ACUERDO ENTRE LA REPUBLICA DE GUATEMALA Y BELICE PARA EL TURISMO SOSTENIBLE ‘La Republica de Guatemala y Belice, en adelants denominadas “Las Partes” CONSCIENTES que el turismo sostenible es un factor esencial para el desarrollo de las Partes; CONSIDERANDO que la promocién del turismo sostenible en Guatemala y Belice atrae un numero significante de turistas y es importante para compartir experiencias en esta materia; DESEOSOS de fortalecer la cooperacién en turismo sostenible entre las Partes y crear -ventajas recfprocas en beneficio del desarrollo turistico en ambos paises; RECONOCIENDO la importancia del tursmo para la promocién del desarrollo econémico y cultural entre las Partes; TENIENDO EN CUENTA las iniciativas regionales, incluida la Organizacién Mundo Maya, el Consejo Centroamericano de Turismo e iniciativas especificas y proyectos de cooperacién para el desarrollo del (urisino susicuible en le regiGu Maye y ols proyectos regionales; Acuerdan lo siguiente: ARTICULO 1 OBJETIVO El objetivo del presente Acuerdo consiste en fo-talecer la cooperacién y colaboracién entre los sectores del turismo en base de igualdad de derechos y beneficios mutuos y de conformidad con las respectivas leyes nacionales y compromisos internacionales de las Partes, asi como establecer mecanismos de trabajo para consolidar la implementacién de los planes de accién y estrategias de las Partes. ARTICULO 2 AREAS DE COOPERACION El presente acuerdo incluira las siguientes areas de cooperacién: a) Alentar el desarrollo de iniciativas para la promocién del turismo con el fin de aumentarlo, haciendo énfasis en reuniones, incentivos, convenciones yexposiciones; turismo médico, gastronémico, de Iujo, de aventura, ecoturismo, de deportes, de playa, cultural y en grupo, entre otros. 'b) Promover la imagen de las Partes, a través de su participacién en seminarios, conferencias, exhibiciones y simposios relacionados con el turismo y dreas afines, y cualquier otra accién que genere un potencial para el desarrollo del turismo en ambas Partes. ©) Alentar y apoyar el intercambio de experiencias, mejores pricticas, estadisticas, materiales informativos sobre destinos turfsticos y otra informacién de interés mutuo para los sectores del turismo, ‘ncluidos pero no limitados a lo siguiente: # recursos y estudios relacionados con el sector del turismo * politicas y planes de turismo * volumen y caracteristicas de poteaciales mercados de turismo © experiencias sobre turismo cultural, médico, rural y sostenible * experiencias en la administracién de la infraestructura y el desarrollo del turismo * rutas y paquetes para promover v.ajes multidestino © experiencias en mecanismos de inversién para promover el turismo; * investigaci6n y desarrollo de productos y servicios de turismo © sistemas de acceso de turismo para ambas partes facilitacién al turista y gestin de seguridad del turismo; 4) Promover la implementacién de programas de intercambio para capacitar a estudiantes y profesionales de la industria del sector turismo de ambas Partes, incluyendo capacitacién de idiomas; c) Fomentar el turismo mediante Ia difusién de materiales informativos sobre eventos culturales en cualquiera de las Partes; £) Promover acciones para valoracién de la identidad de pueblos originarios, sus costumbres, valores, cultura y medio ambiente; 2) Colaborar de comin acuerdo en cualquier otro tema relacionado con el sector turismo.ARTICULO 3 AUTORIDADES CENTRALES Las Partes trabajarén conjuntamente para promover la cooperacién por medio de sus autoridades competentes para el cumplimiento cel presente acuerdo. ARTICULO 4 PROGRAMAS ESPECIFICOS ara la implementacién de este Acuerdo las Pa-tes promoverin el desarrollo de programas especificos de cooperacién, que incluirén: 8) objetivos claros, cronogramas para la implementacién, responsabilidades de los participantes, gestién informitica, recursos humanos y materiales, financiamiento, monitoreo y evaluacién de actividades y cualquier otra informacién que las Partes consideren relevantes. b) fomentar la participacién conjunta en actividades de mercado y promoci acuerdo con las posibilidades presupuestarias de cada Parte, ©) compartir experiencias exitosas y mejores pricticas, en particular sobre la planificacién de programas ¢ implementacién del desarrollo regional del turismo, de ARTICULO 5 PROPIEDAD INTELECTUAL Si como resultado de las actividades de 1a cooperacién bajo este Acuerdo se crean productos de valor comercial sujetos a derechos de propiedad intelectual, éstos serén regulados de conformidad con las respectivas leyes nacionales y convenios intemacionales sobre la materia de los cuales ambos scan parte. ARTICULO 6 PROTECCION DE LA INFORMACION Las Partes protegerfn la integridad de la informacién intercambiada de conformidad con este Acuerdo adhiriéndose a las disposiciones de las respectivas leyes nacionales.ARTICULO7 DISPOSICIONES FINALES El presente Acuerdo esté fundamentado en el “Acuerdo sobre un Marco de Negociacién y Medidas de Fomento de la Confianza entre Guatemala y Belice’, suscrito el 7 de septiembre de 2005, en el cual uno de los propésitos es el de mantener y profundizar las relaciones bilaterales amistosas hasta que el Diferendo Territorial, Insular y Maritimo sea resuelto de manera permanente. Este acuerdo también se fundamenta en el Mapa de Ruta para el Fortalecimiento de la Relacién Bilateral firmado en Washington, D.C. Estados Unidos de América, el 24 de enero de 2014 por los Ministros de Relaciones Exteriores de las Partes en el ‘que se convino elaborar un programa de actividades para el fortalecimiento de la relacién bilateral. El presente instrumento no constituiré renuncia total o parcial de la soberania sobre ningin territorio (terrestre, insular y maritimo) reclamado por cualquiera de las artes; ni ird en detrimento de derecho alguno de las Partes sobre dicho territorio; ni constituira precedente para el fortalecimiento o debilitamiento de la reclamacién de cualquiera de las Partes sobre ningun territorio. Cada una de las Partes reserva expresamente sus derechos con reapecto a sus reclamos de soberanfa sobre cualquier territorio (terrestre, insular o maritimo). Las Partes acuerdan que ninguna de ellas usaré contra la otra, en ningiin foro ante el cual su diferendo territorial sea Mevado en el futuro, el hecho de que cualquiera de las Partes haya aceptado, acordado, acatado o aplicado cualquiera de las medidas de fomento de la confianza. . Cualquier controversia relacionada con la aplicacién o interpretacién de este Acuerdo ser resuelta de manera amistosa por las Partes por la vie diplomatica. . Este Acuerdo entraré en vigor en la fecha en la que ambas Partes hayan recibido la notificacién respectiva por 12 via diplomética sobre el cumplimiento de sus respectivos requisitos legales intemos. El presente Acuerdo tendri una duracién de diez (10) aflos y se prorrogaré automaticamente por periodos iguales, salvo que alguna de las Partes, mediante notificacién escrita por la via diplomética, lo de por terminado, terminacién que surtird efecto un (1) aflo después de la notificacién respectiva,8. En ningtin caso la terminacién del Acuerdo afectard los derechos adquiridos por los. particulares en virtud del mismo. 9, El presente Acuerdo podré ser modificado de comin acuerdo por las Partes por escrito y por la via diplomatica. Las medificaciones entraran en vigor siguiendo el procedimiento establecido en el parrafo 6 de este Articulo. POR LA REPUBLICA DE GUATEMALA POR BELICE PROCURADOR GENERAL ¥ MINISTRO DE RELACIONES EXTERIORES JOSE MIGUEL INSULZA SECRETARIO GENERAL DE LA ORGANIZACION DE LOS ESTADOS AMERICANOS (TESTIGO DE HONOR)AGREEMENT BETWEEN BELIZE AND THE REPUBLIC OF GUATEMALA FOR SUSTAINABLE TOURISM Belize and the Republic of Guatemala, hereinafter referred to as “The Parties” CONSCIOUS that sustainabie tourism is a key factor in the development of the Parties; CONSIDERING that the promotion of sustainable tourism in Belize and Guatemala attracts large numbers of tourists and is important to share successful experiences in sustainable tourism; DESIROUS of enhancing cooperation in sustainable tourism between the Parties and creating reciprocal advantages beneficial to tourism development in both countries; RECOGNISING the importance of tourism for the promotion of economic and cultural evelopment between the Parties; TAKING INTO ACCOUNT regional initiatives including the Mundo Maya Organization, the Central American Tourism Council and s2ecific initiatives and cooperation projects for sustainable tourism development in the Maya region and other regional projects; ‘Agree as follows: ARTICLE 1 OBJECTIVE ‘The objective of the current Agreement is to enhance cooperation and collaboration in the tourism sectors based on equal rights and mutual benefits in compliance with the respective national laws and international commitments, to which the Parties are a pert of and to establish working mechanisms in order to srengthen the implementation of action plans and strategies of the Parties. ARTICLE 2 AREAS OF COOPERATION The current agreement will include the following areas of cooperation: a) Encourage the development of ini:iatives that promote tourism to increase flows with emphasis on meetings, incentives, conventions, and expositions; medical tourism, gastronomic tourism, luxury tourism, adventure tourism, naturebd) 4d) 8) tourism, sports tourism, sun and beach tourism, cultural tourism and tourism organized for groups, among others. Promote the image of the Parties by participating in seminars, conferences, exhibitions and symposia related to tourism and related issues, and any other action that provides potential for tourism development in both Parties. Encourage and support the exchenge of experiences, best practices, statistics, information materials on tourist destinations and other information of mutual interest to their tourism sectors, including but not limited to the following information: + tourism resources and studies related to the sector, + tourism policies and plans; + volume and characteristics of their potential tourism markets; + experiences on cultural, medical, rural and sustainable tourism; + experiences in the managirg of tourism infrastructure and development + routes and packages promcting multi-destination travel; + experiences in investment mechanisms for tourism development + research and development of tourism products and services; + systems for tourism access to both Parties, tourist facilitation and tourism security management; Promoting the implementation of exchange programs to train students and industry professionals of both Parties in the tourism sector, including language training; Encourage tourism through the dissemination of information materials on cultural events taking place in any of the Parties; Promoting actions for valuing indigenous identity, customs, values, culture and environment; Collaborate in any other areas related to the tourism sector as mutually agreed by the Parties. ARTICLE 3 CENTRAL AUTHORITIES ‘The Parties shall work together to enhance cooperation through their competent authorities in the fulfilment of this agreement,ARTICLE 4 SPECIFIC PROGRAMMES For the implementation of this Agreement, the Parties shall promote the development of specific cooperation programmes, which shall include: a). clear objectives, activities to develop schedules fer implementation, responsibilities of each of the participants, information management, human resource and materials, financing, monitoring and evaluation of sotivities, and any other information that the Parties consider relevant. b) encourage participation. in marketing and promotional activites together according to the budgetary possibilities of each Party. Bs ARTICLE 5 INTELLECTUAL PROPERTY If as a result of the cooperation activities under this Agreement, products of commercial value are created which are subject to intellectual property rights, these shall be regulated pursuant to the respective national legislation and international conventions on the eubject to which both are pacty. ARTICLE 6 INFORMATION PROTECTION ‘The Patties shall proteet the integrity of information exchanged accordance with the provisions of the respective national iaws der this Agreement in ARTICLET FINAL PROVISIONS i. The present Agreement is based on the "Framework Agreement for Negotiations and Confidence Building Measures between Belize and Guatemala,” signed on 7th September 2005, that has as an object:ve the maintenance and deepening of friendly bilateral relations until the Territorial, Inswlar and Maritime Dispute is permanently resolved,This Agreement is also based on te Road Map for the Strengthening of the Bilateral Relations signed in Washington, D.C. United States of America on 24th January 2014 by the Ministers of Foreign Affairs of the Parties, in which it was agreed to develop a programme of activities for the strengthening of the bilateral relations. ‘The present instrument shall not constitute a total or partial waiver of sovereignty over any territory (land, insular and maritime) claimed by either Party; nor shall any rights of either Party to such territory be prejudiced; nor shall any precedent be established for the strengthening or weakening of either Party’s claims to any such territory.. Each Party expressly reserves its rights with respect to its claims of sovereignty over any territory (land, insular or maritime). ‘The Parties agree that neither Party will use against the other, in any forum in which their territorial differendum may be addressed in the future, the fact that either of the Parties has accepted, agreed to, complied with or implemented any of the confidence building measures included herein, ‘Any dispute arising from the interpretation or application of this Agreement shall be resolved amicably through diplomatic channels. ‘This Agreement will enter into force on the date when both sides have received notification via diplomatic note that their respective legal requirements have been met, ‘The present Agreement will have a duration of ten (10) years and will be automatically extended for equal periods, unless any of the Parties, through written communication via diplomatic chanrels, revokes it, and the termination will be effective one (1) year after the respective notification. ‘The termination of this Agreement shall not affect the rights or benefits already acquired by the individuals by virtue cf this Agreement. This Agreement may be amended by mutual agreement of the Parties through vritten communications via diplomatic channels. Its entry into force will be in accordance with paragraph 6 of this Article.Done in Placencia, Belize, on December 17, 2014 in two original copies, in the Spanish and English language, both texts being equally authentic.
