JOINT AFFIDAVIT OF ADVERSE CLAIM

WE, DOLORES CASAY CADUCIO of legal, widow, Filipino and a

resident Dalaoig, Alcala, Cagayan and ROSE CASAY BUTAY also
of legal age, Filipino, married, and a resident of Dalaoig, Alcala,
Cagayan after having been sworn to in accordance with law, depose
and say:

1. That we are one of the heirs of the late Faustino Casay;

2. That OCT No. P-24766 is registered in the name “Heirs of

Faustino Casay, represented by Dominador Casay”, containing
an area 17,607 square meters;

3. That Dominador Casay is the father of Rose Casay Butay

4. That a certain Servando Batan, Jr. occupied the entire area by

virtue of a Deed of Sale allegedly entered into by Dominador
Casay and herein Servando Batan, Jr.;

5. That such Deed of Sale bears a distinct signature of our father

Perdo Adviento making it so suspicious;

6. That by virtue of such fraudulent sale, Magdalena Adviento

caused the cancellation of the TCT No. T-12783 and had it be
titled anew under TCT No. T-126324;

7. That it has come to my knowledge that Magdalena Adviento

caused the sale of the same lot to another person and such
person is presently claiming to have an interest over the
aforementioned parcel of land and is attempting to sell,
dispose and caused the titling of the same;

8. That with fear that our rights as heirs over the parcel of land
left to us by my father us our inheritance be transgressed, I
cause this adverse claim;
 9. That unless an adverse claim is annotated on the
aforedescribed Transfer Certificate of Title T-126324, the heirs
of PEDRO ADVIENTO are in danger of being defrauded and
deprived of their just and valid right over the aforedescribed
parcel of land and, as such, I am executing this Affidavit in
support of my request for the annotation of an adverse claim
over the parcel of land described herein.
