Dear Mr. Burton,
Thank you for your response on behalf of Daimler Trucks North America (DTNA) to the
determination of the Oregon Department of Environmental Quality (DEQ) that the operation of
the DTNA facility on Swan Island in Portland, Oregon may be causing a nuisance. Your
agreement to negotiate in good faith to reach a Best Work Practices Agreement to abate the
suspected nuisance will be considered by DEQ as we work toward a prompt resolution of this,
matter.
DEQ's Northwest Regional Administrator (Nina DeConcini) will contact you by email in the next
24 hours to arrange an in-person meeting to discuss DEQ's determination that a nuisance may
exist, and steps that can be taken to abate the suspected nuisance. Given DEQ's
determination, itis important that this meeting ocour promptly, no later than the end of
September 2018. At that meeting, we are prepared to discuss DEQ's determination, which is
based on technical reports and other information attached to this letter, including its
consideration of the factors in OAR 340-208-0310. The primary purpose of the meeting,
however, is to discuss specific elements of a Best Work Practices Agreement. As stated in my
letter of August 15, 2018, if a complete nuisance abatement proposal is not submitted within two
months (by October 28, 2018), this matter will be referred for formal enforcement action.
