Honorable Court, in support hereof respectfully avers that:

1. The herein witness __________________________________ is of legal


age, widow, Filipino citizen and a resident of 300 Magsaysay St., Sta.
Quiteria, Caloocan City;
2. ATTY. __________________________ is the lawyer who conducted
and supervised the examination of the said witness whose
testimony was taken and held at his Office located at the
________________________________________________; and

3. The witness is answering the questions asked of her fully


conscious and that she does so under oath and is aware that
she may face criminal liability for false testimony or perjury.

By way of offer, herein witness,


________________________________ is being presented on DIRECT
EXAMINATION as a witness for the petitioner on the following
matters, to wit:

1. To prove that she is the petitioner in this case;

2. To testify that her date of birth was erroneously registered in her


Certificate of Live Birth; and

3. To testify as to other relevant matters.

With the offer above, the questions were propounded in Tagalog,


a language known and understood by the witness, and translated in
English:

1. Q: Ms. Witness are you the same

2. Q: Do you remember having executed a Petition regarding this case?

A: Yes Sir.

3. Q: If that petition will be shown to you will you be able to identify the
same?

A: Yes Sir.

4. Q: I am showing to you a petition entitled “IN RE: PETITION FOR


CORRECTION OF ERRONEOUS ENTRY AS TO THE DATE OF BIRTH FROM
November 09, 1965 TO November 09, 1962 AS APPEARING IN THE
CERTIFICATE OF LIVE BIRTH OF _____________________________________”
is this the same petition that you executed?

A: Yes Sir.
Manifestation: Your Honor, may we pray that the petition as
identified by the herein witness be marked as Exhibit “G”.

5. Q: Why did you execute the petition and file this case?

A: I need to have an entry in my birth certificate corrected sir.

6. Q: I am showing to you documents which were attached as Annexes


“A” and “B” to your petition, will you see if this is the copy of your birth
certificate as issued by the National Statistics Office and the Municipal
Civil Registrar of San Juan, Abra, respectively?

A: Yes sir.

Manifestation: Your Honor, may we pray that the certificate of live


birth of ______________________________________________ as
issued by the National Statistics Office and the Municipal Civil
Registrar of San Juan, Abra, be marked as Exhibits “H” and “I”,
respectively.

7. Q: What entry in your birth certificate needs to be corrected?

A: The Date of my Birth sir.

8. Q: How did you discover that your date of birth as reflected in your
certificate of live birth was erroneous?

A: Sometime in March 26, 2015, I secured a copy of my birth certificate


from the Municipal Civil Registrar of San Juan, Abra and upon
receiving and perusing it, I was surprised to find out that my date of
birth as reflected therein was wrong.

9. Q: What is your date of birth as entered in your Certificate of Live Birth?

A: November 9, 1965, sir.

10. Q: To what date do you need to change it to?

A: To November 9, 1962, sir.

11. Q: Why do you need to change it to November 9, 1962?

A: That is my correct date of birth and I have been using the same
since my childhood days, to my school days and even for work
purposes.
12. Q: How is it that what was entered in your certificate of live birth
was November 9, 1965?

A: I can only surmise that the one who supplied the information during
the registration of my birth certificate on October 1, 1997 caused an
inadvertent and unintentional error in entering my date of birth.

13. Q: Who was the one who supplied the information in your birth
certificate?

A: It was one ___________________________ Sir.

14. Q: Do you have any proof other than your own testimony that your
date of birth is really November 9, 1962?

A: Yes sir.

15. Q: What proof are those?

A: My Baptismal Certificate, my secondary student’s permanent


record, my voter’s identification card, my marriage contract and an
affidavit of two disinterested persons stating that they know that I was
born on November 9, 1962 and not November 9, 1965.

16. Q: I am showing to you a Baptismal Certificate which was attached


as Annex “D” in your petition, will you examine it and tell me if that is
the Baptismal Certificate that you are talking about.

A: Yes Sir. This is the Baptismal Certificate that I was talking about.

17. Q: I am showing to you a Secondary Student’s Permanent Record


which was attached as Annex “E” in your petition, will you examine if
that is the Secondary Student’s Permanent Record you were saying.

A: Yes Sir. This is my Secondary Student’s Permanent Record.

18. Q: I am showing to you a photocopy of a Voter’s Identification Card


which was attached as Annex “F” in your petition, will you tell me if
that is the Voter’s Identification Card that you are talking about.

A: Yes sir. This is my Voter’s ID.


19. Q: I am showing to you a Marriage Contract contracted by a
certain ___________________________________________________________
and was attached as Annex “C” in your petition, will you please
examine the same and tell me if that is the Marriage Contract that you
are talking about.

A: Yes sir. That is the marriage contract that I was talking about.

20. Q: I am showing you an Affidavit of Two Disinterested Persons


executed by a certain __________________________________________
and was attached as Annex “G” in your petition, can you please
examine it and tell me if this is the affidavit that you are talking about?

A: Yes Sir. That is the Affidavit that I was talking about.

21. Q: Now, Ms. Witness, in all of the documents that you have just
identified, what is your date of birth as entered therein?

A: November 09, 1962, sir.

Manifestation: Your Honor, may I pray for the marking of the


documents identified by the witness as follows:

The Baptismal Certificate identified by the Witness as Exhibit “J” and


the date of birth therein as Exhibit “J-1”;

The Secondary Student’s Permanent Record as Exhibit “K” and the


Date of Birth as Exhibit “K-1”;

The Photocopy of the Voter’s Identification Card as Exhibit “L” and


the date of birth therein as Exhibit “L-1”;

The Marriage Contract as Exhibit “M” and the age and birthdate of
_____________________ as entered therein as Exhibit “M-1”; and

The Affidavit of two disinteresed persons as Exhibit “N”.

22. Q: Are there more entries to be corrected in your Certificate of Live


Birth?
A: No more, all the other entries are correct, sir.

23. Q: What is the necessity of this petition?

A: It is necessary to correct the errors in my Certificate of Live Birth in


order to state the true and correct facts in my certificate of live birth
and to avoid any confusion.
24. Q: Were you ever been accused of any criminal offense anywhere
in the Philippines?

A: No sir.

25. Q: What are the effects of these erroneous information to you?

A: Such discrepancies greatly affect my personal data, and in order


to avoid confusion and to remedy the problem, I humbly ask the court
to direct the Local Civil Registrar to cause to be made the correction
of my Certificate of Live Birth as to my date of birth.
