Overview
You are required to do a group assignment during this Trimester. Each group shall have
five (5) members formed from the same lecture session (unless otherwise allowed). This
assignment carries 20% towards the final grade.

Objective

Your paper will be assessed on the basis of your research and analysis methods. On top of
that, it is essentially very important that you have a sound knowledge on the principle of
law in the allocated area.

Expected Outcome

You are expected to be able to analyse and apply the principles of law according to
relevancy in this field of study.

Instruction to students
 The length of the content of the assignment is 5,000 - 6,000 words only.

 The write-up must be composed in hard copy and soft copy forms. You shall retain a
copy for your own safekeeping.
 You are advised:
o (Content) to use Times New Roman, 12 pt size, alignment justified, 1 inch
margins on all sides (left, right, top and bottom) with double spacing on A4 size
paper. Paginate your work and add the total number of words.
o to staple (top left corner) and to punch 2 holes (at the left side centre) and DO NOT
comb-bind the assignment.
o to follow the general instructions stated in the Subject Pro-forma to this Subject.
There shall be included one standardised Cover Sheet only and one Group’s Self-
Assessment Sheet for the assignment (see pages 4 & 5 below). Each Sheet shall be
printed on one page only.
o to use collaborative tool [such as Google Docs (docs.google.com)] in drafting the
assignment.
 Cover page, acknowledgement, page content, bibliography and footnote are to be given
some importance.
 Method of submission:
o Hard copy: The assignment shall be submitted by putting inside my mailbox and
the group leader shall sign on the acknowledgement sheet which will be put up
outside my office on or before the Submission Deadline; and
o Soft copy: The assignment (properly compiled into one document file) shall
be sent by the group leader to our email addresses:
amir.amernudin@mmu.edu.my & asfarina.shakri@mmu.edu.my (using 1
email) and also submit to the MMLS on or before the Submission Deadline.

deduct 5 marks from the Total Marks. Assignment which is to be submitted five
(5) days from the deadline shall not be entertained and shall be given zero marks.

QUESTION

“The government can be classified as a cluster of public entities entrusted with the formal
authority to represent the entire community, while the developers is categorised as
entrepreneur who embark on land development projects, including the building of national
facilities and infrastructures”.
[Bell (2002) Journal of Design and Built Environment, Volume 8 pp 21-38]

In Malaysia, it has become regular that the decision of land development was initiated by
the government, for example execution of urban development plan on rural areas where
land acquisition took place on a huge scale. In some cases, even though the project
development was initiated by the government which involved land acquisition of private-
owned land, the implementation of the actual project is still in the hand of private
developers or entity. Amongst many cases brought up were issues on ‘land acquisition’
and ‘inadequate compensation’ to the landowners.

In the light of the above statement, discuss the following issues:

(a) The procedure of land acquisition by the State Authority under the National Land
Code 1965.

(b) The method(s) and criteria(s) of arriving at the value of ‘adequate compensation’
from the perspective of landowners as well as the State Authority.

Your opinion / advice shall be supported by relevant and necessary statutory provisions
and latest case laws. (You may make presumption of relevant additional facts in your write
