AFFIDAVIT OF SHAWN SCHUBERT

I, Shawn Schubert, of legal age, a British citizen, married

and residing at 128 St., Maple St., Oxford Blvd. ,London after
having been duly sworn to in accordance with law, avers:

1. That I am the Record Officer of Marine Agency Limited with

office address at Bilbao House, 36/38 New Board St. and
have been employed with the said Agency from 2001 up to
present.

2. That as part of my Job Description, one of my duties is to

be responsible for the Company’s records , classification
and storage schemes, regardless of media or physical
format. This particularly includes e-mail, spreadsheets,
word processing documents, databases, image files, and
paper and microfirm records.

3. That having the said job description, I receive for and in

behalf of the company, letters, notifications and other
forms of packages, keep custody of the said items as well
as release them when requested by appropriate officers of
the company.

4. That Juan P. Masipag entered into a Contract of Guaranty

to secure the obligation of Hongkong-Philippine
International Navigation Services Limited with the latter’s
Contract of Sale contracted with West Eagle Limited.

5. That our company, Marine Agency Limited was appointed

as agent by Juan Masipag for the above-mentioned
Contract of Guaranty.

6. That as agent of Juan Masipag, we have never received

nor is there any record showing in our Official Logbook of
In-Coming Correspondence that summons or any other
court process has ever been received by our office in
 relation to the civil action filed by Western Eagle Ltd
against Juan Masipag.

7. That I executed this affidavit to attest the truthfulness of

the aforementioned facts and in support of our client, Juan
P. Masipag in the case filed against him by the Western
Eagle Limited denominated as CIVIL CASE NO. 2015-1
which is FOR ENFORCEMENT OF A FOREIGN JUDGMENT.
