Dear Mr. Meloni ,
On behalf of Macomb County Prosecuting Attorney Eric J . Smith , this office has reviewed
your request for certain public records under the Freedom of Information Act (the "FOIA"), MCL
15 .231 et seq., dated August 29 , 2018 .
Pursuant to the FOIA , all persons are entitled , with few exceptions , to full and complete
information regarding both the affairs of government, and the official acts of those public officials and
public employees who represent the government . See MCL 15 .231(2) . Thus , as a public body, the
FOIA generally requires this office to produce its existing public records upon receiving a written
request for such records . See MCL 15 .233(1) . Of course , not all public records are subject to
disclosure , as certain public records are expressly exempt from disclosure by the FOIA . See MCL
15 .2 43(1 -2) . In addition , the FOIA does not require a public body to create an otherwise non -existent
public record merely because such a record is requested . See MCL 15 .233(5) . Nor does the FOIA
require a public body required to make a report , compilation , or any summary regarding its records .
See MCL 15 .233(4) . Rather, the FOIA simply obligates that this office , and any other public body,
produce any existing and non -exempt public records whenever it receives a written request for such
records . See MCL 15 .233(1) .
After a thorough review of the laws pertaining to the FOIA and governing disclosure of public
information and records , your request for the public records described in your FOIA request is
hereby GRANTED . In light of our decision , copies of the requested records have been enclosed herein ,
and this office will now consider the matter to be closed.
