Our Ref, ASCH Your Re. 24 September 2018 Daly, Ho & Associates 3" Floor, Yam Tsz Commercial Building, 23 Thomson Road, Wan Chai, Hong Kong Dear Sirs, By his letters dated 17 July 2018 to the Hong Kong National Party (“HIKNP”), its Convenor and Spokesman, the Secretary for Security (“the Seeretary”) notified HKNP to make representations in writing as it thinks fit as to why an order under section 8(2) of the Societies Ordinance (Cap. 151) (“the Ordinance”) should not be made to prohibit the operation or continued operation of HKNP. The deadline imposed to receive any such representations fell on 5 p.m. on 14 September 2018 following three extensions of the original deadline. In the event, at around 8:45 p.m, on the day, we received a letter with enclosures dated 14 September 2018 written by you on behalf of your client, HKNP’s Convenor Chan Ho-tin, and at around 9:45 p.m, on the day, a letter with enclosures written by the solicitors of HKNP’s Spokesman Chow Ho-fai. Having considered the case including the said letters with enclosures, the Secretary has decided that it is necessary for him to make an order to prohibit the operation or continued operation of HKNP in Hong Kong in accordance with section 8(2) of the Ordinance in the interests of national security or public safety, public order or the protection of the rights and freedoms of others, The order takes effect on publication in the Gazette on 24 September 2018.
