ORDER

The Court en banc has considered the briefs and authorities in

this expedited election matter. This appeal concerns whether the Stop

Political Dirty Money Amendment, C-03-2018 (the “Initiative”),

qualifies for the November 6, 2018 general election ballot.

The Court holds that A.R.S. § 19-118(C) is not unconstitutional

facially or as applied in this case and that the superior court did

not err in disqualifying signature sheets pursuant to this

statute. As a result, the Initiative petitioners have not submitted a

sufficient number of signatures for placement of the Initiative on

the November 6, 2018 ballot. Because these issues are dispositive,

the Court does not reach other issues raised in the appeal or the

cross-appeal.

IT IS ORDERED affirming the superior court's judgment

disqualifying signature sheets pursuant to A.R.S. § 19-118(C). A

written opinion will follow in due course.
