Dear Judge Oetken:

I am lead counsel for the Plaintiffs in the above referenced action before your honor. I
write to inform the Court that all parties have agreed in principle to resolve this action and request
that your honor enter an Order of Discontinuance. The parties request that said Order conditionally
discontinue this matter without prejudice for thirty (30) days, after which time the dismissal will
be with prejudice. Plaintiffs reserve the right to reinstate the action to the active calendar of the
Court in the event that the parties are unable to resolve all final issues within that thirty (30) day
period.
