AFFIDAVIT

I, KAREN D. VALENCIA, of legal age, widow, Filipino citizen and

residents of Brgy. Matayuncab, Gerona, Tarlac, after having been duly sworn
to in accordance with law, hereby depose and state - THAT:

1. I am one of heirs of the late LORENZO E. VALENCIA being his surviving

spouse, and with KIMBERLY KATE D. VALENCIA, JULIANE JAN D.
VALENCIA and LADY LEAH D. VALENCIA as our only children;

2. Consequently, I and our children executed a Deed of Extrajudicial

Settlement of Estate Among Heirs (with Waiver of Rights)1 on 12
December 2017 involving a parcel of land covered by TCT No. 043-
20170139372 registered in the name of deceased LORENZO E.
VALENCIA , in which we agreed to divide the subject real property as
follows:

a. 1/2 - to be equally divided among the children (KIMBERLY

KATE D. VALENCIA, JULIANE JAN D. VALENCIA and LADY
LEAH D. VALENCIA) by virtue of the waiver of KAREN D.
VALENCIA of her share in the 1/2 portion of the subject property
(or constituting 1/8 of the entire real property) representing the
conjugal share of deceased LORENZO E. VALENCIA; and

b. 1/2 - to be retained by KIMBERLY D. VALENCIA as her own

conjugal share.

3. The aforesaid intended division/partition of the subject real property is

clear from the provisions of the said deed, specifically the portion which
states that:

Resultantly, only the above-named 3 children
will divide (equally) the 1/2 conjugal share of the

involved, while the other half shall be retained by the
surviving spouse as her conjugal share as well.

4. Pursuant to the said Deed of Extrajudicial Settlement of Estate Among

Heirs, the registration and titling of the subject parcel of land ensued and
a new title, TCT No. 043-2018000508,3 was issued by the Register of
Deeds of the Province of Tarlac, and canceling in the process TCT No.
043-2017013937.

5. However, upon receipt and examination of the owner’s copy of TCT No.
043-2018000508, I was surprised to notice that my name as owner of the
1/2 portion of the entire parcel of land, which is the unequivocal intention
of the said Deed of Extrajudicial Settlement of Estate Among Heirs, was
not reflected as only our children - KIMBERLY KATE D. VALENCIA,
JULIANE JAN D. VALENCIA and LADY LEAH D. VALENCIA were
entered and made to appear as co-owners of the entire parcel of land.

6. I am therefore executing this Affidavit to attest to the truth of the forgoing

declarations and to notify the Register of Deeds and other concerned
government agencies about such fact and make them effect the
necessary rectifications in their records.
