The Promulgation of thq Code on
Sanitation on December 23, 1975 bY
His Excellency, President Ferdinand E.
Marcos, is a significant landmark in the
histpry of our country's health and
sanitation effotts.
This Code on Sanitation has for its
ultimate objective the improVement of
the way of the Filipinos by directing
public health services towards the
protection and promotion of the health

Public healih laws ancl regulations
on sanitation in the Philippines used to
be sdattered in numerous volumbs of
our statute books. To look for them
when needed has often been a the code was exPedited. Further
cumbersome and tedioustask. Clearly,
there was a compelling need to compile
all existing public health laws and to
update them to make them truly respon-
sive to the Present daY needs of the
nation.
Hislorically, there have been three
major efforts to codifi our health laws
and regulations. I remember distinctly
that the initial one started more than 20
years ago when the late Dr' MarianQ
lcasiano, then City Hoalth Officer of
Manila, the late Dr. Amadeo Cruz, then
Director of Health Services and lurcrked
as a oommitteo on codification.-From
our efforts carne out a first draft of {he

code. LJnfortunately; our proposed ctlde
did not gain official sanction due to
conflicts of polit-ical interest whiGh
afflicted most of our agencies in the0ld
Society.
The two other subsequent efforts to
produce a code did not fare any betleri
Whil6 assistance and'support weie
received from various govemment and
private entities and individuals, they
were never enacted bY Congress; red
tape, social indifference and other
similar evils were to hilame'
With the advent of the New,SocietY
and'its atmosphere that was'conducive
to reform, work on the fourth draft of
impetus was afforded by the dyna'nribrn
which pervaded the Public health
service and by the Administrationls
s.oclal concern. President Marcos gave
it the force of law when he signed it as
Presidential Decree No. 856.
ln the various stages of
development of the code, there are
reflected signiflcant conlributions from
variOus dePartments, bureaus and
offices of the national govemment and
many civic and protessional societies.
Notable among them are the Regional,
frovincial and City Health Offices; the
National Environmental Protection
Commission; the Metropolitan Water
and Sewage System; the Population
Commission; the following departments
of the executive branch of the
govemment; Labor, Natural Resources,
Agriculture,' Educetion, and Finance;
the Philippine Public Health
Associatiou the Lepgue of PublicHeahh
Engineers; the'Rhilippine Society of
Sanitary EngineeB and-many others.
Acknowledgment is publicly made
of th'eir linilaluable supports and
interest.
Thb new Code on Sanitation ushers
ln a new era for public health in the
Phlllpplnos. lt marks'the consolidation
of what used to be disparate laws and
regulations into a single compact
volurne. With it, the problems of
cohfusion and misinformation -- orworse
-
still, {he lack of it were swept away.
That it is a modern and updated code
is shown by its ppverage of pll present
day business enterprises dnd
establislments. Being Sg, it should be
kept a living, vibrant document
-- relevant and responsive to the needs
of our communities end of the nation,
at large.
It is hoped that compliance by those

SEC. 4. Authority of the Secretary

Officers - The Health Offit;ers 'shall

of this Code and the rules and rr:gulations
promulgated by the Secretary under this
Code.
SEC. 8, Miscellaneous Provisions *
International treaties, agreenrent and
conventions * The republic of the
Philippines recognizes intemational
trealies agreement and convention on
public health. Their provis ions may be
considered parts of this Code
provided they do not contravene the
Constitution" existing larvs or any
provisions of this Code.
b. Rights and Proceedings -
Any-
proceeding which has comlrenced or
anv right which has accrued upon the
effectivity of this Code shall not be
affected by any of its provisions.
However, matters of procedure and

CHAPTER III _ FOON

SEC. 11. Sanitary Pernrit -
No person or entity shall operate
food establishment for public
patronage without securing il permit
from the local health offrce. The term
"food establishment" as used in this
food or drinks are manufactured,
processed, stored, sold or served.
Every Sanitary Permit shall be posted

SEC. 17. Structural Requirements
- Food establishment shall be constructed

cleanliness; or

for the purpgse; Provided,
That, in dopartment stores or
