TERMS & CONDITIONS

Payment Terms Payment deadline strictly within 10 working days from the time of approval Intimation.
10 working days from the date of issue of Delivery order. Failing this EMD/Auction amount/Security Deposit
will be forfeited without intimation and M/s. B.G. Shirke Construction Technology Pvt Ltd /Infra Bazaar will
dispose the material to other buyer.

Lifting Period In case any buyer purchased a lot and after making full or part payment removes part of the lot and fails to
remove the balance lot then after the stipulated time is over (Including any extension that is granted) the lot
will be treated as abandoned and whatsoever money is paid for the lot will be forfeited along with the down
payment etc. The balance lot will be disposed of by company as it deems fit.

All equipment will be delivered on Lot No basis only. Trading & Reselling of equipment from site will not be
permitted. Lots will be delivered in “As is where Is” basis.
Lifting Condition Documents like RC, RTO Taxes, Insurance, Permit, and Fitness etc will be given subject to availability. Any
(VERY IMPORTANT) pending Taxes, Insurance, Duties , Penalties, fitness etc are to be borne by the
Buyer only. Seller/Infra Bazaar Pvt Ltd will not take any responsibility in the future. Kindly check document
status before bidding in the Auction at Site.
All Bids will be sent to M/s. B.G. Shirke Construction Technology Pvt Ltd for final approval after timed Auction.
Post Approval M/s. B.G. Shirke Construction Technology Pvt Ltd is expected to confirm or reject the bids within 14 days from
the date of submission.
All offer bids are basic price only and applicable taxes & duties as per Law of the state will be in addition to

Bill will be issued in the name of the buyer(Bidder) on whom sale/Delivery order has been awarded and bill in
Billing favor of other then buyer will not be entertained. The buyer (bidder) will be responsible for arranging all
documents enroute. Customs duty, import duty as applicable, please checks with seller.

 EMD Return EMD of all unsuccessful bidders will be returned within 12 days.
On refusal of lifting/acceptance of Letter Of Award (LOA) or Non –payment within 10 working days by the H1
Bidder, the seller, (M/s. B.G. Shirke Construction Technology Pvt Ltd ) & Infra Bazaar Pvt Ltd would reserve its
EMD Forfeiture
right of disposal whomsoever as per their discretion and EMD amount so deposited as security money shall
be forfeited without any intimation.
Seller shall not be liable for non-performance of any contract either wholly or in part nor for any delay in
performance resulting due to cases beyond seller’s control including fire, strikes, lock out, closure, dispute
Force Major Clause with workmen, uncertain and unstable labor situations, accidents, damage or government force. Seller can
cancel the contract anytime for causes aforesaid and in such cases the buyer will not have any claim upon
seller of any kind.
If a dispute of any kind whatsoever arises out of this auction shall be settled amicably between buyer and
Arbitration & seller. Failing this the dispute shall be resolved with the help of any arbitrator. Venue of this would be
Jurisdiction Hyderabad(TG) . Infra Bazaar Pvt Ltd will not have any involvement or does not have any role to play in the
same.

 PAN No. & GST Registration No. / TIN No. is mandatory for participating in the Auction.
 All sales are strictly against applicable Sales Tax/ GST.
 The DD/pay order in favor of M/s. B.G. Shirke Construction Technology Pvt Ltd before taking delivery. PDC/ Cheques will
not be accepted..
 User Id will be activated only after confirmation of EMD’s receipt and other documents.
 For Bidding in Online Timed Auction please Refer Lot Nos Only.
 The reserve price would not be made public. The 3 Highest Bids will be submitted to seller for their consideration.
 Bidders should note that bid would be binding upon them. The bidders are advised to think before committing any lots.
The deposit will be kept with M/s. B.G. Shirke Construction Technology Pvt Ltd for all the highest 3 bids cases and will be
adjusted with your total payable amount if approved.
 Interested Bidders shall have free access at the Seller’s Premises with prior intimation for inspection of the Materials
under disposal. Lot details given are indicative and you are strongly advised to inspect the assets in the Seller’s ware
houses before bidding.
 All Sales & Disposals are strictly on “As is Where is” basis, and No Exceptions, thereof. Buyers should inspect the material
before placing the Bid & participating in the “Online Timed Auction”. Buyers are advised to obtain all relevant information
during inspection of the assets before Bidding. M/s. B.G. Shirke Construction Technology Pvt Ltd or Infra Bazaar Pvt Ltd
will not entertain any grievances post Auction and also Tax Liability, Warranty or Guarantee of the Quality, Quantity,
Measurement, Condition, Defects in any item/s or lot/s from the Bidder’s end.
 Infra Bazaar Pvt Ltd is an agency appointed as an auctioneer to facilitate auction on Internet by M/s. B.G. Shirke
Construction Technology Pvt Ltd They are expected to facilitate organizing and conducting an E- auction and are
considered as third party not particularly interested in the item being sold for and on behalf of M/s. B.G. Shirke
Construction Technology Pvt Ltd .
 Infra Bazaar Pvt Ltd runs its business on the basis of a robust Website. However Infra Bazaar Pvt Ltd. is out sourcing server
space from a third party hosting company and hence shall ensure the smooth running of the website in all good faith and
intention. M/s. B.G. Shirke Construction Technology Pvt Ltd / Infra Bazaar Pvt Ltd will not be held responsible for any
failure of power, network, server, hosting server, internet connectivity, ISP or otherwise at Bidder’s end or at M/s. B.G.
Shirke Construction Technology Pvt Ltd /Infra Bazaar Pvt Ltd directly or indirectly affecting online method of Bidding.
Bidders need to check it at their end and bid in advance and monitor their lots.

 Auto Extension of bid closing time is 2 minutes. If any bid placed in last 5 minutes of closing time of respective lot then it
will be extended for next 2 minutes and keeps on extending till bids are placed.
 The opening price of the lots and the bid increment value be available to the bidders on their bidding screen.
 Bidding can be done only by registered bidder.
 Bidder/s would need to pay an E.M.D. (Refundable/Adjustable) in the form of DD / Pay Order favoring M/s. B.G. Shirke
Construction Technology Pvt Ltd payable at Pune (CASH/ CHEQUE WILL NOT BE ENTERTAINED).
 On Refusal of Lifting / Acceptance of Sale order or Non-Payment within given time period by the H1 Bidder, the seller M/s.
B.G. Shirke Construction Technology Pvt Ltd ,would reserve its Right of disposal to whomsoever as per their discretion.
EMD amount so deposited as Security Money shall be forfeited without any intimation.
 “Bidder undertaking “shall be signed by the Bidders before participating in “Online Timed Auction “.
 Buyers are required to submit the following any one document along with Bidder Undertaking:
 PAN Card
 Voter Id Card or Pass Port or Driving License for address proof
 Valid Photo Identity is mandatory for participation
 Any communication with Company’s staff members excepting during the time of filing Bidder Undertaking with EMD” OR
any CARTEL among the Bidder, if reported , all disqualify the Bidder/s and will refrain the Bidder from taking participation
in the Auction.

VERY IMPORTANT

 The highest bidder does not get any right to demand acceptance of his offer / bid. M/s. B.G. Shirke Construction
Technology Pvt Ltd reserves the right to accept/ reject/ cancel any offer / bid, withdraw/add any portion of the assets at
any stage of Auction even after acceptance of offer / bid/ issue of delivery order or release order/ deposit of full value by
successful bidder without assigning any reason thereof. In the event of such rejection/cancellation/ withdrawal, M/s. B.G.
Shirke Construction Technology Pvt Ltd shall refund the value of assets, if paid for, to the successful bidder. Discretion lies
solely on M/s B.G. Shirke Construction Technology Pvt Ltd regarding this.
 No Lots can be removed without full payment being realized by M/s. B.G.Shirke Construction Technology Pvt Ltd . Delivery
will be given on presentation of original Delivery Order obtained from M/s. B.G. Shirke Construction Technology Pvt Ltd
/Infra Bazaar Pvt Ltd. Reselling/Trading of equipment from the site will not be permitted. If found so M/s. B.G. Shirke
Construction Technology Pvt Ltd reserves the right to forfeit the EMD deposited or impose Ground charges.
 Resale will not be recognized and the delivery orders will be issued in the name of the actual/original bidder only. If the
goods are found to be other than described in this catalogue, M/s. B.G. Shirke Construction Technology Pvt Ltd reserves
the right to refuse to deliver the goods and reject the bid at any stage. Any amount paid in part or full shall be refunded
without any interest.
 All loading and other expenses at the site are to the buyer’s account.
 The Bidder should have required registration as required in conducting the trade confirming to the legal conditions as laid
down by the Government of India, State Government and local authorities. Default in carrying out the contract due to any
breach in Government regulation shall be taken up seriously and may lead to forfeiture of EMD and disposal order value.
 Any Disputes related to the Assets / Documents, Post Sale, would be dealt by M/s. B.G. Shirke Construction Technology Pvt
Ltd only and Infra Bazaar Pvt Ltd does not have any involvement or does not have any role to play in the same.
 Packing and lifting of material will be the buyer(s) responsibility at their own Cost. Any mishap at the time of dismantling,
packing, pickup, loading of machines / Materials will not constitute any liability on M/s. B.G. Shirke Construction
Technology Pvt Ltd or Infra Bazaar Pvt Ltd end. The buyer is responsible to keep the warehouse & stockyard in order after

 removal of bidded lots. In case of non adherence, seller may reserve the right to impose penalties or forfeiture of payment
deposited.
 Any damage or loss caused to any of the disposal items, seller’s material, machines, vehicles, building or other property ,
seller’s employees, visitors or other contractor resulting from bidder or any of the bidder’s employee negligence, the
bidder is liable for all the losses, damages, or any other consequences. Seller will not be responsible for any claim
whatsoever.
 The price you have bidded for the Asset/s is excluding GST and you have to pay them along with GST.
 No cheque will be entertained. Buyers shall deposit the payment by Demand Draft / Pay Order / Banker’s Cheque / RTGS
to the M/s. B.G. Shirke Construction Technology Pvt Ltd and the Delivery Orders will be issued by M/s. B.G. Shirke
Construction Technology Pvt Ltd itself.
 If you do win, your EMD taken as token of Security Money will be adjusted as advance and M/s. B.G. Shirke Construction
Technology Pvt Ltd will give 7 working days time to pay the balance amount with taxes, if any. In case buyer retracts his
bids once the sale is finalized, deposited EMD will be forfeited without recourse. Please bid only if you are agreeable to
this clause.
 Delivery order will be issued in the name of Successful bidder once full Payment is cleared. Resale will not be allowed
before receipt of full and final payment by M/s. B.G. Shirke Construction Technology Pvt Ltd.
 All Assets must be removed from the Seller’s Premises at own cost of the Buyer within 10 working days of Payment made.
No resale or Trading of material /equipment awarded is allowed as long as they are kept at seller’s site. If found so then
the seller has right to forfeit EMD deposited or impose Ground charges as per their discretion.
 The Terms & Conditions as laid down shall be the binding part at the Bidder/s’ end and should be signed off before
participation in “Online Timed Auction “.
 Please Inspect the assets as there may be missing parts / equipment in the set. Please satisfy yourselves with the
condition of the equipment being sold. No complaints at any cost will be entertained after the auction.

YOU SHALL BE LIABLE TO PAY THE WINNING SALE AMOUNT along with GST if any without any EXCEPTIONS.

 I/We understand that my/our bid in an e-selling event would be construed as my/our acceptance to the General
Terms & Conditions for sale through Online Timed Auction available on Infra Bazaar Ltd (service providers) website
and the General Rules and Regulations governing conduct of Online Timed Auctions. I/We understand that if our bid
is accepted by the service provider, and approved by Seller, I/We are obliged to complete the transaction.
 I/We request Service Provider Infra Bazaar Ltd to allot User-id and password to me/us and activate the same to
participate in the above mentioned Online Auction.
 I/We agree that I/We shall change the password on receipt by me/us and keep it confidential. I/we agree that Infra
Bazaar Ltd (service provider) shall not be held responsible in any way for any losses that may be suffered by me/us as
a result of disclosure of the password to any other person by me.
 I/We understand that my/our inability to participate in an e-selling event due to disruption of my/our internet
services, or due to bandwidth problems with my/our local internet service providers are beyond the control of the
Infra Bazaar Ltd (service provider).
  I/We also agree that Sale Invoices pertaining to the Online Timed Auction Lot’s will be released by Seller in their
Normal Course was ever available and possible. Any Disputes related to the Asset / Documents, Post auction
modalities, would be dealt by Seller only and Infra Bazaar Ltd will not have any say in the same.
 Bidders shall have free access at the Seller’s Premises with prior intimation for inspection of the Materials under
disposal. Lot details given are indicative and you are strongly advised to inspect the assets in the Seller’s ware houses
before bidding.
 All pictures displayed in the auction are for illustration purpose only. Bidders are requested to visit the site/ yard for
assessing exact equipment condition, Bidding on the lots without prior inspection is Bidder’s risk and M/s. B.G. Shirke
Construction Technology Pvt Ltd / Infra Bazaar Pvt Ltd cannot be held responsible for that.
