The Worst

We all have met a person whether we know it or not who has

a record of breaking the law. Some of these people may have a

stigma as a bad person or a person to stay away from. That is

not the case for every criminal, but a sexual predator is

something that sticks with that person for life. Anyone can look

up a website on the internet and see who’s a predator in their

specific neighborhood. It is quite a frightening and scary thing

to see in a place where you raise your children and families.

You may not be aware that your neighbor is convicted of such a

serious crime and would never know if these websites we not

available. I believe that the incarceration lengths of sexual

predators are to short for the life changing emotional wrecking

crime that has been committed. There are different types of

convictions to be labeled as. The typology of a rapist is

classified as an uncontrollable urge or action that they wanted.

Although, a child abuser is usually classified with a mental

illness or lack social and emotional skills (Simons). I want to

find out why these offenders get less sentencing than a person

who gets caught stealing or another small non-sexual charge.

Many people have the opinion of sentencing and how the

length for most predators is too short. Specifically, in Ohio

there are five categories on how sexual crimes are categorized.

There is Gross sexual imposition, Rape, Sexual Battery, Sexual

imposition, and unlawful sexual conduct with a minor. Depending

on the charge your sentence can be probation and up to eight or

nine years of incarceration.

The first charge a predator could be found guilty of is

gross sexual imposition. This crime is in which a person has

sexual intercourse while the other is impaired or is not clear

minded. The fourth degree is on average six to 18 months in

prison. While third degree is drugging and intentionally

impairing a victim. Also, there is a second part dealing with

minors and the age of consent.

“Cause (ing) someone else to have sexual contact with victim, and

the offender touches the genitalia of victim less than 12 with

intent to abuse, humiliate, harass, degrade or arouse or

gratify”. (Gross Sexual Imposition)

I personally believe that these sentences especially if

committed to a minor or child should be much longer than 6

months to six years.

Rape is counted as a felony is Ohio courts. The felony of

first degree rape has multiple parts that a predator can be

convicted of. The first is a “‘victim’s ability to resist or

consent is substantially impaired”. Also, “control by

administering any drug, intoxicant, or controlled substance to

the other person surreptitiously or by force” (Gross Sexual

Imposition). If the predator used force against a child under 10

they will have life in prison with the chance or parole or not.

On the other hand, if the victim is over the age of ten it could

be not less than five years.

Sexual Battery is the third of the five types of sexual

abuses you can convicted of. The sexual battery definition has

multiple degrees. Felony of the second degree is statutory and

is the sexual act on a child of 13 years or younger. The time n

prison for these people is on average two to eight years in

prison. Felony of the third degree has a substantial amount of

information in Ohio for rules and stipulations. The sexual

conduct should not be with another person besides a spouse

“unless” the offender is a cleric and sexual conduct with a

minor, peace officer and someone less than 2 years older,

teacher and student, coach and player, employee of a detention

center and a detainee and the list goes on. The punishment

average is one to five years in a prison.

Sexual imposition is less in terms of time in prison and

only counts as a misdemeanor. Misdemeanor of the first degree is

when a person shall not have sexual contact with another when

not convicted of another sexual assault. This first degree has a

punishment of 6 months in prison. Third degree is defined as no

sexual contact with a minor of thirteen years of age, but also

states that they cannot be “less than sixteen years of age and

the offender is at least eighteen years of age and four or more

years older than such other person” according to Ohio Sexual

Assault.

Lastly, unlawful sexual conduct with a minor has severity

from first through fourth degree. All of which result in a

felony on the persons record and are statutory; except of first

degree which is a misdemeanor. First degree is when a person has

conduct with a person who is 13 years or older but not older

than 16. They also could be reckless in regard of knowing the

victim is under 16 and the convict is less than four years

ealry. The time in jail is a max of six months. Second degree

felony is the same as first degree but has been convicted of a

sexual conduct charge previously. This incarceration time is on

average two to eight years in prison. Felony of the third degree

is also the same as first, but the convict is ten years older

than the victim. Lastly, fouth degree of unlawful sexual conduct

with a minor is when the predator or convict know the age of

their victim but is reckless. The average prison time is six to

eighteen months.

I believe that most of the incarceration times and averages

of most sexual crimes are a good amount of time, but I highly

disagree with the times that effect minors. Minors are so

impressionable, and they do not know how, nor do they know what

is happening to them is wrong. Some kids are so innocent and

have much to learn they do not know it is wrong. On the other

hand, recently there has been celebrities and the Olympic

Gymnastics doctor who have taken advantage of minors and young

adults. The stress and hardship Larry Nassar has put these young

men and women through is horrific. He abused ove3r 160 children

and young teens over his more than 20 year career with Michigan

State and the U.S.A Olympics. Larry brainwashed his victims with

methodologies and ideas that these young girls and boys did not

get. They did not know right from wring until they got older.

None of his victims found help because of Larry’s credentials

and high status. According to New York times and victim of

Nassar “I reported it. Michigan State University, the school I

loved and trusted, had the audacity to tell me that I did not

understand the difference between sexual assault and a medical

procedure”(Correa). The reason some victims are afraid to come

out are the exact scenarios that happened to these women. No one

believed them, and nothing was being done to stop his sexual

rampage.

We are now seeing predators try and evade the law by going

online with fake profiles to lure small naïve children to them.

The age of technological advancements is a great thing, but also

has many setbacks within. The internet is an easier and more

secret way for predators to find and take advantage of anyone.

There is a less serious problem related which is catfishing.

Catfishing shows how easy it is to be a fake person online.

Catfishing is making a fake account on any social media to talk

to someone, but the other person thinks you are someone else.

To go along with online threats to young children there is

also the threat of suffering alone. So many children and woman

keep silent due to the fear that is instilled in the victim. A

scaring fact from the National Crime Victimization Surveys is

that only 12% of children being sexual assaulted are reporting

it (Myths). Only a fraction of predators are caught. This means

the children and adults must go through a sick experience

probably more than once. There are many different statistics

with how many victims let someone know about their abuse, but

all percentages are under 30%. I mentioned earlier that most

predators are family members or live within a mile of the

victim.
