The Complainant submits this complaint to the Court and states that there is probable cause to believe

Charge Description: On or about December 18, 2017, within the County of Olmsted, Byron Clarence Rush
and Dushawn Lee Minor, intentionally aided, advised, hired, counseled, conspired or otherwise procured
each other to commit a crime and each aiding the other, having knowledge of not being entitled thereto,
did wrongfully, unlawfully and feloniously take personal property from the person or in the presence of
another, to-wit: Victim 1 and Victim 2, and used or threatened the imminent use of force against any
person to overcome the person's resistance or powers of resistance to, or to compel acquiescence in, the
taking or carrying away of the property and Byron Clarence Rush and/or Dushawn Lee Minor was armed
with a dangerous weapon or any article used or fashioned in a manner to lead the victim to reasonably
believe it to be a dangerous weapon.

STATEMENT OF PROBABLE CAUSE 3/14/2018 08:41:14 AM

The Complainant states that the following facts establish probable cause:
 
Your complainant is a licensed peace officer employed by the Rochester Police Department. In that
capacity your Complainant has reviewed the police reports relating to Byron Clarence Rush, the above-
named defendant, and the allegations contained therein. Based upon that information, your complainant
believes the following to be true and correct.

At approximately 10:40 p.m. on December 18, 2017, officers responded to Sun Tan City, 3430 22nd
Avenue NW, Rochester, Olmsted County, Minnesota, for a reported robbery. Upon arrival, officers met with
an adult female (hereinafter “Victim #1) and an adult male (hereinafter “Victim #2). Victim #1 was sitting
upright on the floor, crying and bleeding from the top of the head. Victim #2 was attending to Victim #1.

Ofc. Stevens received the following account from Victims #1 and #2. Victim #1 worked at the store and
locked the front doors at 10:00 p.m. She finished other closing tasks and checked out at 10:36 p.m. Victim
#2 was sitting in his car outside the store, waiting for Victim #1. As Victim #1 exited the store and locked
the front door with a key, a male rushed up to Victim #1 and told her to open the door. Victim #1 could see
that the male had a large gun. At the same time, a second male knocked on Victim #2’s driver’s door
window and pointed a gun at him. Victim #2 saw the male holding a gun on Victim #1 and saw a third male,
as well. Victim #1 opened the door again and went back inside to the office where the safe was located.
Victim #1 was shaking too much to open the safe, even though the man was yelling at Victim #1 to open
the safe. The male then hit Victim #1 on the head with the gun, causing Victim #1 to feel woozy. As Victim
#1 tried again to open the safe, another male came into the office and tried to get Victim #1 to open the
safe. Victim #1 never opened the safe. The males then left the store, taking cash and a mobile phone from
Victim #1’s purse. The three men also took Victim #1 and Victim #2’s car and drove away. All three
suspects had their faces covered during the robbery. Officers reviewed the video surveillance from Sun Tan
City. The video shows the robbery as described by Victim #1 and Victim #2. 

Victim #2 had reported to officers that he saw one of the suspects come from a driveway between 3506
and 3512 22nd Avenue NW. Ofc. Red Hill responded with his K9 partner, Kola and commanded Kola to
track. Kola tracked from that location around the north side of 3561 21st Avenue NW and then east toward
21st Avenue NW. Kola tracked to the area of a maroon Pontiac G6 that was parked on 21st Avenue NW,
facing south. The Pontiac G6 was unoccupied and the driver’s window was partially down. Ofc. Red Hill
could smell a strong odor of marijuana coming from the Pontiac G6. Ofc. Red Hill had Kola perform a
narcotics search of the vehicle, and Kola alerted on the Pontiac G6. The Pontiac G6 was towed to the LEC
garage so a search of the vehicle could be conducted. The search of the Pontiac G6 revealed a black
Taurus Millenium .40 caliber semi-automatic handgun under the back seat. There was a loaded magazine
in the handgun with a round in the chamber. Next to the handgun was a box of .40 caliber ammunition.

Later on December 18, 2017, DUSHAWN LEE MINOR (DOB 9/24/1996) called in to report as stolen his
Pontiac G6. MINOR told dispatch that he was calling from southeast Rochester, but dispatch was showing
that his phone was located in the area of 3524 22nd Avenue NW. MINOR’s location never moved even
though he was telling officers that he was in different locations. Very shortly after MINOR called in his
Pontiac G6 as stolen, officers located MINOR behind 3561 21st Avenue NW. Minor did not answer several
questions posed by officers and deflected others. MINOR was then transported to the Government Center
and interviewed by Ofc. Schlag. MINOR denied any involvement in the robbery, claiming that he was asleep
in southeast Rochester at the time of the robbery. MINOR stated that he thought a person named
“Jeremiah” framed him for the robbery. MINOR then backtracked, saying he was not sleeping, but that he

said he was sleeping because he did not have much information to provide. Ofc. Schlag’s interview with

MINOR lasted over two hours and MINOR’s version of events changed numerous times. As he had been
promised, MINOR was released at the end of the interview.

After additional evidence was developed, MINOR was again arrested on December 25, 2017. Ofc. S.
Beery interviewed MINOR who stated that he lied to Ofc. Schlag about the events of December 17, 2017
because he was scared and did not want to cause any drama. MINOR admitted to Ofc. Beery that he was
at an apartment near Sun Tan City, arriving between 9:30 p.m. and 10:00 p.m. According to MINOR, he ran
into a couple people that were taking about doing a robbery. However, MINOR continued to deny
involvement in the Sun Tan City robbery, claiming he went back to his friend’s apartment. MINOR was
released on December 27, 2017.

MINOR consented to a search of his Apple Iphone 6s and gave Ofc. S. Beery the passcode. The forensic
examination of MINOR’s phone provided multiple pieces of evidence:

-On December 18, 2017, there were Google searches for “sun tan city” and “sun tan coty” [sic] at 10:27
p.m. and 10:26 p.m., respectively. (The Sun Tan City robbery began at 10:38 p.m.)

-Taken on December 16, 2017, there is a photo of a MINOR pointing a handgun at the camera.

-Taken on December 15, 2017, there is a selfie video of MINOR walking and talking. MINOR lowers the
camera to show his waistband, then lifts his sweatshirt to reveal two semi-automatic handguns. One of the
guns appears to be the handgun recovered from MINOR’s vehicle on December 18, 2017. The other
handgun matches the description given by Victim #2 of the handgun used to threaten Victim #2 during the
Sun Tan City robbery.

-Taken on December 13, 2017, there is a video that depicts Timberland boots. The boots are black and
have a shiny gold strip all around the top opening. The boots in the video appear to be the same boots that
MINOR was wearing when arrested. Additionally, Ofc. Beery reviewed the surveillance video from Sun Tan
City and noticed that they appear to be the same boots worn by the suspect who entered the business with
Victim #2. 

-Taken on December 9, 2017, there is a selfie video. MINOR is depicted in a residence. Two other males
come into camera view. One of the males has facial hair and is wearing a black hooded sweatshirt. Both of
those characteristics match a suspect from the Sun Tan City robbery and a robbery at the Fairfield Inn and
Suites that occurred on December 9, 2017 (ICR #17-59548).

-Taken on December 2, 2017 at 12:11 p.m., there is another selfie video. The video depicts MINOR and
shows a semi-automatic handgun with an extended magazine sticking out of MINOR’s left pants pocket.

-Taken on December 2, 2017 at 11:55 a.m., there is another selfie video. The video depicts MINOR holding
a semi-automatic handgun. MINOR points the handgun at the camera.

-Taken on December 2, 2017 at 11:54 a.m., there is another selfie video that shows MINOR and another
male handling semi-automatic handguns with extended magazines. 

-Taken on December 2, 2017 at 8:17 a.m., there is another selfie video that shows MINOR pulling out a
semi-automatic handgun from his waist area.

At the time Ofc. Beery reviewed the December 9, 2017 selfie videos on MINOR’s mobile phone, he did not
know the identity of the individual wearing the black hooded sweatshirt. The sweatshirt had a zipper up the

entire front of the sweatshirt and appeared to have a small, red, Ralph Lauren polo-rider logo on the left

side. The suspect was swearing white Nike shoes with black laces and a black “swoosh” logo. 

On Thursday, January 4, 2018, MINOR was re-arrested for the Sun Tan City robbery. MINOR was again
wearing the Timberland boots that are unique and strongly resemble the boots shown in the Sun Tan City
surveillance video. MINOR chose not to add information to his previous interview with Ofc. Beery.

On Thursday, January 4, 2018, a search warrant was executed at a residence at 3524 22nd Avenue NW,
#2. When officers executed the search warrant, the unidentified suspect from the December 9, 2017 selfie
video was present and identified as BYRON CLARENCE RUSH (dob 10/1/92). Also located at the
residence were a black zip-up sweatshirt and white Nike shoes that matched the garments worn by the
suspect in both the Fairfield Inn robbery on December 9, 2017 and the Sun Tan City robbery. RUSH was
arrested and was wearing black sweatpants that matched the garment worn by the suspect in both
robberies. When asked if white Nike shoes were his, RUSH admitted that they were. 

RUSH was charged with the Fairfield Inn robbery in Olmsted County District Court File No. 55-CR-18-296.
That matter was scheduled for trial on March 12, 2018. In preparation for trial, Ofc. Beery closely examined
and the sole of the white Nike Air Force One shoes belonging to RUSH and suspected to be worn by
RUSH during both the Fairfield Inn and Sun Tan City robberies. Ofc. Beery noticed that RUSH’s Nike shoes
bore a distinctive concentric-circle tread pattern on their soles. Ofc. Beery remembered that, during the
investigation of the Sun Tan City robbery, officers found distinct and clear foot prints near the front door of
the Sun Tan City store. Ofc. Beery compared the photos of the Sun Tan City foot prints to RUSH’s Nike Air
Force One shoes and noted that they had the same concentric circle tread pattern.
