EX PARTE MOTION TO LITIGATE

AS INDIGENT LITIGANT

COME NOW, the plaintiffs, through the undersigned counsel and unto
this Honorable Court, most respectfully avers that:

1. The plaintiffs are indigents whose only source of income is a small store
located at their house. Copies of the Certificates of Indigency issued by
the Office of the Barangay Chaiman of Brgy.
_______________________ and the Office of the Municipal Social
Welfare and Development – _________, both in favor of
_________________ are attached herewith as Annex A and Annex B
respectively;

2. Their daily income of Three Hundred Pesos (PHP 300.00) is not

sufficient to support their basic necessities, much less, pay for the legal
expenses. They, likewise, do not have any immediate family who can
support the expenses of litigation. Additionally, their sworn statement
attesting to the truthfulness of their indigency and an affidavit of two
disinterested persons attesting to the truthfulness of their indigency are
attached herewith as Annex C and Annex D respectively;

3. The plaintiffs have not benefitted, financially, from the subject real
properties, despite the fact that the plaintiff _______________ is one
of the co-owners thereof.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed

unto this Honorable Court that the plaintiffs be allowed to litigate as indigent
litigants and they be exempted from payment of docket fee and other
incidental legal fees.
 Other reliefs which are just and equitable are likewise prayed for.
