covering all aspects of the computerization.
After carefully analyzing the new requirements of the IT staff along with already available
resource in the Commission, some new posts in the area of System and Network Management
Database administration and data entry operators have been proposed to be created. Furthermore,
the existing posts have also been redefined making them in line with the new requirements. The
proposed organogram along with the proposed service rules and pay packages is annexed at

the system for its optimal and intended usage. IT Department has proposed IT Wing of the PPSC
on the basis of contractual mode funded through SNE from the Finance Department.
25. All existing posts of Computer Wing of the Commission are on regular basis. In
the Commission, Computer Wing has to do secret nature of work e.g. feeding of MQC Objective
Type solved answer sheets, preparation/compilation of result and its record holding, maintenance
of database of the Commission and security of the software which requires long term
commitment and loyalty of their employees. It is not possible for the Commission to depend upon
the contract employees because they try to seek employment on regular basis and do not fulfill
their commitment towards their duties.
26. In view of the position explained above, if approved, the Secretary, Finance

Punjab Public Service Commission has a Research Branch. The functions of the
Research Branch are as under:-
a. To keep the Commission abreast of the latest methods of selection and put up
practical recommendations in this regard to the Commission.
d. When directed to arrange the preparation of Objective Type Tests for over
subscribed jobs advertised by the Commission.
e. To oversee the availability of books, periodicals, and other reading material in the
Library.
At present Research Branch consists of one Director Research (BS-18) and two
Research Assistants (BS-11). It has been observed that Director Research is not being assisted
properly by the Research Assistant as there is no Officer in Research Branch to assist the Director
Research. Resultantly the output of Research Branch is unsatisfactory. Therefore, it is requested
that one post of Assistant Director (Research) (BS-17) may be created to assist the Director
Research.

13. The Governor of the Punjab ordered the Commission vide order dated 27-9-2006
that the Chairman, PPSC should review the Commission’s policy of making the candidates appear
in the written test without complete scrutiny of their applications. In compliance with Governor’s
order, the Commission decided that in all cases shortlisting should be done after detailed scrutiny
of applications and determining the eligibility of the candidates. To determine the eligibility of the
candidates through detailed scrutiny of their applications, present supervisory staff i.e. Deputy
Directors is not sufficient especially in such cases like those of A.S.Is. in Police Department, PMS
(Competitive Examinations) Lecturer in Education Department where number of applications
received are upto 25000–32000. Recently the Commission advertised the posts of Senior Subject
Specialist, Headmaster/Deputy Headmaster, Headmistress/Deputy Headmistress and Subject
Specialist in the Education Department against which 63,258 applications have been received. The
number of applications are increasing day by day due to increase in literacy rate in the Punjab.
During the last 13 years the workload increase has been phenomenal.
14. Recruitment work of all the departments of Punjab Government has been
distributed amongst Recruitment Branches in the Commission. According to PPSC Organizational
Chart a Recruitment Branch consists of the Following Staff:-

15. Each Recruitment Branch in the Commission has been allocated recruitment work
of different Departments of Government of the Punjab and in each department there are many
recruitment cases of different pay scales which a recruitment branch has to process
simultaneously in a stipulated time frame. Due to large number of applications against different
advertisements of the Commission , it has become practically impossible to cope with the task
without providing additional supervisory staff. For instance, in response to Commission’s
advertisement for the posts of Senior Subject Specialist, Headmaster/Deputy Headmaster,
Headmistress/Deputy Headmistress and Subject Specialist in the Education Department 63,258
applications have been received. To determine the eligibility of all candidates through detailed
scrutiny of their applications and finalize the same, recruitment branch dealing with this case will
take more than 4 years whereas stipulated time period is nine months where a written examination
is to be held and 3 months where there is no written examinations.

16. To complete the recruitment process within the shortest possible time period,
additional supervisory staff is required immediately. It is pertinent to mention here that the post of
Assistant Director does not exist in the present service structure of PPSC whereas in all other
Provincial Departments as well as in FPSC, post of Assistant Director exists with the posts of
Deputy Directors & Directors. In order to meet the shortfall of supervisory staff in PPSC and to
complete the service structure, 6 posts of Assistant Directors (BS-17) may be created.
17. Accordingly, S.N.E. for creation of six posts of Assistant Director (BS-17) in the
PPSC is added for approval please.
18. Research Wing of PPSC consists of One Director Research (BS-18) and Two
Research Assistants. One post of Assistant Director Research is proposed to be created to Assist
the Director Research and also to open the promotion channel for Research Assistants.

213. The Additional Finance Secretary (Reg.), Finance Department vide circular letter
dated 29th June, 2007 at Page-262/Cor. (PUC), has stated that the benefit of drawal of
commuted value of pension by the families of those Government servants who retired on
Superannuation, Invalidation and Compulsory basis, but could not sign their pension papers
during their life time, is available. Few cases were reported to this Department whereby the
Government servants got voluntary/pre-mature retirement but could not sign pension papers due
to death. Consequently, the bereaved families of deceased Pensioners remain deprived of benefit
of commuted value of pension under the existing rules.
214. In order to curtail the difficulties of families of such retirees, it has been decided
that the family of a deceased Government Servant, who after having voluntary/pre-mature
retirement, could not sign his pension papers due to death, will also be entitled for the commuted
value of pension with immediate effect.

Department. All the District Attorneys in the Punjab have been directed vide letter dated 20-12-
2006 to send the requisite information which is being received by this office. The data of all the
Government cases which are being conducted by the law officers in all the Districts of Punjab is
accordingly being complied and scrutinized.

come to the notice of Home Department wherein some person/groups impersonated on telephone

Procedure should be that when some body contacts on telephone introducing himself as an officer
of the Government or a celebrity and his number and his office is not recognizable, his number
should be taken up by the concerned officer to verify whether the call is coming from the same
number and from the same person. All official telephone must have the facility of CLI track down
such calls and record all the calls coming from such persons/groups.

302. The Solicitor to Government of the Punjab vide circular letter dated
5th March, 2007 at Page-166/Cor. (PUC-I), has emphasized that instructions contain at
Pages-166 to 167/Cor. be followed in letter and spirit so that Government may achieve fruitful
results in litigation.
303. The Solicitor to Government of the Punjab vide another circular letter dated
5th March, 2007 at Page-169/Cor. (PUC-II), has intimated that the Honourable Supreme Court
of Pakistan has taken serious notice of filing time barred appeals by Province of Punjab. It is,
therefore, directed that in future necessary sanction of the competent authority should be
conveyed to this Department at least 21 days before the expiry of limitation period, except for
I.C.A. and Review. It should also be ensured that necessary funds and the requisite briefs are
provided to the Advocate General Punjab, immediately after the receipt of instructions of this
Department by the litigant departments concerned. The office of the Advocate General, Punjab
should be given at least a fortnight period for preparation and filling of appeal/revisions/CPLAs
before expiry of limitation.
304. All litigant Departments, Head of litigant Departments, and offices should bear in
mind that separate and specific limitation has been prescribed under the law to challenge
judgments and decrees of different courts and if an Appeal/Revision/CPLA is to be filed,
it should be filed within the prescribed limitation period which is detailed at Pages-170 to
171/Cor. for convenience and guidance.

participate in the activities of the day.
iv) Debating competitions and quiz programmes in all educational institutions, so that
the younger generation should also know about the Kashmir issue.
vi) Newspapers to give special coverage for the activities of the Solidarity Day and
Kashmir Issue.

provision in their TA Rules to pay TA/DA to the members attending the meeting of the bodies like

52. The Section Officer (PR), Government of the Punjab, Finance Department vide
circular letter dated 29th November, 2006 at Page-67/Cor. (PUC), has conveyed the approval of
the Governor of the Punjab for the grant of Special Pay/Special Allowance to the officers in BS-
22/BS-21 and the administrative secretaries. The Special Pay/Special Allowance will be admissible
with effect from 1st July, 2006 on terms and conditions specified below:-
(a) A Special Pay at rate of 20% of the basic pay per month to the officers promoted
to the rank of Federal Secretary in BS-22 and having substantive postings against
civil posts in the province.
(b) The officers not covered under sub-para (a) above but holding civil posts in
BS-21/22 in the Punjab Government and all Administrative Secretaries to
Government of the Punjab (BS-20) will receive a Special Allowance at rate of 20%
of the basic pay. The Special Allowance:-
(i) will be admissible at rate of 20% of the basic pay being drawn by the
officer.
(ii) will be admissible during the period the post is held by the officer.
(c) The Special Pay/Special Allowance sanctioned at rate of 20% of the basic pay will
be without any upper limit/ceiling.
53. Expenditure involved in meeting the additional liability will be discharged from the
existing budget grants provided to the departments for the current financial year.

428. The Section Officer (ERB), S&GAD vide circular letter dated
12th December, 2006 at Page-296/Cor. (PUC), has stated that in order to benefit from their well
gained experience and with a view to rehabilitating them, the Government has been encouraging
recruitment of ex-servicemen against civil posts.
429. In this regard, para 7(vii) of the Recruitment Policy, 2004 reiterated that the retired
armed forces personnel may also be recruited against civil posts while making general recruitment
through advertisement, provided they are otherwise eligible for appointment, under the relevant
rules. Note 1 below sub para (e) of para 11 of the Recruitment Policy ibid envisages that for posts
in BS-1 to BS-4, BS-5 to BS-10 and posts in BS-11 and above, 5 additional interview marks shall
be awarded to the candidates who are ex-servicemen. In addition, to facilitate employment of ex-
servicemen, the Government of Punjab S&GAD has issued an amendment in rule 3, clause (iii) of
the Punjab Civil Servants Recruitment (Relaxation of Upper Age Limit) Rules, 1976 vide its
notification No. SORI (S&GAD)9-1/2000 (P-I) dated
11th September, 2004 at Page-298/Cor. under which the Ex-Defence Forces Officers/Personnel
are entitled to the grant of age relaxation in their upper age limit equal to the period of service
rendered by them subject to a maximum of 10 years.
430. However, it is felt that there is a need to suitably highlight the above dispensations
with regard to the ex-servicemen in the advertisements given by various Government
Departments/Attached Departments/Autonomous/Semi Autonomous Bodies/District Government
while making recruitment against civil posts, so as to enhance their awareness and to ensure
sustained rehabilitation process of retired armed forces personnel.
431. It has been requested to kindly ensure necessary action accordingly and also to
bring these instructions to the notice of all concerned for observance in letter and spirit. This
issues with the approval of the Chief Secretary.

25. The Section Officer (Welfare–I), S&GAD vide circular letter dated
10th November, 2006 at Page-32/Cor. (PUC-I), has conveyed that the Chief Justice of Pakistan
has taken a suo moto notice on slow implementation of the “Prohibition of Smoking of Non
Smoker Health Ordinance 2002”. As per the directions of the Supreme Court of Pakistan and in
pursuance of instructions of Federal Government, it has been requested to set up Commission’s
own administrative mechanism to monitor and ensure the implementation of the said ordinance
under intimation to Federal Government as well as the Section Officer (Welfare-I), S&GAD.
25. The Deputy Secretary (Cabinet), S&GAD vide circular letter dated
20th November, 2006 at Page-33/Cor. (PUC-I), has enclosed a copy of Government of
Pakistan, Islamabad’s another self-explanatory communication bearing No. F.14-1/2006-HE dated
15th November, 2006 (along with its enclosures), whereby the Federal Government has, inter alia,
reiterated that the issue be prioritized in the context of directions passed by the Apex Court, and
actions on the points at Page-33/Cor. be taken by all the concerned quarters/departments of the
Punjab Government.
26. It has been requested that implementation status on the subject matter may kindly
be furnished to the Deputy Secretary (Cabinet), S&GAD latest by 25th November, 2006 positively
for submission of a consolidated compliance report to the Supreme Court of Pakistan as well as
Government of Pakistan, Ministry of Health, Islamabad as per deadline fixed by the Apex Court /
Federal Government. This being a Supreme Court case, may pleas be given top priority.
27. It is submitted that the instructions conveyed by the Supreme Court of Pakistan to
accelerate implementation of the “Prohibition of Smoking and Protection of Non Smokers Health
Ordinance 2002” have been circulated in the Commission’s Office for strict compliance. Care
Taker, PPSC has also been directed to make arrangements for displaying and exhibition of boards.

279. The Additional Secretary (Regulations), S&GAD vide circular letter dated
26th December, 2006 at Page-221/Cor. (PUC), has stated that the Establishment Division vide
letter No. E/40/2006-CP-II dated 7th November, 2006 at Page-222/Cor., inter alia, observed that
no value judgment as to whether or not a particular remarks is an adverse remarks should be
passed by the administrative departments without a reference to the countersigning officer. In this
regard, the Establishment Division, has advised that whenever the remarks generally regarded as
adverse appears in the narration part of the PER/ACR forms (i.e. the officer’s performance,
integrity, pen picture, fitness for promotion etc.), the same may be processed as under:-
If the countersigning officer has underlined them in red ink, those must be
conveyed to the officer reported upon in accordance with the laid down
instructions.
If the countersigning officer has not underlined such remarks in red ink, the PER
be returned to the countersigning officer to clarify as to whether those are adverse
remarks or not within the meaning of Para 13 of the instructions for filling up the
ACR forms and if yes the same be underlined in red ink to complete the
requirement of the said instructions. If the countersigning officer fulfills the
requirement, then the said remarks be treated as adverse and communicated to the
officer reported upon in accordance with laid down instructions. If the
countersigning officer replies that those are not to be treated as adverse remarks,

403. The Additional Secretary (REG), S&GAD vide circular letter dated
11th October, 2006 at Page-278/Cor. (PUC), has stated that instances have come to the notice
of the Government where certain officers attended as chairman or as a member, meetings of the
Selection Committees while their blood relations were candidates for a post. Needless to say that
such an act is not only prejudicial to the norms of transparency and casts aspersion on the
conduct of the concerned officers, but also tantamount to nepotism, favouritism and wilful abuse
of office under rule 26 of the Punjab Government Servants (Conduct) Rules, 1966.
404. Therefore, in order to ensure merit and transparency, in case a relative of the
chairman or a member of the Selection/Recruitment Committee is to appear for interview as a
candidate, the said officer should not participate in the meeting of the Selection Committee and
for alternative arrangements order of the next higher authority may be sought.

124. The Motor Transport Officer, S&GAD vide circular letter dated
21st September, 2006 at Page-98/Cor. (PUC), has stated that Competent Authority has
approved the following guideline for usage of official vehicles of Transport Pool, S&GAD by the
dignitaries in order to formalize policy and to streamline allocation of vehicles for Protocol
duties:-
i. A vehicle shall be provided only for an official visit of the dignitary through written
intimation by the concerned departments/organization/office.
ii. Exact duration of visit shall be clearly specified and the vehicle shall be returned
immediately upon its expiry. The driver shall have prior direction to report back to
the Transport Pool upon expiry of the intimated visit, after informing the dignitary.
iii. The facility shall be extended for a maximum of 3 days. If the same is required for
a longer duration, the request will be sent in writing in advance. S&GAD reserves
the right to regret long-term requisitions.
iv. No request shall be entertained for provision of an official vehicle for the family of
visiting dignitaries.
v. Visiting dignitaries, who have subordinate or field offices in Lahore, shall not be
extended such facility.
vi. This facility is extended for official use of the vehicle within Lahore only. Under no
circumstances should the vehicle be taken outside Lahore without specific
approval of the Competent Authority, i.e. Additional Chief Secretary.

45. The Additional Finance Secretary (Budget), Government of the Punjab, Finance

copy of Office Memorandum No. F.2(1)-BR-II/2004-797/UNDP, dated 18th September, 2006 at
Page-49/Cor., received from the Government of Pakistan, Finance Division on the subject noted
above, wherein it has been informed that certain Government Departments are receiving foreign
aid/grants directly by means of cheques drawn in favour of their officers and are utilizing such
foreign aid/grants at their own, out side the formal budgetary mechanism. The Federal
Government has disapproved this practice as being against financial rules and has advised that
even the operation of bank accounts for such transactions is not permissible. It has been requested
that financial rules governing the receipt and utilization of foreign aid/grants may be strictly
adhered to and all such transactions may be made a part of the formal budgetary mechanism.

18. Usually three to five cases are fixed for hearing in different courts of law everyday
at Lahore, Rawalpindi and Multan Bench of Lahore High Court including Punjab Service Tribunal
and Provincial Ombudsman’s cases. To defend these cases the Commission has only one
sanctioned post of Director Legal-cum-Law Officer (BS-18). It is not possible for Director
Legal-cum-Law Officer to attend all cases at a time. If approved, SNEs for the creation of Legal
Cell in PPSC as defined in Category–II at Page-14/Cor. may be sent to the Secretary, Finance
Department, Lahore for further necessary action. The post of Senior Law Officer (BS-18) has not
been included in SNE as the Commission has already one post of Director Legal-cum-Law Officer

Subject:- COMPLAINT AGAINST PUNJAB PUBLIC SERVICE COMMISSION
FOR STOPPING THE CANDIDATES OF ISLAMABAD FOR
APPEARING IN ITS EXAMS.
1. The Press Secretary (P), Office of the Press Secretary to the President, Rawalpindi
vide letter dated 7th September, 2006 at Page-7/Cor. (PUC), has sent emails for appropriate
action, wherein it has been stated by the applicant that PPSC decided not to consider the
Islamabad’s candidates for the posts announced by it. Since the establishment of Islamabad in
1960, for the last forty years PPSC is considering the candidates of Islamabad candidates as the
candidates of Punjab. In 2000, PPSC made the decision at its own and deprived the candidates of
Islamabad for jobs announced by it. Please note Federal Public Service Commission is considering
the candidates of Islamabad as candidates of Punjab. There is a clash between Federal Law and a
Provincial Law regarding the domicile status of Islamabad candidates. It is the responsibility of
Federal Government to make laws regarding the quota of specific area of country not of PPSC.
Please note there is no quota of jobs in CDA, Islamabad Police, Federal Directorate of Education
for the candidates of Islamabad, they are considered as a candidate of Punjab by the Federal
government.
2. It has been requested that PPSC may be asked through which authority they
stopped the candidates of Islamabad for appearing in the exams of PPSC for various jobs. PPSC
is examination body to recommend suitable candidates for various jobs not to decide about the
quota of specific area of the country. It has also been requested to direct the PPSC to consider the
candidates of Islamabad as the candidates of Punjab, which it was considering before 2000 and a
special age relaxation of 6 years may also be given to the candidates of Islamabad, who were
unable to apply for the jobs of PPSC due to this illegal decision of PPSC.
78. The Secretary, Sindh Public Service Commission, Hyderabad vide letter dated 23 rd
August, 2006 at Page-49/Cor. (PUC), has stated that Sindh Public Service Commission intends
to approach Government of Sindh for grant of Commission allowance to the officers and staff of
this Commission’s office. It is learnt that officers & staff of PPSC are drawing commission
allowance at the rate of 20% of the basic pay. If so a copy of such notification may kindly be
provided to Sindh Public Service Commission for their guidelines
246. The Educational Consultant, Federal Public Service Commission, Islamabad vide
letter dated 4th June, 2007 at Page-304/Cor. (PUC), has stated that the subject meeting which
was scheduled for 16th June, 2006 has been rescheduled to be held on Monday, 25 th June, 2007 in
Quetta. In this regard, formal invitation would be extended by the Balochistan Public Service

156. The Deputy Secretary (REG), S&GAD vide circular letter dated 19 th August, 2006
at Page-118/Cor. (PUC), has stated that an appointment on acting charge basis can be made
under Rule 10-A of the Punjab Civil Servants (Appointment and Conditions of Service) Rules,
1974 at Page-6/Cor. Sub-rule(2) of rule 10-A ibid provides that:-
157. It has been observed that the appointments made on acting charge basis are
continued for an indefinite long period instead of prompting the incumbents on regular basis after
completion of their requisite length of service which entails certain financial as well as
administrative complications.
158. In view of the above, it has been requested that the competent authorities should
ensure that the cases of officers/officials promoted on acting charge basis are processed for
promotion on regular basis immediately after completion of the requisite length of service in order
to avoid complications and unwarranted litigation. These instructions may kindly be brought to
the notice of all concerned for strict compliance.

40. The Advisor (Technical), Health Department vide circular letter dated
15th November, 2006 at Page-14/Cor. (PUC), has conveyed serious concern regarding
non-compliance of the rules/instructions in medical reimbursement cases as per West Pakistan
Medical Attendance Rules, 1959 vide letter of even number, dated 5th April, 2006. This cause
inconvenience and delay in realizing the medical claims. It has been reminded to strictly adhere the
instructions contain in the letter dated 15 th November, 2006 at Page-14/Cor. (PUC) in order to
facilitate the government servants in their claims.

25, in column No. 5, 7, 8 and 9 of the Punjab Public Service Commission Service Rules, 2003
shall be substituted.

29. The Deputy Secretary (Monitoring), Finance Department vide circular letter dated
7th August, 2006 at Page-34/Cor. (PUC), has been directed to invite attention to Finance
Department’s notification No. even, dated 30th June, 2004, on the subject as cited above, whereby
it was clarified that the Administrative Departments and Officers in Category – I were competent
to sanction re-appropriation of funds of development schemes, within their sectoral allocations, in
the prescribed manner, vide serial No. 5 under Part–I – Powers Common to all Departments, of
the Second Schedule to the Delegation of Financial Powers Rules, 1990 read with para 15.3(b)
(xi) of the Punjab Budget Manual, without seeking prior approval of the proposed re-
appropriations from P&D and Finance Department. It was further clarified vide F.D’ letter No.
even, dated 14th May, 2005 that the connotation “Approved Schemes” shall only include
‘development schemes reflected in the ADP/Development Budget as per the Schedule of the
Authorized Expenditures’.
30. Since the issuance of the aforesaid instructions, a number of instances have come
to the notice of the Finance Department where the designated authorities made re-appropriations
of funds of development schemes in deviation of the prescribed procedure and laid down
conditions. Besides floating the prescribed procedure and conditions, such irregular re-
appropriations have, interalia, created immense difficulties for the Finance Department while
finalizing the Revised Estimates for both the year 2004-2005 and 2005-2006. Some of the
irregularities committed while making re-appropriations during previous years were as under:-

31. Given that, it has been directed to reiterate the relevant provisions regulating the
re-appropriations of development schemes within their sectoral allocations as under:-
b) The approved cost of the scheme will not be exceeded, through re-appropriation
by more than 10% of the amount for which the scheme has been administratively
approved;
d) No authority subordinate to the one which reduced an allocation will increase such
reduced allocations by means of re-appropriations;
e) Re-appropriation will not be made so as to divert the provision from specified new
items to other purposes;
g) It will be ensured that 2nd Statement of Excesses & Surrenders is received in the
Finance Department by 31st March of the given financial year.
32. It has been requested to strictly adhere to the aforesaid conditions while
sanctioning re-appropriations of development schemes within their sectoral allocations.

2. They have further requested that the functions and duties of the Directors and
Deputy Directors of the Federal Public Service Commission as well as of the Punjab Public
Service Commission are the same whereas manpower from Director to Naib Qasid in Punjab
Public Service Commission is 318 as compared to Federal Public Service Commission where
manpower from Director General to Naib Qasid is 542. Therefore, justice and propriety demand
that the posts of Directors and Deputy Directors of the Punjab Public Service Commission should
be brought at par in status as well as in basic pay scale with the corresponding posts of Federal
Public Service Commission and other Departments of the Punjab Government.
5. All the Deputy Directors and Directors of PPSC vide their representation at Page-
1/Cor. (PUC) have requested to upgrade the posts of Deputy Director from BS-17 to BS-18 and
Director from BS-18 to BS-19 on the analogy of all other provincial departments and FPSC. The
request of the officers is based on discriminatory ground only that the posts of Deputy Director
and Directors may be brought at par in status as well as in basic pay scale with their counter parts
in all other provincial departments and FPSC.
6. Recently Governor of the Punjab ordered the Commission vide order dated
27-9-2006 that the Chairman, PPSC should review the Commission’s policy of making the
candidates appear in the written test without complete scrutiny of their applications. In
compliance with Governor’s order, the Commission vide minutes of the Full Commission Meeting
dated 4-11-2006 at Page-19/Cor. decided that in all cases shortlisting should be done after
detailed scrutiny of applications and determining the eligibility of the candidates. To determine the
eligibility of the candidates through detailed scrutiny of their applications, present supervisory
staff i.e. Deputy Directors is not sufficient especially in such cases like A.S.I. in Police
Department, PMS (Competitive Examinations) and Lecturer in Education Department where
number of applications are received upto 25000 – 32000. These numbers of applications are
increasing day by day due to increase in literacy rate in the Punjab. During the last 13 years
workload has highly been increased. A comparison of workload of 1994 and 2006 is as under:-

7. The above comparison shows that number of applications received during the year
2006 has been increased two times as compare to the year 1994. Para (h) Section 3 of PPSC
standing orders at Page-44/Cor. says that a Deputy Director/Wing Officer will disposed off 50
applications in case of non-technical posts and 30 applications in case of technical posts per day.
And in case number of applications are received upto 25000–30000 against an advertisement,
to determine the eligibility of all candidates, scrutiny of applications will take 20–24 months +
2–6 months for declaring result of written tests and conducting interviews. This will badly delay
recruitment process. Therefore, with present strength of Deputy Directors, it will be impossible
for the Commission to complete the recruitment process within stipulated time period which is
nine month where a written examination is to be held and 3 months where there is no written
examinations (Page-51/Cor.).

8. To complete the recruitment process within the stipulated time period, additional
supervisory staff is required immediately. It is pertinent to mention here that the post of Assistant
Director does not exist in the present service structure of PPSC whereas in all other provincial
departments as well as in FPSC post of Assistant Director exists with the posts of Deputy
Directors & Directors. Therefore, in order to meet the shortfall of supervisory staff and to
complete the service structure of PPSC, 6 posts of Assistant Director (BS-17) may be created in
the PPSC and the present posts of Deputy Directors and Directors may be upgraded from
BS-17 – 18 and BS-18 – 19 respectively. This reform in service structure will not only remove
discrimination pointed out by the Deputy Directors and Directors, PPSC but also increase the
performance of the said officers and in the long run, the lower staff will also get benefit due to
having their promotion quota for these posts. The proposed service structure in PPSC is as
under:-
(i) No change in pay scales of the employees in BS-1 to BS-16 as in each of the
Government Departments posts of Clerk, Assistant and Superintendent are
carrying one and the same scale.
(ii) 6 posts of Assistant Director (BS-17) may be created on regular basis, which
will be the feeding cadre for promotion to the post of Deputy Director BS-18.
(iv) Existing posts of Directors (BS-18) may be upgraded from BS-18 to BS-19.
9. Government of the Punjab, Finance Department vide its letter dated 29-12-1997 at
Page-23/Cor. has delegated financial powers to the Chairman, PPSC. According to these
delegation of Financial Powers, the Chairman, PPSC stands empowered to create, upgrade/
downgrade and abolish any post (or change the nomenclature thereof subject to the following
conditions:-
(i) There shall not be any additional financial liability at any stage, and
(ii) There shall not be any violation of the general policy of the Government such as
ban on creation/upgradation of posts and other economy measures, etc, as
announced by the Government from time to time.
10. On changing the existing service structure as explained in para-8 above, additional
financial liability will be incurred, therefore, if approved, the Secretary (I&C), S&GAD may be
requested to approach the Finance Department for creation of 6 posts of Assistant Director
(BS-17) and upgradation of the posts of Deputy Directors from BS-17 to BS-18 and Directors
from BS-18 to BS-19 in PPSC. Subject to approval, draft ‘reference’ is added below for
approval, please.
11. Para-1/N onward may kindly be seen. The proposal in Para-10/N is strongly
recommended and may please be forwarded for approval of the Chairman, PPSC.

3. In compliance of the Punjab Office of Ombudsman’s order passed in complaint No.
M/1126/05, the Governor of the Punjab passed the following orders:-
“It is evident from the facts of the case that the Punjab Public
Service Commission has committed maladministration by not
allowing age relaxation to the candidate, Mr. Muhammad Afzal
Saffi, which was available to him under the rules being already a
contract appointee. The candidate has been allowed to appear in the
written test which he had cleared and was entitled to be
interviewed. In view of the foregoing, the Punjab Public Service
Commission is directed to hold the interview of the candidate and
send its recommendation to the Education Department for
consideration against the next available vacancy of Lecturer in
Urdu. The Chairman, PPSC should also review the Commission’s
policy of making the candidates appear in the written test without
completing scrutiny of their documents. The representation filed by
Muhammad Afzal Saffi against the order of Provincial Ombudsman
dated 31-12-2005, passed in complaint No. M/1125/05 is disposed
of in terms of these directions. Parties be informed.”

58. The Section Officer (S–III), Education Department (Schools Wing) vide circular
letter dated 20th July, 2006 at Page-62/Cor. (PUC), has informed that Honourable Lahore High
Court, Lahore in its orders referred above has directed Secretary Education, Punjab to dispose of
the petitioner’s representation strictly in accordance with law. In compliance with the court
orders, Special Secretary (Schools) afforded personal hearing to the petitioner. Resultantly, the
case was referred to S&GAD for advice. S&GAD advised to present the case before Qualification
Equivalence Determination Committee Notified vide No. SOR.III(S&GAD)
2-3/2004 dated 18-11-2004. The matter was considered in Qualification Equivalence
Determination Committee on 07-07-2006. The Qualification Equivalence Determination
Committee has principally approved the Bachelor of Library and Information Sciences (BLIS)
degree from Allama Iqbal Open University is equal to Post Graduate Diploma in Library Science.
Minutes of the meeting of Qualification Equivalence Determination Committee at Pages-63 &
64/Cor. has been submitted herewith for kind perusal.
59. If approved, a copy of letter dated 20th July, 2006 at Page-62/Cor. (PUC) may

200. The Deputy Secretary (I&C), S&GAD vide circular letter dated
16th November, 2006 at Page-98/Cor. (PUC), has stated that the Chief Minister, Punjab has
been pleased to further observe that all the mega or other projects involving provincial ADP
Funds, may be inaugurated by the Chief Minister, Punjab/the concerned MNAs/MPAs, with their
names prominently inscribed on the plaques. In this regard, any previous violation may also be

155. Mr. Yousaf Kamal, Member, PPSC vide letter dated 19 th June, 2006 at Page-
31/Cor (PUC), has informed that during the course of conducting the interviews for the subject
noted post, on 17th June, 2006 the representative of the Department,
Mr. Muhammad Abbas while addressing the Chairman/undersigned and advisor
Mr. Muhammad Shafique Ajami, Associate Professor, Government College University, Lahore
informed that on the next date of interview i.e. 19 th June, 2006 one candidate
Mrs. Yasmin Farrukh will be appearing for interview. He informed and recommended that she was
already working as sub editor in the said Department for the last ten months, had experience, was
competent and she should be selected for the post of Editor which the Punjab Public Service
Commission was interviewing. It was stunning to hear such remarks and safarish from a
departmental representative who is obviously required to be totally impartial and above board.
157. As the D.R. Mr. Abbas was biased, Mr. Yousaf Kamal, Member, PPSC had
requested Mr. Liaqat Ali Khan Niazi, Secretary/Director (Archives) on June 19, 2006 (day of
interviews) that the D.R. may be changed and replaced at once. The entire situation was also
explained to Mr. Liaqat Ali Khan Niazi. Mr. Yousaf Kamal, Member, PPSC has brought this
unbelievable offence to the notice of the Commission for taking appropriate action similarly.
342. The Additional Finance Secretary (REG), Finance Department, Lahore vide letter
dated 18th July, 2006 at Page-235/Cor (PUC) has stated that directives of the Honourable
Supreme Court of Pakistan reads as under:-
“The Chief Secretary of Punjab shall collect information from all the departments
of the Government of Punjab about re-imbursement of expenses allowed to any
person by the said Government for treatment abroad. The Secretary Incharge of
every department shall send this information to the Chief Secretary for onward
communication to this Court, under his own signatures.”
343. Honourable Chief Secretary has desired the Finance Department to collect the
information on his behalf and submit to him in shape of Summary for its submission to the
Honourable Supreme Court of Pakistan under his signatures.
344. Above-noted information is not restricted to the civil servants only but includes
any money ever been paid to any one as expenses for treatment abroad since 1993.

1. Panel of Advisors/Examiners
Maintaining a list of Advisors and Examiners for interviews and written tests/examination
is an important task. The earlier list of advisors/examiners has been expanded and updated as
desired by the Government of Punjab. Vice Chancellors of Universities and Heads of all extant
institutions were requested for recommendations. With this exercise the Commission has an
updated and comprehensive list of scholars and experts and advisors/examiners.
2. Regional Offices
There are two regional offices of Punjab Public Service Commission one in Multan and the
other in Rawalpindi. In order to maximize the convenience to the candidates, the Commission has
initiated conducting interviews at these regional offices. The prospects of holding the writing
examination/tests at Rawalpindi and Multan are being explored.

To ensure effective management control, to avoid the causes of delay in the selection
process and to optimize the efficiency of the
Commission, date-wise requisition progress record is maintained right from the receipt of
requisitions to the finalization of recommendations. Constant monitoring has reduced bureaucratic
delays and removed many bottlenecks.
6. Legal Cell
The Commission provides adequate opportunity to the candidates to reduced their
grievances within the Commission and is committed to minimize the chances of litigations by
taking remedial measures, procedural improvements and timely notice for resolving causes of
litigations. Legal Cell of the PPSC and Establishment Branch are st5reamlining the working for
timely disposal or reference of courts.

Internet is now-a-days most popular, feasible and economical way of updating the domain
of knowledge and information of every subject. Most of the fields are dynamically changing,
requiring most current and updated knowledge. Thus all the Members of PPSC have been
provided with the internet facility at their desk to benefit from his technology for acquiring current
and the desired updated knowledge on each subject.
Except Software Development almost all the components have already been completed.

183. In response to this office letter dated 10th June, 2006 at Page-84/Cor., the Section
Officer (Cabinet–I), S&GAD vide letter dated 16th June, 2006 at Page-92/Cor. (PUC), has
informed that the reply to the subject cited complaint received from the Deputy Secretary, Punjab
Public Service Commission vide letter dated 10 th June, 2006 at Page-84/Cor. is not satisfactory

resignation of the said Member with immediate effect but permission under section 6(1) of Punjab

14. Keeping in view the domestic problems of Mr. Muhammad Shabbir, Private
Secretary especially illness of his mother, there seems some compassionate grounds to accede the

21. The Section Officer (REG–II), S&GAD vide circular letter dated
20th May, 2006 at Page-45/Cor. (PUC), has informed that the cases in which the Proforma
Promotion can be granted have been enumerated at sub para (III) of para 2 of the Promotion
Proforma Policy circulated vide No. SOR-II(S&GAD)2-59/78, dated
19th April, 2003 at Page-16/Cor.
22. The Proforma Promotion Policy is, however, silent about a situation where a
senior was conditionally recommended for promotion while his junior was recommended for
promotion to the same rank unconditionally in the same PSB meeting. The senior could not fulfill
the condition even after a lapse of 11 months from the date of his clearance by the Provincial
Selection Board the junior assumed the charge immediately after the issuance of promotion
notification. The senior would have otherwise become eligible for grant of proforma promotion
had he been deferred instead of conditional promotion. The senior had to assume charge of the
higher post after 11 months of the promotion of his junior, with immediate effect, thus losing the
financial benefits for the period and had to seek relief from the judicial fora.
23. In order to cater for the cases arising out of conditional promotion of civil servants
by PSB/DPC, the competent authority, in partial modification of the Proforma Promotion Policy
has been pleased to allow addition of the following sub-clause in Para 2 (III) of the Proforma
Promotion Policy at Page-17/Cor.:-
24. The above instructions should be brought to the notice of all concerned.
25. It is submitted that the addition has been incorporated in the relevant policy which
may kindly be seen at Page-17/Cor.

Chief Secretary, Punjab has noted with concern that Administrative Departments at
time fail to submit parawise comments/reports before the Supreme Court/High Court within the
stipulated time, thereby causing embarrassment to the government. In many cases, the Chief

140. The Section Officer (Cabinet–I), S&GAD vide circular letter dated
16th February, 2006 at Page-43/Cor. (PUC), has stated that the Cabinet Division, Government
of Pakistan, Islamabad vide its communication dated 6th January, 2006 at Page-44/Cor. has
informed that the Federal Government observed that direct contact between political functionaries
of certain countries has been taken without regard to procedure laid down in the Rules. Direct
invitations have been accepted and also given at high political level. It has also been noticed that
mutual visits and MOUs between various educational institutions are being planned without
keeping the Ministry of Foreign Affairs in the loop. In some cases, specific advice of the Foreign
Office is not being observed.
142. Chief Minister, Punjab vide his communication bearing dated 24th January, 2006 at
Page-48/Cor. has desired that the relevant rules/instructions mentioned above, be followed in
letter and spirit.
143. If approved, the circular letter dated 16th February, 2006 at Page-43/Cor. (PUC)
along with its enclosures may kindly be provided to Chairman/Members, PPSC.

18. According to Government of the Punjab, Finance Department’s letter dated 29-12-
1997 at Page-11/Cor., the Chairman, PPSC has been delegated financial powers to create,
upgrade/downgrade and abolish any post (or change the nomenclature thereof) subject to the
following conditions:-
(i) There shall not be any additional financial liability at any stage, and
(ii) There shall not be any violation of general policy of the Government such
as ban on creation/upgradation of posts and other economy measures, etc.

19. In view of the position explained above, there is an additional financial liability
involved in upgrading the post of Data Entry Operator from BS–11 to BS–12, if approved, the

158. The Section Officer (Culture), S&GAD vide circular letter dated
19-12-2005 at Page-113/Cor. (PUC), has stated that Government of Pakistan has decided to
celebrate the birthday of the Quaid-e-Azam Mohammad Ali Jinnah falling on Sunday 25th
December, 2005 in the following manner:-
ii) Hoisting of the National Flag on Principal Government Buildings throughout the
country.
iii) Special Programme by Radio Pakistan / TV Stations on the life, ideas and
achievement of the Quaid-e-Azam.
159. It has been requested that suitable arrangements may kindly be made by all
concerned for the celebration of Quaid-e-Azam’s birthday falling on Sunday the 25 th December,
2005 in a befitting manner. It may also be ensured that people belonging to all walks of life get an
opportunity to participate in the celebrations.
160. It has further been requested that in deference to the sufferings of the quake-
affected people of Azad Kashmir and NWFP an appeal may also be made to the public at large to
celebrate the birthday of the Father of the Nation in simple but dignified manner.
161. It has also further been requested to give an added colour to the official
programme. And appeal may also be made to the public at large to wholeheartedly participate in
the birthday celebrations.

162. The expenditure involved on these arrangements will be met out from within the

163. It is submitted that a copy of the said circular letter dated 19-12-2005 at Page-
113/Cor. has been circulated to Security Officer-cum-Protocol Officer and Care Taker, PPSC for
compliance/necessary action.
All Data Entry Operators of Punjab Public Service Commission have filed a
representation at Page-1/Cor. (PUC) for up-gradation of the post of Data Entry Operator BS-
11 into BS-12. They have submitted that the post of Data Entry Operator in other departments
like Excise & Taxation Department, Punjab Assembly and Lahore High Court, Lahore is of BS-
12. It has been requested that the post of Data Entry Operator in Punjab Public Service
Commission may be upgraded in BS-12 like other departments and obliged.
3. In view of the position explained above, there is clear difference between the
grades of the post of Data Entry Operator in Punjab Public Service Commission and other
departments stated above. The Data Entry Operator of other departments and Punjab Public
Service Commission perform the similar kind of duties. But the said officials of other departments
enjoy high grades than the officials of Punjab Public Service Commission.
4. It is submitted that in order to upgrade the post of Data Entry Operator, the
Accounts Branch may be advised to calculate the financial implications for up-gradation of the
post of Data Entry Operator (BS-11) in BS-12 to proceed further in the matter.
10. If approved, the Secretary, NWFP Public Service Commission, Peshawar may be
requested to provide copy of judgment of Supreme Court of Pakistan titled as
Mr. Musa Wazi v/s NWFP Public Service Commission may be supplied so that report regarding
implementation of decision of the said court could be provided to the Section Officer

9. In view of the above comparison, there is clear difference between the grades of
the posts of Punjab Public Service Commission and Federal Public Service Commission. The
functions of Federal Public Service Commission and Punjab Public Service Commission are of
similar nature and the officer mentioned above perform the similar kind of duties. But the said
officer of Federal Public Service Commission enjoy high grades than the officers of Punjab Public
Service Commission.
10. It is submitted that in order to upgrade the posts of Director and Deputy
Secretary/Deputy Director, the Commission will have to change the service structure i.e. for
promotion to the post of BS-18 officers in BS-17 while promotion to the posts in
BS-19 officers in BS-18 will be considered, therefore, service structure in Punjab Public Service
Commission is proposed to be as under:-
(i) No change in pay scales of the employees in BS-1 to BS-16 as in each of the
Government Departments posts of Clerk, Assistants and Superintendent are
carrying one and the same scale.
365. The Additional Secretary (Management), S&GAD vide circular letter dated
5th August, 2006 at Page-265/Cor. (PUC), has stated that in partial modification of Contract
Appointment Policy, 2004 circulated vide S&GAD (O&M Wing) letter No.
DS(O&M)5-3/2004/Contract(MF), dated 29th December, 2004 at Page-137/Cor., the Chief
Minister, Punjab has been pleased to allow substitution of the existing sub-par XI of 3 of the
Policy with the following sub-para:-
(i) The following quotas already provided under various notifications shall continue to
be observed for appointments on contract basis:
Explanation: The posts reserved for quotas mentioned above are to be filled only
at the time of making general recruitment through advertisement, under the
Recruitment Policy. If general recruitment against any category of posts is being
made on contract basis, appointments against above mentioned quotas shall also be
made on contract basis.
(ii) The provision of rule 17-A of the Punjab Civil Servants (Appointment and
Conditions of Service) Rules, 1974 and the relevant instructions/guidelines issued
in this behalf from time to time shall be applicable mutatis mutandis for
employment of one of the unemployed children, wife/widow of a civil servant who
dies while in service or is declared invalidated/incapacitated, under this policy.
366. The instructions issued vide S&GAD letter No. SOR-III-2-42/92(P-III) dated
15-11-2003, shall stand withdrawn with immediate effect.
141. The Secretary Regulations, S&GAD vide circular letter dated 20-7-2005 at Page-
93/C (PUC), has stated that a question has arisen as to whether ban on recruitment is applicable
to appointment under Rule 17-A of the Punjab Civil Servants (appointment & Conditions of
Service) Rules, 1974, and various quotas as mentioned in Recruitment Policy 2004. the issue has
been examined in the Regulations Wing, S&GAD, and it has been observed that under rule 17-A,
relief to the family of a deceased or invalidated/incapacitated civil servant by providing
employment to the widow/wife or one child of the said civil servant for which he/she possesses
the prescribed qualification and experience, has been provided. Under the rule ibid, this special
dispensation has the following two categories requiring different application viz a viz application
of ban on recruitment.
As such, appointment under rule 17-A in this category can only be made when
general recruitment is made and general recruitment can be make when there is no
ban on recruitment. As such, ban on recruitment sahll be applicable in case of
appointment in BS-6 and above unless the ban is relaxed for general recruitment
against any category of posts.

142. The following quotas have been provided in the Recruitment Policy-2004 at Page-
95/C.
(i) 2% quota for disabled person as per notification No. SOR.III-2-86/97 dated 29-
01-1999 at Page-108/C, and in keeping with instructions issued vide No. SOR.IV
(S&GAD) 7-1/2003, dated 15-04-2004 at Page-109/C.
(ii) 5% quota for women as prescribed vide notification NO. SOR-III-1-35/93, dated
17-04-2002 at Page-111/C.
(iii) 20% quota of posts in BS-1 to 5 for the children of serving/retired government
employees in BS-1 to 5, as prescribed vide notification No. SOR-III.1-22/90,
dated 01.09.1993 at Page-112/C. This quota has been prescribed only for the
cadres of Junior Clerk, Driver, Naib Qasid, Mali, Frash, Water Carrier and
Chowkidar in all government departments for the children of government servants
in BS-1 to 5.
The posts reserved for above quotas are to be filled only at the time of making
general recruitment through advertisement, under the Recruitment Policy as and
when ban on recruitment is lifted. As such, ban on recruitment is applicable on
appointments against the above categories of posts.
143. It has been advised to follow the above instructions while making recruitments
under Rule 17-A of the Punjab Civil Servants (Appointment and Conditions of Service ) Rules,
1974 or under various quotas, as mentioned in preceeding paras.
83. The Secretary Regulations, S&GAD vide circular letter dated 7-6-2005 at Page-
98/C (PUC), has stated that according to the prevailing policy of the Government of Punjab,
promotion is granted to serving civil servants with immediate effect and not from the date of
occurrence of vacancy. Promotion is not granted to a retired civil servant as he does not remain a
civil servant after retirement, though proforma promotion may be granted to a retired civil servant
from the date of promotion of his junior, provided that the retired civil servant was promoted to
that rank during his service. To further strengthen the provisions of the policy regarding the date
of effect of promotion, the
Government of Punjab has now made the following amendments in Punjab Civil Servants Act,
1974, through notificiation dated 15-4-2005 at Page-100/C. The salient features of the
amendments are as under:-
(2) Promotion including proforma promotion shall not be claimed by any civil
servant as of right.
(3) Promotion shall be granted with immediate effect and be actualized from
the date of assumption of charge of the higher post, and shall in no case be granted
from the date of availability of post reserved for promotion.
(4) A civil servant shall not be entitled to promotion from an earlier date
except in the case of proforma promotion.
(5) A retired civil servant shall not be eligible of promotion; provided that he
may be considered for grant of proforma promotion as may be prescribed.

84. It has been requested that while processing and deciding the cases of promotion
and proforma promotion of civil servants and retired civil servants, guidance should be sought
from the provisions of the above amendment in the Punjab Civil Servants Act, 1974, as well as the
Punjab Government’s Proforma Promotion Policy issued vide circular No. SOR-II(S&GAD)2-
59/78, dated 19-4-2003.
207. The Section Officer (Cabinet–I), S&GAD vide circular letter dated
15-4-2004 at Page-306/C (PUC) has forwarded a copy of letter dated 28-8-2004 at Pages-307
to 309/C wherein it has been stated that the instructions regarding disposal of Assembly
Business at Pages-307 to 309/C as to how Legislative Business, Assembly Business,
Privilege/Adjournment/Cut Motions and other such matters connected with the Assembly Session
should be handled, may kindly be followed in letter and spirit. It has been requested that

150. The Section Officer (Culture), Information, Culture & Youth Affairs Department
vide circular letter dated 30-7-2005 at Page-102/C (PUC) has informed that the National
Independence Day is celebrated on 14th August every year with full enthusiasm and fervour. The
Prime Minister of Pakistan has been pleased to approve the following programme for this year’s
celebrations:-
d. Dramatic pause at 7:58 a.m. with sounding of sirens to herald the flag hoisting at
8:00 a.m. and all moving traffic (road, rail and sea) to stop for one minute.
e. Flag hoisting ceremony by the Prime Minister at Islamabad and playing of the
national anthem.

ceremony.

Director (BS-17). As such on his further promotion, Deputy Secretary has to
