Rule and Regulation V (1); Standard of Conduct Rule and Regulation [X (48); Derogatory Ethnic Remarks PERSONS INTERVIEWED Deputy Frank Di Orsini ID #12462 Focus) Officer Courtney Sullivan, West Pelm Beach Police Department (WPBPD) DOCUMENTARY EVIDENCE Employee Notification of Complaint (Deputy Di Orsini) Officer Sullivan's Body Camera Footage June 21, 2017 (DVD) Burglary Report WPBPD Case #17-12070 Compact Disc Statement of the following: © Officer Sullivan WPBPD © D/S Frank Di Orsini (Focus) PBA Notice of Representation (Brennan Keeler) Garrity Rights Form Documentary Evidence Form INVESTIGATIVE REPORT On July 10, 2017, I received a Digital Video Dise (DVD) in the mail addressed to the Palm Beach County Sheriff's Office (PBSO), Department of Internal Affairs. The packaging, which housed the disc, gave no indication of its origin, Inside the box, the DVD protective sleeve noted a case #17-12070 and the name, “Allison.” A typed written note wrapped around the disc said, “PBSO Deputy saying racial slurs in froat of WPB officer”, “It smells Like ggg dicty iggy in my QAR.” Upon viewing the DVD Tleamed the following. Sey rey The contents of the video originated from the body camera of WPBPD Officer Courtney Sullivan responding to a delayed vehicle burglary on June 21, 2017. Officer Sullivan exits her vehicle and meets with the victim, a uniformed, PBSO Deputy who was later identified as Frank Di Orsini, Deputy Di Orsini walks Officer Sullivan to the rear of his residence and shows het his personally owned 2013 Jeep Wrangler. He points to the rear passenger vinyl window, cut open, allowing someone to enter and steal money from his wallet he left in the driver's door panel ‘The video continues while they both check around the Jeep. At one point, the video captures PALM BEACH SHERIFE’S OFFICE | 3 DIVISION OF INTERNAL AFEAIRS CASE HPC 17-068 Deputy Di Orsini saying to Officer Sullivan, “It smells keiIiiiy dirty gimp in xy stam, car.” The video terminates just seconds later. Officer C ivan ‘On July 26, 2017, I met with Officer Sullivan at the WPBPD for the purposes of obtaining a sworn recorded statement as to her involvement with this investigation. The fotlowing is a synopsis of her sworn statement. Officer Sullivan confirmed she responded to a call for service at Deputy Di Orsini’s home where he reported his 2013 Jeep Wrangler was burglarized. She said Deputy Di Orsini showed her ‘where the unknown suspect(s) forcefully entered the Jeep by cutting the passenger side canvas top. Once inside, the suspeci(s) removed US currency from his wallet, after unlocking the driver's door, Officer Sullivan said, once she arrived, she activated her body worn camera system, pet WPBPD policy, when dealing with the public and responding to calls for service, She said Deputy Di Orsini made racial comments in her presence which she found offensive, She told me she shared the comment with another employee at WPBPD, but would not tell me who. Officer Sullivan denied requesting the DVD or mailing the DVD to PBSO. Sie said she terminated the video after the comment as she completed the evidentiary part of her investigation, Officer Sullivan did not recall any other racial comments off camera, Deputy Frank Di Ors On August 3, 2017, I obtained a swom recorded Garrity statement from Deputy Di Orsini Present during the interview as Deputy Di Orsini’s PBA representative was Attorney Brennan Keeler. Deputy Di Orsini was provided an opportunity to review the entire investigative case file including all recorded end written statements prior to providing his statement. ‘The following is a synopsis of the interview: Deputy Di Orsini said he reported the burglary to his personally owned vehicle to Officer Sullivan of WPBPD. He admitted the body worn camera video is @ true and accurate representation of what he said during the encounter. At the time, he said he was not aware the ‘encounter was being recorded. Deputy Di Orsini added he was upset and very mad, “Pissed” his property was violated. He said hhis emotions got the better of him and realizes be represents PBSO while in uniform and this behavior would not continue, PALM BEACH SHERIFF'S OFFICE | 4 DIVISION OF INTERNAL AFFAIRS. CASE #PC 17-068, INVESTIGATIVE REVIEW On July 10, 2017, PBSO Internal Affairs Division was made aware of body wom video camera footage involving Deputy Di Orsini using inappropriate, racial slurs while speaicing to an officer of the WPBPD. Deputy Di Orsini reported a burglary to his personally owned vehicle which was parked in the rear of his home in West Palm Beach, The video was viewed and captures Deputy Di Orsini, in fall uniform, saying to Officer Sullivan, “It smells like ggglammmplrty gigmaayin. cy ial.” Officer Courtney Sullivan provided information in her swom recorded statement confirming the conversation between her and Deputy Di Orsini captured on her body worn camera. ‘On August 3, 2017, in a swom recorded Garrity statement with Deputy Di Orsini, he admitted he used the racial slur as depicted in the video. He said he was very mad and upset over the burglary to his vehicle, RECOMMENDED FINDINGS. 1. A preponderance of evidence does exist to support the allegation that Deputy Sheriff Frank Di Orsini violated Palm Beach County Sheriff's Office Rule and Regulation V (1); Standard of Conduct. 2. A preponderance of evidence dags exist to support the allegation that Deputy Sheriff Frank Di Orsini violated Palm Beach County Sheriff's Office Rule and Regulation IX (48); Derogatory Ethnic Remarks.
