NOTE:

The A.P. Charitable Hindu Religious Institutions and


Endowments Act No.30/1987 came into force on 28-05-1987 to amend
the law relating to the Administration and Governance of Charitable and
Hindu Religious Institutions and Endowments in A.P. State. In the year
1987, the Government of AP has enacted Act 30/87, for administration
of Hindu Religious Charitable and Endowments Institution in A.P. By the
Act 30/87, the Government of AP has abolished mirasi rights.

Subsequently, the Government of Andhra Pradesh in


G.O.Ms.No:1171, Rev [Endts-I] Department, dt.16.12.1987 prescribed
certain qualifications and method of recruitment and retirement age for
Endowments Archakas and other office holders and servants. Provided
that physically unfit person may be retired before the age of
superannuation. The rules relating to the Service conditions of the office
holders and servants of the Tirumala Tirupati Devasthanams framed
under Sub-Section [4] Section 35 shall apply to the Archakas and other
office holders and servants in respect of matters other than those
expressly provided.

As the Hon’ble Supreme Court of India in the interim directions


Dt.22.06.1987 suspended the operation of the provisions of Sections 34,
35, 37, 39 &144 of the Endowment Act 30/1987 and ordered to maintain
status-quo, because of the said directions of the Hon’ble Supreme Court
of India, the G.O.Ms.No.1171, Revenue [Endts-I] Dept., Dt.16.12.1987
was not implemented in TTD, till the disposal of Writ Petition
No.638/1987, Dt.21.03.1996.

As per judgment Dt.19-03-1996 a three man committee has been


constituted for rationalization of pay scales of archakas and others in
TTD temples vide G.O.Ms.No.688, Revenue [Endt-I] Dept., Dt.17-05-
1996 and the entire hereditary services existed prior to 28-05-1987 are
treated as secular by the Hon’ble Supreme Court and any one can be
appointed subject to fulfillment of qualifications as envisaged in section
36 of the Act No.30/1987 and the rules made there under from time to
time. As per the above judgment only the honours to be continued to
mirasidar families under Section 142 of the Act No.30/1987.

As the matter stood thus, the TTD management served Notices


to the erstwhile Archakam Mirasidars calling for willingness to serve in
TTD Temples in accordance to the qualifications specified in
G.O.Ms.No.1171, Rev [Endts-I] Department, dt.16.12.1987, and
G.O.Ms.No.855, Rev [Endt-I], Dept, Dt.08-10-1997.

The report of the three men committee which was constituted by


the Government of A.P. for rationalization of the pay scales of Archakas
and others in TTD was also approved by the Supreme Court. After that
the government had created certain religious posts in G.O.Ms.No.855,
Rev [Endt-I], Dept, Dt.08.10.1997.

Previously the management of TTD has taken a decision to


ascertain the information regarding the age of erstwhile mirasidars, so as
to take a decision regarding retirement age of archakas. Accordingly,
Circular Dt.18.09.12 was issued to all the HODs / HOSs concerned
requesting to arrange to furnish the age proof particulars in respect of all
Archakas.

The government in G.O.Ms.No:611, dt.16.10.2012 amended the


TTD Service Rules 1989 and incorporated the post of putu worker
Senior and Junior etc., in it. The Government in the said G.O clearly
stated that the age of Religious staff is 65 years. This was done as per
provisions of G.O.Ms.No:1171 Rev.Endts-III Department dt.16.12.1987.
Basing on the above said provisions of G.Os, orders were issued in
Proc.Roc.No.TS3/18528/2010, Dt.28.01.2013 & 15.02.13, retiring the
following three members of erstwhile mirasi archakas as the recorded
evidence is available departmentally that they crossed more than 65
years of age. Accordingly, they were relieved:

1. Sri A.B. Bhaktavatsalam, Erstwhile ArchakaMirasidar working as


Archaka inSri PAT, Tiruchanoor [28.01.1013].

2. Sri A.S. NarasimhaDeekshitulu, Erstwhile ArchakaMirasidar


working as PradhanaArchaka in Sri G.T., TTD, Tirupati.
[15.02.2013].

3. Sri A. Rama Chandra Deekshitulu, Erstwhile ArchakaMirasidar


working as Archaka in Sri T.T., Tirumala. [15.02.2013].

Aggrieved by the retirement orders, the above mentioned


individuals have approached the Hon’ble High Court of A.P with a prayer
to set aside the order of the management vide W.P.No:6949/2013 and
8690/2013. The Hon’ble High Court of A.P in two interim orders
dt.04.03.2013 and dt.08.03.2013 in W.P.M.P No:7904/2013 in W.P
No:6324/2013 filed by Sri A.B.Bhaktavatsalam, Archaka, Sri PAT,
Tiruchanoor and in W.P.M.P.No: 8690/2013 in W.P.No:6949/2013 filed
by Sri A.S.NarasimhaDeekshitulu, PradhanaArchaka, Sri G.T, Tirupati
and Sri A.RamachandraDeekshitulu, Archaka, Sri TT, Tirumala
respectively has ordered as follows:

“The Petitioners shall be permitted to render


Archakatvam service in Sri PadmavathiAmmavari
Temple, Tiruchanoor, / Sri Govindaraja Swamy
Temple, Tirupati However, they shall not claim any
emoluments including “Sambhavana” until further
orders”.

Accordingly, they are permitted to render Archakatvam


service in their respective places however; they shall not claim any
emoluments including “Sambhavana” until further orders.

Proposals were placed before the TTD Board fixing certain


modalities and guidelines to the erstwhile archaka mirasidars . The TTD
Board in Res.No:101, dt.13.07.2013 ‘DEFFERED’ the subject for in-
depth study. The connected file is under process.

In the representation, dt.17.07.2013 both Sri A.S.Narasimha


Deekshitulu, Pradhana Archaka, Sri G.T., and Sri A.Ramachandra
Deekshitulu, Archaka, Sri G.T., have requested the Executive Officer,
TTD to pay sambhavana to them.

While processing the file on the above requests, the D.L.O,


TTD, Tirupati while offering his remarks on the above subject, since this
subject is pending before the Hon’ble High Court of A.P, he opined as
follows:
“Article 39(a) of the Constitution of India, which is one of the
directive principles of State Policy, imposes a duty on TTD to
secure the right of the citizens, men and women equally, to an
adequate means of livelihood. Therefore, Sri A.S.Narasimha
Deekshitulu and Sri A.Ramachndra Deekshitulu can be paid under
the above respective packages, subject to the outcome of the said
writ petition and without prejudice to the rights and contentions of
the TTD in the said writ petition. So also, TTD is not restrained to
report before the court in the said writ petition, if any of them or all of
them is physically unfit to do archakatvam”.

Hence, above subject is placed before the TTD Board, for


taking a decision on payment of sambhavana at the same rates at which
they were paid before they were retired to the following archakas subject
to outcome of the W.P No:6324/2013 W.P.No:6949/2013 filed by the
following petitioners respectively for the period worked.
1. Sri A.B. Bhaktavatsalam, Erstwhile
ArchakaMirasidar working as Archaka in Sri
PAT, Tiruchanoor.

2. Sri A.S. NarasimhaDeekshitulu, Erstwhile


ArchakaMirasidar working as PradhanaArchaka
in Sri G.T., TTD, Tirupati.

3. Sri A. Rama Chandra Deekshitulu, Erstwhile


ArchakaMirasidar working as Archaka in Sri
T.T., Tirumala.
