APPLICATION FOR PROBATION

Accused, EDUARDO FRANCISCO y FRANCISCO, through the

undersigned counsel, respectfully apply for probation under the
provisions of Presidential Decree No. 968, as amended by Republic Act
10707 and hereby respectfully states that:

1. The accused is of legal age, Filipino, married and presently residing

at # 153 Kaypandan Street, Canuway West, Valenzuela City;

2. On the September 21, 2018 hearing of the above entitled case for
Attempted Homicide, the accused was found guilty for the lesser
offense of Less Serious Physical Injury for which the Honorable
Court sentenced the accused to a penalty of two (2) months and one
(1) day imprisonment and cost of suit;
 3. On the same hearing for the above entitled case for Malicious
Mischief, the accused was found guilty for which the Honorable
Court sentenced the accused to a penalty of eleven (11) days of
imprisonment;

4. That the accused has none of the following disqualifications as

provided under Section 9 of the Probation Law, to wit:

a) sentenced to serve a maximum term of imprisonment of more

than six (6) years
b) convicted of any crime against national security
c) have previously been convicted by final judgment of an offense
punished by imprisonment of more than six (6) months and
one (1) day and/or a fine of more than P1,000.00
d) have been once on probation under the provisions of this
Decree
e) who is already serving sentence at the time the substantive
provisions of this Decree became applicable pursuant to
Section 33 hereof;

5. That in view of the above, the accused is qualified to apply for

Probation.

PRAYER

In view of the above, it is hereby most respectfully prayed that the

Honorable Court grants the instant application for probation.
