INFORMATION
The undersigned accuses TOM CRUISE of the crime of ATTEMPTED
MURDER, committed as follows:
That on or about June 17, 2018, in the Island Garden City
of Samal, Davao del Norte. Philippines, within the jurisdiction of
this Court, the above-named accused, with intent to kill, by means
of treachery and with the use of a knife, which the accused
conveniently provided himself, did then and there, willfully,
unlawfully and feloniously commence the commission of the
crime of murder directly by overt acts, by stabbing BRAD PITT,
but said accused did not perform all the acts of execution which
should have produced the felony of Murder as a consequence, by
reason of causes or accident other than his own spontaneous
desistance, that is, said BRAD PITT was able to evade the stab
employed by the accused and ran away for his safety.

I, BRAD PITT, 44 years old, married, driver and a resident of Purok-1,

Barangay Mambago-A, Samal Dist., IGACOS, after having been sworn in
the manner prescribe by law, I hereby depose and say that:

PRELIMINARY JUDICIAL STATEMENT

I am answering the question asked by PO1Jet Lee, Investigator of

Penaplata Police Station, said statement was conducted in the same
policstation, fully conscious and aware that, I do so under oath and that I may
face criminal liability for perjury and false testimony:

Q-1: Are you same person who execute this Affidavit which will
also serve as your Affidavit complaint?
A-1: Yes, I am sir.

Q-2 Why are you here in Penaplata Police Station?

A-2 To give a statement for filing a case Sir.

Q-3: What case do you want to file?

A-3: A case of Attempted Murder.

Q-4: Who is the suspect of this case?

A-4: Tom Cruise, of legal age, jobless and a resident of Purok-2,
Barangay Mambago-A, Samal Dist., IGACOS.
 Q-5: Can you tell us the whole incident?
A-5: Yes Sir, at around 1:40 PM of June 17, 2018, I together with my
daughter Angelina Pitt went at the basketball court in our Barangay at Purok-
2.

Q-6: What did you do there?

A-6: We went there to play basketball in connection to our incoming
Barangay Anniversary.

Q-7: Then, what happened next?

A-7: As I about to park my driven motorcycle near at basketball court,
Tom Cruise approached me and said in vernacular “PASENSIYA NA GABIE
TA”.

Q-8: Then what did you do after what he said?

A-8: I handshake him, but he took from the right portion of his waist
more or less six (6) inches long and he stabbed me.

Q-9: Did you sustain injury after the suspect stabbed you?
A-9: No sir, I manage to evade in order not to hit by the knife.

Q-10: What did you do after that?

A-10: Because of fear I run away from him.

Q-11: Where did you go?

A-11: I went to the house of Jackie Chan a retired Police Officer and a
neighbor to sought assistance, but he was not around so I proceeded to
Penaplata Police Station.

Q-12: Then what did you do at the Police Station?

A-12: I reported the incident and asked Police assistance.

Q-13: Then what happened next?

A-13: I together with the Personnel of Penaplata Police Station went to
the basketball court, wherein the house of Tom Cruise also situated near
thereat.

Q-14: Was Tom Cruise still at the area?

A-14: Yes, Sir, and he was arrested by PO1 Sylvester Stallone at
around 2:30 PM at the same date.

Q-15: I have nothing more to ask, do you have something to add

with your statements?
A-15: None Sir.

I, NICOLE KIDMAN, 24 years old, single, bar tender and a resident of

Purok-1, Barangay Mambago-A, Samal Dist., IGACOS, after having been
sworn in the manner prescribe by law, I hereby depose and say that:

PRELIMINARY JUDICIAL STATEMENT

I am answering the question asked by PO1Jet Lee, Investigator of

Penaplata Police Station, said statement was conducted in the same police
station, fully conscious and aware that, I do so under oath and that I may
face criminal liability for perjury and false testimony:

Q-1: Are you the same person who execute this Affidavit of
Witness?
A-1: Yes, I am sir.

Q-2: Why are you here in Penaplata Police Station?

A-2: To give statement as a witness regarding the stabbing incident
happened at around 1:40 P.M. of June 7, 2018 at Barangay Mambago-A

Q-3: Who is the victim of that incident?

A-3: Bradd Pitt Sir.

Q-4: Who is the suspect?

A-4: Tom Cruise, of legal age, jobless and a resident of Purok-2,
Barangay Mambago-A, Samal District, Island Garden City of Samal.
 Q-5: Can you tell us the whole incident?
A-5: Yes Sir, at around 1:40 P.M. of June 7, 2018 I was at the
basketball court, Barangay Mambago-A, Samal District, Island Garden City
of Samal.

Q-6: Why are you there?

A-6: I was there, because I’m one of the member of the sports
committee in our barangay and I was in charge of the basketball game in
connection to our upcoming Barangay Anniversary.

Q-7: Then, what happened next at around 1:40 P.M. of the same
date?
A-7: I was at the stage during that time 15 meters more or less, when
I saw Bradd Pitt and his daughter Angelina Pitt arrived.

Q-8: When they arrived what happened?

A-8: I saw Bradd Pitt parked his motorcycle near at the basketball
court, then Tom Cruise approached them.

Q-9: Then, what did you observed?

A-9: Tom Cruise was talking to Bradd and then Bradd hold the hand of
Tom.

Q-10: After that, what happened else?

A-10: I actually saw Tom Cruise took a knife from the right portion of
his waist and stabbed Bradd Pitt.

Q-11: Did the suspect hit Bradd Pitt with the knife?
A-11: No sir, Bradd manage to evade in order not to hit by the knife.

Q-12: Then, what happened next?

A-12: Bradd run away to Tom going to unknown direction.

Q-13: Did Tom chased Bradd?

A-13: No sir, but I actually saw Tom holding a knife and tried to chase
Angelina Pitt instead of Bradd.

Q-14: What else happened?

A-14: Tom Cruise returned to his house, and at around 2:30 P.M.
Bradd arrived together with the Police Officers and arrested Tom Cruise then
brought to Penaplata Police Station.

Q-1: Why are you here at Penaplata Police Station?

A-1: To give statement regarding the stabbing incident transpired at
around 1:40 P.M. June 17, 2019 at basketball court, Barangay Mambago-A,
Samal Dist., IGACOS.

Q-2: Who was the victim of the incident?

A-2: My father Bradd Pitt.

Q-3: Who is the suspect?

A-3: Tom Cruise, of legal age, a resident of Purok-2, Barangay
Mambago-A, IGACOS.

Q-4: Can you tell us the whole facts of the incident?

A-4: Yes sir, at around 1:40 P.M., June 17, 2018, I together with my
father went to basketball court at Purok-2, Barangay Mambago-A.

Q-5: Why were you there?

A-5: To play basketball Sir.
 Q-6: When you arrived there what happened?
A-6: I was onboard to my father motorcycle, then when we are about
to parked the motorcycle near the basketball court, Tom approached us and
said in vernacular to my father “PASINSYA NA GAVIE TA”.

Q-7: Then what happened?

A-7: My father handshake him, but after that I actually saw Tom took a
knife from right portion on his waist and stabbed my father.

Q-8: Did you father hit by Tom?

A-8: No sir, he managed to evade in order not to hit by the knife of
Tom.

Q-9: After that what happened to your father?

A-9: He ran away from Tom going to unknown direction.

Q-10: After your father run away what did you do?
A-10: Because of fear, I also run away but Tom tried to chase me
holding with a knife.

Q-11: What happened next?

A-11: After I feel safe, I follow my father going to the house of Jackie
Chan a retired Police Officer and our neighbor.

Q-12: When you arrived at the house of Jackie Chan, what did you
do?
A-12: We sought Police assistance to him, but because he is not
around we proceeded to Penaplata Police Station.

Q:13: What did you do at the Police Station?

A-13: We reported the incident and asked Police assistance.

Q-14: What happened after that?

A-14: My father together with the Police Officers went to the resident
of Tom Cruise.

Q-15: Did you also go there?

A-15: Yes sir.

Q-16: What happened there?

A-16: They arrested Tom and subsequently brought to Penaplata
Police Station.

Q-17: I have nothing more to ask, do you something more to add

with your statements?
A-17: There is nothing more that I could add to.

COUNTER-AFFIDAVIT
I, Tom Cruise, of legal age, Filipino, single and resident of Purok 2,
Brgy. Mambago-A, Samal Dist., IGACOS, Davao del Norte, after having
been sworn to in accordance with law, do hereby depose and declare that:

1. I am the respondent in NPS Docket No. XI-06-INQ-28F-00169 for

Attempted Murder, now pending before the Office of the City
Prosecutor of IGACOS;

2. The allegations in the Complaint against me is not true;

3. It is admitted that I know the Complainant since we are just neighbors

and living within the same community;

4. However, his allegations in his complaint are completely false;

5. The truth of the matter is that in the afternoon, at around 1:00PM of

June 17, 2018, I was at the house of my brother-in-law Roger Santos
at Brgy. New Pandan, Panabo City;

6. At around 2:00 in the afternoon, the two of us, together with four other
companions (Noel, Badong, Bebe and Uriel) went to witness a
cockfighting in Brgy. San Francisco, it was the eve of its Fiesta
Celebration, hence we decided to go there. Also, I was a member of
the group who organized the cock fighting;

7. The cockfighting was arena was just a make shift one and not
permanent, since it was only set-up on an empty lot and only because
of the upcoming fiesta of the Barangay.

8. After the cockfighting, all of us went to the house of my Aunt, Nene

Flores, to grab something to eat for our lunch, her house is just near
where the cockfighting was set up. During our lunch, we also took time
to drink alcoholic beverages to celebrate our winnings;

9. After taking our lunch, we went back to the galleria;

 10. I am executing this counter-affidavit to refute all the imputations of
wrongdoings against me, to inform the concerned authorities and this
Honorable Court of the foregoing facts and to attest to the truth thereof.
