Resumo
O presente artigo reproduz os resultados preliminares de uma
análise comparativa que permitirá visualizar quantitativamente,
com números e estatísticas mais objetivas, a situação do sistema
judicial brasileiro, a fim de aferir o grau do seu desenvolvimento
tanto em relação a países europeus com indicadores de eficiência
judicial de melhor qualidade como em relação a países com
indicadores inferiores qualitativamente. O estudo comparativo
também pretende focar sua atenção sobre países com
características mais próximas ao caso brasileiro, ou seja, países
continentais com população de uma ou duas centenas de milhões
de habitantes. Este painel comparativo pretende aferir em quais
itens o sistema judicial brasileiro avançou mais em relação a outros
Abstract
This article reproduces the preliminary results of a comparative
analysis which aims to visualize quantitatively, through numbers
and statistics, the situation of the Brazilian judicial system, to
visualize the degree of its development in relation to European
countries. The comparative study also intends to focus its attention
on countries that have closer characteristics to the Brazilian judicial
system, and continental countries with populations of one or two
hundred million. This research aims to show, in a comparative
panorama, which points the Brazilian judicial system is more
advanced compared to other countries, such as which items need
better performance, an analysis that promises many interesting
results. The methodologies and indices adopted by the CNJ and
reports by the European Commission for the Efficiency of Justice
- CEPEJ are similar. The performance of the CNJ, as an inducer
of reform policies of the Brazilian Judiciary, is about to complete
one decade. Therefore, we must evaluate the results achieved in
these years in a comparative and globalized perspective.

1 Introdução
O Conselho Nacional de Justiça-CNJ, através do seu
Departamento de Pesquisas Judiciárias, vem produzindo e
divulgando ao longo dos últimos anos relatórios estatísticos anuais
sobre o sistema judicial brasileiro, através do seu sistema
denominado “Justiça em Números”. Os relatórios praticamente
não existiam nos anos 90 ou eram produzidos de forma muito
fragmentária. Atualmente, com os relatórios “Justiça em
Números” produzidos pelo CNJ, já é possível visualizar o sistema
judicial brasileiro através de dados mais consistentes, os quais
permitem um conhecimento mais exato da realidade do Poder
Judiciário no Brasil.
Outros sistemas judiciais com maior tradição de planejamento e
organização, como os de países da União Européia e dos Estados
Unidos, divulgam há mais tempo seus relatórios. Na Europa temos
a CEPEJ - European Commission for the Efficiency of Justice (Comissão
européia para a eficiência da Justiça) e seu relatório “European
judicial systems Edition 2010 (data 2008): Efficiency and quality of
justice”; nos Estados Unidos temos os relatórios do NCSC -
National Center for State Courts (www.ncsc.org).

On average, at the European level in 2008, the first instance courts were able to
resolve more or less (slightly more) the same number of cases than the number of
new incoming cases: in average 2.203 incoming cases per 100.000 inhabitants and
2.289 resolved cases per 100.000 inhabitants. Nevertheless, at the state or entity level,
main variations can be highlighted.

When considering the volume of civil (commercial) cases addressed by first instance
courts, serious discrepancies can be noticed according to the member states. Citizens
seem to be more prone to go to court to solve disputes (more than 3000 new cases
per 100.000 inhabitants) in the Central and Eastern European states (Russian
Federation, Lithuania, Czech Republic, Croatia), South-eastern European states
(Bosnia and Herzegovina, Romania, Serbia) and in the countries of the South of
Europe (Italy, Portugal,
Spain) than in the countries of the North of Europe (Finland, Norway, Sweden) and
the states of the Caucasus (Georgia, Azerbaijan, Armenia) where less than 1.000 new
cases were filed per 100.000 inhabitants per year. This report is not the place for a
sociological analysis of these trends, but it might be useful to exploit this information
