INTRODUCTION

1.1 Background

Kenya Dairy Board is a statutory organization established in 1958 by an Act of Parliament, the
Dairy Industry Act Cap 336 of the Laws of Kenya. The Boards Mandate is to Develop, Regulate
and Promote the Kenya Dairy Industry.

The Board has a branch network of 16 offices located in the major milk production and
consumption zones of the country with the Head office located in Nairobi. The Boards
workforce stands at 107.

The Board advocates for an enabling environment that caters for and recognizes the roles and
responsibilities by all individuals in a non- discriminatory manner towards the development of
the dairy industry in Kenya.

1.2 Policy Imperative

The need to integrate disability issues into national development has been recognized in many
government policy pronouncements and commitments reflected by signing and ratifying
various instruments, treaties and international conventions. The existing national policies and
legislations relevant to disability mainstreaming in Kenya Dairy Board are analyzed below;

The Constitution of Kenya 2010; Chapter four of the Bill of Rights ensures and upholds general
provisions for recognizing and protecting human rights and fundamental freedoms by
preserving the dignity of all individuals Section 54 clearly states that

(1)Any person with disability is entitled to:

 Be treated with dignity and respect and to be addresses and referred to a manner that is
not demeaning;

 To access educational facilities and institutions for persons with disabilities that are
integrated into society to the extent compatible with eh interests of the person
 To reasonably access all places, public transport and information;
 To use sign language, braille or other appropriate means of communication
 To access materials and devices to overcome constraints arising from the persons
disability

(2) the State shall ensure the progressive implementation of the principle that at least five
percent of the members of public in elective and appointive bodies are persons with
disabilities.

The Persons with Disabilities Act, (P.D.A.), 2003

The Persons with Disabilities Act 2003 was enacted to achieve the following objectives;

 To establish the National Council for Persons with Disabilities which is a semi-
autonomous government agency
 To provide for the rights and rehabilitation of persons with disabilities in terms of the
right to be protected from discrimination on the grounds of disability and to safeguard
the political and civic rights of persons with disability
 To provide for realization of opportunities for persons with disabilities through provision
of tax exemption ,legal assistance and encouraging credit facilities be extended to
persons with disabilities

 The Kenya Dairy Board Disability policy aims at activities;


 To ensure that no one person is denied employment due to disability
 To ensure that no disabled person working in the Board faces discrimination of any form

 To ensure that no disabled person faces discrimination based on the manner in which
vacancies are announced, the manner in which employees are recruited for
employment, in terms of promotions
 To ensure that no disabled person is discriminated based on training opportunities
transfers and retrenchment
 To ensure that the facilities for working in the organization do not deliberately disqualify
anyone with disabilities
 To ensure that the person with disability does not take undue advantage of the Board in
terms of the inclusion of special facilities that will hinder the Boards operations
 To ensure that the person with disability is able to seek redress if faced with
discrimination through making a formal complaint which if not solved by the Board can
be addressed through the Industrial Court by the trade union to which the staff member
belongs to
 To ensure that the persons with disability have access to the same insurance facilities as
the rest of the staff

1.3 METHODOLOGY OF THE PLAN OF ACTION (POA)

The methodology used to develop the POA include: in-depth interviews with selected key
informants in sector, literature review of documents on disability mainstreaming, conventions,
agreements and other instruments, that have consequently evolved into the disability
mainstreaming issues as a core development concept, together with policies, plans and
programs of selected dairy stakeholders. In terms of process the POA included: preparation of
inception report, production of draft report and presentation to the committee, a 2-day
consultative technical review and input, 1- day, stakeholder validation workshop, finalization of
the Plan, publication and a dissemination launch.
A review of selected dairy stakeholder disability mainstreaming plans, policies, strategies,
Programs and implementation plans provided insights in the current situation,
Successes, challenges, and lessons learned in disability mainstreaming.

The key informant interview with key people in the National Council for Persons living with
Disabilities ,working definitions of disability, their commitment to disability mainstreaming,
the operational structures and disability monitoring mechanism being used, achievement
and lessons learned.

1.4 BASIC PRINCIPLES OF DISABILITY MAINSTREAMING

 Development of adequate accountability mechanisms for monitoring progress.

• Analyze differences and disparities in definition of disability in activities at all levels.

• Need for consistent goodwill and allocation of adequate resources (financial and human)
for translating the concept into practice.

• Deliberate efforts to broaden equitable participation at all levels of decision making by all
stakeholders.

• Recognition that mainstreaming does not replace the need for targeted, specific policies
and programs, and positive legislation; that may contribute to more efficient facilitation of
the process.

1.5 JUSTIFICATION FOR THE PLAN OF ACTION


This POA responds to the challenges of implementing disability mainstreaming policies and
programs. The first steps towards realization of equity and equality in development is having
policy statements articulating disability perspectives at KDBs’ core functions, purpose and
values
The POA provides a framework for harmonization, coordination, networking, monitoring and
evaluation of disability mainstreaming initiatives within KDB. The POA also provides strategies
for resource mobilization and technical capacity development. In addition, the POA proposes
mechanisms for making disability issues core at indicator development and target setting at all
levels. Further it offers opportunities for strengthening and fastening implementation of

disability -related legislations, and the creation of an enabling environment for translation of
disability related commitments at national levels into action.
Therefore, the objective of this POA is to mainstreaming disability into the development
process in the country and to provide a common framework for all KDB staff to promote
disability equality.

1.6 OUTLINE OF THE PLAN OF ACTION

Broadly, the Plan of Action addresses itself to the five pillars of disability mainstreaming which
include;

a) Strengthening the capacity of organizations of people with disabilities to address human


rights.

(b) Mainstreaming respect and promotion of disability rights in the dairy industry

c) Improve efficiency through sensitization of disability anti-discrimination as provided in the


Persons with Disability Act 2003.

d) Develop disability support and arbitration services to improve advocacy efforts and ensure
participation by organizations of persons with disabilities in all levels of dairy stakeholder
participation

(e) Undertake regular monitoring of the rights of people with disabilities, ensuring the active
involvement of people with disabilities in Kenya with regard to service provision by KDB.

1.7SCOPE

This policy applies to all staff of Kenya Dairy Board as well as visitors and subcontractors inside
and outside of formal scheduled working hours.

All individuals are expected to treat one another with respect

All staffs are provided with requisite tools for carrying out their respective responsibilities as
prescribed

All staffs are provided with means to access the Boards premises where physically challenged

All staffs are guaranteed same terms and conditions of service as per requisite grades.

All staffs irrespective of status are legible for training where necessary

The Board prohibits any discrimination practice

2. STRUCTURES FOR IMPLEMENTATION OF THE PLAN OF ACTION

The implementation of the Plan of Action will use the institutional mechanisms as provided for
by the Persons with Disabilities Act 2003 and any other and other recent developments such as
the Devolution Act, Constitution of Kenya Act 2010, National Livestock Policy 2008, and the
KDB Corporate Strategic Plan 2012-2017. The implementation process will be a collaborative
effort between KDB and Dairy industry stakeholders through interviews, use of help desk,
trainings, open days and engagement in CSR activities.

3. IMPLEMENTATION STRATEGIES

The implementation strategies of this POA will be guided by current sector strategies and
recommendations drawn from consultations with key informants, existing literature, and needs
assessment reports. The following strategies are proposed;

3.1 Establish Structural linkages

This is done by establishing Institutional structures with clear mandates and resource
allocation, and well defined communication channels for the Disability Mainstreaming
Committee.

3.2 Capacity building for institutions and individuals

This is meant for institutional strengthening and implementation of programs for disability
mainstreaming through:

 Sector reforms
 Systematic interventions to address sector disability issues
 Engendering of operational structures
 Development of policy statements linking disability mainstreaming to KDB’s core
functions, purpose and values, and allocation of adequate resources for gender issues
 Setting up a disability mainstreaming committee that is responsible and responsive to
the institutions framework
 Disability Committee members attain relevant training to handle disability issues with
clear terms of reference

3.3 Lobbying and Advocacy


Lobby and Advocate for implementation of presidential directives and pronouncements on
disability mainstreaming interventions. Develop shared understanding of among the different
actors with the aim of bringing commitment to disability issues to the fore at all levels of
management for active and meaningful participation from all dairy stakeholders. Ensure clarity
Lobby and advocate for continuous capacity building of field staff to sustain momentum for
increased impact.

3.4 Harmonization and alignment of Initiatives


The harmonization and alignment of initiatives of different actors with the Policy development,
law reform, enactment and implementation is aimed at more sustainable realization of
disability mainstreaming. This will be done through inter-sectoral activities and coordination,
and joint programming among KDB activities targeted at dairy stakeholders, establishing
linkages with institutions such as the National Council for Persons with Disabilities among

others, which will provide an opportunity to create harmony while complementing on-going
initiatives.
3.6 Research and information dissemination
Continuous disability mainstreaming surveys will be carried out to produce sex disaggregate
data to inform policy development. Existing data will be analyzed, disseminated and utilized
among staff of KDB. In addition, creation of partnerships with Civil Society Organizations will be
emphasized to facilitate information dissemination to the grassroots and continuous follow-up.

3.7 Monitoring and Evaluation mechanism


There is need to develop and operationalize M & E framework to track progress, document
experiences, challenges, lessons learned and establish impact and review the in achievement in
disability mainstreaming.

3.8 Resource Mobilization

This will be realized through adequate resource allocation to the Disability Mainstreaming
Committee. In addition, budgeting process need to be engendered with adequate allocations by
KDB through the Parent Ministry. The mobilization of non-budget support from the community,
development partners and other stakeholders will expedite achievement of mainstreaming
disability in the Board.

3.9 Partnership and networking


There is need to create partnerships and networks for resource mobilization, implementation
of programs and activities aimed at disability mainstreaming and for rapid results and
sustained gains for equitable development at all levels .

4. ACTIVITIES, INDICATORS, IMPLEMENTATION SCHEDULES


The activities are presented in Annex 1: the Logical Framework using a result based approach
format.

4.1 Overall Recommended Activities

The foundation activities that will roll out the implementation of the Disability Mainstreaming
Implementation Plan of Action include:

• Capacity building of Committee Members on the Plan of Action

• Operationalizing the Disability Mainstreaming Plan of Action

4.2 Specific Theme Activities

These will be derived from themes and integrated into KDB activities across the board. The
process of operationalizing the POA will be coordinated by the Disability Mainstreaming
Committee and spearheaded by the Chairman and other committee members as well as Branch
Officers who will articulate disability issues in the respective Stations up to the community level
as follows:

• Identify, map out and prioritize disability issues in the among dairy stakeholders

• Review proposed activities and harmonize with sector realities

• Build relevant capacities to mainstream disability

• Identify linkages and networks

 Coordinate sector implementation of disability mainstreaming strategic activities


• Produce disability mainstreaming reports
• Profile disability issues

5. MONITORING AND EVALUATION FRAMEWORK

The proposed M&E framework aims at meeting the information needs of different stakeholders
and promoting evidence based planning and decision making at all levels. The need for ensuring
timely availability of data; analysis and dissemination of findings, ensuring reliable access and
retrieval of data by stakeholders cannot be overemphasized. The M&E will also facilitate the
following:
 provide a linkage with sector/national M&E systems to ensure adequate
 provision of disaggregated data at all levels
 strive to collect and analyze qualitative and quantitative information using participatory
approaches, and other research methods
 analyze programs to evaluate changes towards disability mainstreaming
The following institutional arrangements and mechanism for M&E framework for the KDB
Disability Mainstreaming Committee are proposed;

 The M& E will be implemented through the Sector Disability Mainstreaming Chairman
 The KDB Management will provide technical support and resources to carry out
activities
 A rationalized and harmonized functional system of routine information and data
collection on disability issues at the national and regional level will be put in place
 Capacity building frameworks will be developed for data collection, analysis and
use with clear dissemination plans
 Communication strategy will be developed and implemented
5.1 Monitoring
To increase the efficiency and effectiveness of the monitoring process, routine data
collection in the sector/thematic areas will be carried out as outlined below:
 The indicators developed for the policy operationalization activities together with the
national indicators for international instruments on disability
 Mainstreaming will facilitate a national systematic comprehensive reporting.

 At the activity level, indicators will provide a checklist of stated activities.


 Data collection, analyses and storage will focus on quality, and the relevance or critical
importance thematic sector and national development and use a harmonized systems.
 Data dissemination and communication will have a mechanism for managing inter-
sector linkages and continuous feedback from the national, and county levels on the use
of advocacy and sensitization key strategies.
 The bottom-up feedback will be a clear indicator of the level of people’s participation
and involvement in the on-set of disability mainstreaming
The level of budgetary allocation and investment by other stakeholders including the
community, development partners and the private sector will be another bench mark in
profile of disability mainstreaming in the Dairy Industry.

5.2 Evaluation
Internal participatory reflections and reviews through forums and annual progress
reports from sectors will keep track of performance. Periodically scheduled evaluations
will establish the level of gender responsiveness in planning, programming, budgeting
and the impacts on disability issues

5.3 Monitoring Tools


Responsible actors will be accountable for delivery of outputs according to the
implementation schedules. Tools for monitoring will include: baseline and research
reports, training reports, annual progress sector plans and progress reports, and
national evaluation reports in line with indicators.
