The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):
COUNT I
Charge: Traffic - DWI - Alcohol-Related School Bus or Head Start Bus Driving; Crime Described
Minnesota Statute: 169A.31.1, with reference to:  169A.31.2(1)
Maximum Sentence: 1 year in jail, a $3,000 fine, or both

Charge Description: On or about 04/10/2018, within the County of Goodhue, State of Minnesota,
defendant drove, operated, or was in physical control of any class of school bus or Head Start bus within
the state when there was physical evidence present in the defendant's body of the consumption of any
alcohol, and while a child under the age of 16 is in the vehicle, if the child is more than 36 months younger
than the defendant, to wit: defendant operated a school bus, containing 58 children under the age of 16
and more than 36 months younger than the defendant, while having the presence of alcohol in his body.

STATEMENT OF PROBABLE CAUSE 4/12/2018 09:26:43 AM
Goodhue County, MN

 
The Complainant states that the following facts establish probable cause:
 
On April 10, 2018, at approximately 8:45 a.m., Goodhue County Sherriff’s Deputy and Pine Island School
Resource Officer Jeffrey Sjoblom, was speaking to High School Principal Mitch Schiltz in his office related
to an unrelated incident. At about 8:49 hours, Deputy Sjoblom observed BEAU JASON TWADDLE, DOB:
08/21/1978, School Transportation and Ground Director, walk by Principal Schiltz’s office. Deputy Sjoblom
and Principle Schiltz asked TWADDLE to come into Principal Schiltz’s office to talk about damage at the
elementary school. TWADDLE indicated that he was going to get more estimates for the damage. Deputy
Sjoblom noted that the conversation between himself, Principal Schiltz, and TWADDLE lasted about three
minutes. TWADDLE left Principal Schiltz’s office and followed by Deputy Sjoblom a few seconds later. As
Deputy Sjoblom was just about to the door of the office, he detected the odor of alcohol. Deputy Sjoblom
stopped and asked Principal Schiltz if he could smell the odor as well. Principal Schiltz stated he could not.
Deputy Sjoblom noted that no one else, besides TWADDLE, was in the area. 

After leaving the office, Deputy Sjoblom met with Superintendent Tammy Berg in the front lobby of the
school. Deputy Sjoblom informed Superintendent Berg that he detected the smell of alcohol after
TWADDLE had left Principal Schiltz’s office. 

At about 9:53 a.m., Deputy Sjoblom met with Principal Schiltz and Superintendent Berg in the district office
who advised Deputy Sjoblom to speak to TWADDLE to see if he had been drinking. At about 9:59 a.m.,
Deputy Sjoblom returned to his office and observed, that outside, along the curb in front of the school, was
a red plow pickup that Deputy Sjoblom knows TWADDLE sometimes drives. At the time, no one was in the
cab of the red plow truck. 

At about 10:03 a.m., Deputy Sjoblom left his office to look for TWADDLE. As Deputy Sjoblom entered the
lobby, TWADDLE approached Deputy Sjoblom from the Principal’s hall to talk about the damage at the
elementary school. As TWADDLE was talking to Deputy Sjoblom, Deputy Sjoblom detected the smell and
odor of alcohol emanating from TWADDLE’s person as he spoke. After taking notes, Deputy Sjoblom
asked TWADDLE to follow him back to the conference room. 

After entering the conference room, TWADDLE was stopped in the hallway by another staff member. After
TWADDLE entered the conference room, Deputy Sjoblom advised that he needed to ask TWADDLE a
question. Deputy Sjoblom told TWADDLE, softly, that he could smell alcohol. Deputy Sjoblom asked
TWADDLE when the last time was that he had a drink. TWADDLE stated “two days ago.” Deputy Sjoblom
told TWADDLE that he could smell a strong odor of alcohol coming from TWADDLE. TWADDLE asked
Deputy Sjoblom if he wanted him to go in and get tested. Deputy Sjoblom asked TWADDLE if he was
willing to give a Preliminary Breath Test (PBT). TWADDLE agreed. Deputy Sjoblom asked TWADDLE if
he was okay with another deputy coming to give TWADDLE a PBT test. Again, TWADDLE agreed. 

While waiting for another deputy to arrive, Deputy Sjoblom observed that TWADDLE had chew in his
mouth and requested that TWADDLE get rid of it. Deputy Sjoblom asked TWADDLE if there were any
bottles of alcohol anywhere, to which TWADDLE stated that he had mouthwash in his personal vehicle at
the bus garage.

At about 10:08 a.m., Deputy Mitch Grabau arrived on scene. Deputy Sjoblom informed TWADDLE of his
observations of TWADDLE and advised TWADDLE that he suspected TWADDLE had been drinking.
TWADDLE initially said that he had not been drinking and that the last time he had drank any alcohol was a

couple of days prior. Deputy Grabau observed that TWADDLE was shaking badly. TWADDLE said that he

was nervous. Deputy Sjoblom asked TWADDLE if he would do a PBT test and TWADDLE said that he
would because he had not been drinking. While Deputy Sjoblom was speaking with TWADDLE, Deputy
Grabau could smell a strong odor of alcohol coming from TWADDLE. Deputy Grabau observed that
TWADDLE’S eyes were bloodshot and watery. 

Deputy Grabau retrieved his PBT and instructed TWADDLE to blow into it. TWADDLE provided an
adequate breath sample with the result being a .10 breath alcohol concentration (BrAC). TWADDLE said
he didn’t know how that was possible and denied having been drinking. TWADDLE was again asked when
the last time he had drank any alcohol was and TWADDLE said that he had a drink the night before at
approximately 6:00 p.m. and that he had drank vodka water and a beer.

Deputy Sjoblom asked TWADDLE if he had a water bottle in the truck out front. TWADDLE stated that he
did. Deputy Sjoblom had observed TWADDLE drinking out of a water bottle before while in a plow truck.
Deputy Sjoblom asked TWADDLE if he could check the water bottle. TWADDLE said yes. 

At that point, Deputy Sjoblom informed Deputy Grabau that TWADDLE had been driving the school vehicle
as well. TWADDLE did not deny driving the vehicle. Deputy Sjoblom realized that he could check the
school’s surveillance video to see if TWADDLE had driven to the front of the school in the plow truck while
under the influence. 

Deputy Grabau escorted TWADDLE out to his squad and placed TWADDLE in the back. Deputy Grabau
escorted TWADDLE to the bus garage to have him perform field sobriety testing away from everyone that
was in the school office. 

The first test that Deputy Grabau had TWADDLE complete was the Horizontal Gaze Nystagmus (HGN).
During testing, Deputy Grabau observed that TWADDLE had equal pupil size in both eyes and that
TWADDLE’S eyes were tracking properly. Deputy Grabau did not observe any clues during the test.

Deputy Grabau then demonstrated and explained the walk and turn test to TWADDLE. During the walk and
turn test, Deputy Grabau observed that TWADDLE used his arms for balance and made an improper turn.

Deputy Grabau then demonstrated and explained the one leg stand test to TWADDLE. During the one leg
stand test, Deputy Grabau observed that TWADDLE swayed while balancing.

After completing field sobriety, Deputy Grabau had TWADDLE give another PBT sample. Deputy Grabau
noted that TWADDLE gave an adequate sample with the result being a .09 breath alcohol concentration
(BrAC). Deputy Sjoblom asked TWADDLE if he knew what the legal limit was, to which TWADDLE
responded “.08.” 

TWADDLE said the results were weird to him. TWADDLE made a reference about how the level had
dropped in a matter of 15 minutes and further stated that he had not been drinking that day. Deputy
Sjoblom advised TWADDLE there still could be alcohol in his system from the last time he drank. 

Deputy Sjoblom then asked TWADDLE if had drove bus in that morning. TWADDLE said “yep.” Deputy
Sjoblom asked TWADDLE if the bus was a commercial vehicle. TWADDLE said that it was. Deputy
Grabau asked TWADDLE if he knew what the legal limit was for a commercial vehicle. TWADDLE said
“.04,” but then stated there was zero tolerance for school bus drivers. 

Deputy SjoblomI told TWADDLE the PBT was only Preliminary Breath Test and that TWADDLE would be
taken to Zumbrota for a breath test, which is an official test. Deputy Grabau said he would find an operator

Deputy Grabau placed TWADDLE under arrest and handcuffed TWADDLE. Deputy Grabau then placed
TWADDLE in the backseat of his squad and transported TWADDLE to the Zumbrota Police Department.

Upon arrival at the Zumbrota Police Department, Deputy Grabau at 11:03 A.M., began to read TWADDLE
the Commercial Vehicle Breath Test Advisory. Deputy Grabau asked TWADDLE if he understood what
Deputy Grabau had explained to him and TWADDLE said “yes sir.” Deputy Grabau asked TWADDLE if he
wished to consult with an attorney and TWADDLE said “no sir.” Deputy Grabau asked TWADDLE if he
would take the breath test and TWADDLE said “yes sir.” Deputy completed reading the Commercial
Vehicle Breath Test Advisory to TWADDLE at 11:05 A.M. 

Officer Gary Schroeder from the Zumbrota Police Department assisted with running the DMT breath test.
At 11:13 A.M. and 11:17 A.M., TWADDLE provided the two required breath tests, which were noted as
being deep breaths with hard and steady blows. The reported value of TWADDLE’s breath samples
showed as being a .08 BrAC at 11:13 A.M. 

Deputy Grabau then transported to TWADDLE to the Goodhue County Adult Detention Center. TWADDLE
was subsequently transported to Detox.

On April 11, 2018, at approximately 8:30 a.m., Deputy Sjoblom reviewed surveillance video to verify when
TWADDLE dropped kids off at the high school. Deputy Sjoblom noted that the video showed at about 7:34
a.m. on April 10, 2018, TWADDLE drove school bus number 11 into his bus parking spot behind the high
school. At about 7:38 a.m., TWADDLE is observed getting out of the driver’s seat and exiting the bus.
TWADDLE walked over to and enters another bus. TWADDLE does not stay in the other bus very long,
returns to bus 11, and sits back down in the driver’s seat. 

At about 7:44 a.m., students are observed beginning to exit bus 11. A total of 58 students exited the bus
with the last one exiting at about 7:47 a.m..

At about 7:49 A.M., TWADDLE drove away in bus 11 while following the other buses that returned to the
bus garage. TWADDLE is not observed leaving the bus garage until 8:40 A.M., when TWADDLE drives a
red ford plow truck from behind the bus garage to a location where a new apartment building being built
approximately a half block from school. TWADDLE leaves the pickup and goes over towards the office
trailer. TWADDLE then leaves the trailer accompanied by an unknown person and walks towards Main
Street. At about 8:46 A.M., TWADDLE is observed getting back into the pickup and driving to the front of
the school, at which time, TWADDLE exits the truck and enters the school at 8:47 a.m. 

At about 8:49 A.M., TWADDLE leaves the school lobby and heads towards the administration hall, at which
time, Principal Schiltz and Deputy Sjoblom meet with TWADDLE in Principal Schiltz’s office.
